Capping Prescription Costs Act of 2018 This bill caps the monthly prescription-drug cost-sharing permitted under qualified health plans and group health plans.

Jeanette Acosta Invest in Women's Health Act of 2018 This bill amends the Public Health Service Act to authorize the Department of Health and Human Services (HHS) to provide support to public or nonprofit entities to expand certain preventive health services, with an emphasis on increasing access to cancer screening, particularly for women of color. The bill reauthorizes through FY2022: (1) programs related to breast and gynecologic cancers under Medicaid and family planning programs, and (2) the Centers for Disease Control and Prevention's National Breast and Cervical Cancer Early Detection Program. HHS must establish a demonstration grant program to train health care providers regarding breast and gynecologic cancer screening. HHS must study and report on access to women's preventive cancer screening, including cancer rates by state, cancer screening by state, and estimated federal savings achieved through early detection of breast and gynecologic cancer.

This bill amends the Internal Revenue Code to modify the rules for health savings accounts (HSAs) with respect to contribution limits, catch-up contributions for married couples, and medical expenses incurred before an HSA is established. The bill increases the maximum contribution limits for HSAs to equal the maximum for the sum of the annual deductible and out-of-pocket expenses that may be required to be paid for covered benefits under a high deductible health plan. If both spouses of a married couple have family coverage under a high deductible health plan, each spouse may make catch-up contributions to the same HSA. (Catch-up contributions are additional contributions which individuals who are at least 55 years of age may make to an HSA.) If an HSA is established within 60 days of the beginning of coverage under a high deductible health plan, any distribution from the HSA used to pay a qualified medical expense incurred during that 60-day period after the health coverage began is excludible from gross income. (Under current law, the medical expense must be incurred on or after the date that the HSA is established.)

Bipartisan HSA Improvement Act of 2018 This bill amends the Internal Revenue Code to modify rules for health savings accounts (HSAs) regarding eligibility and interactions with other tax-favored health accounts. The bill specifies that receiving or being eligible to receive certain employment-related items and services at an employer-sponsored (e.g., an on-site clinic) or retail health care facility is not considered health care coverage that disqualifies an individual from participating in an HSA. The items and services include physical examinations, immunizations, drugs other than a prescribed drug, treatment for injuries occurring in the course of employment, drug testing as a condition of employment, hearing or vision screenings, and other similar items and services that do not provide significant benefits in the nature of medical care. The bill also (1) allows an eligible individual to make HSA contributions if a spouse has a flexible spending arrangement (FSA) as long as the FSA does not also reimburse the expenses of the spouse with the HSA, and (2) modifies the rules for using FSA or a health reimbursement arrangement terminations or conversions to establish an HSA.

This bill amends the Internal Revenue Code to allow the high deductible health plans that are required for a health savings account to cover up to $250 of specified services (twice the amount in the case of family coverage) during a plan year without a deductible. The limit must be adjusted annually for inflation. The specified services covered by this bill include services other than preventive care that are identified under the terms of the plan. (Under current law, high deductible plans are already permitted to provide coverage for preventive care with no deductible.)

Non-Emergency Ambulance Transportation Sustainability and Accountability Act of 2018 or the NEATSA Act This bill decreases the percentage by which Medicare payments must be reduced in 2019 for nonemergency ambulance transports of end-stage renal disease patients. Beginning in 2020, the bill increases the percentage reduction for certain providers that mostly furnish such services.

Re-Valuing Anti-Microbial Products Act of 2018 or the REVAMP Act This bill amends the Federal Food, Drug, and Cosmetic Act to provide for an award of 12 additional months of market exclusivity to a drug manufacturer for a drug designated as a "priority antimicrobial product." (A priority antimicrobial product is intended to treat or prevent a disease attributable to a multi-drug resistant bacterial or fungal pathogen for which there is a critical unmet medical need.)

Thailand Veteran Agent Orange Parity Act of 2018 The Department of Veterans Affairs may provide to any spina bifida-affected child of a veteran who served on active duty in Thailand beginning on January 9, 1962, and ending on May 7, 1975, and who was exposed to a herbicide agent during such service, the same health care, vocational training and rehabilitation, and monetary allowance required to be paid to a similarly affected child of a Vietnam veteran. (The bill extends the presumption of service connection for certain diseases associated with herbicide exposure to such veterans, thus permitting health care benefits and disability compensation to be provided to their children.)

Marijuana Freedom and Opportunity Act This bill removes marijuana from the list of scheduled substances under the Controlled Substance Act and eliminates criminal penalties for an individual who imports, exports, manufactures, distributes, or possesses with intent to distribute marijuana. Additionally, the bill does the following: establishes a trust fund to assist women-owned and minority-owned marijuana businesses, requires federal research on the impacts of marijuana use on highway safety and public health, authorizes federal restrictions on the marketing of marijuana-related products, and authorizes grants for state and local governments to expunge or seal convictions for marijuana possession.

Centers for Disease Control and Prevention Emergency Response Act of 2018 This bill establishes a Centers for Disease Control and Prevention Emergency Response Fund; the fund may be used for certain emergency operations to detect, prepare for, or respond to a natural or manmade disaster, disease outbreak, or other public health emergency, domestically or abroad.

Protect Our Food From Phthalate Contamination Act This bill prohibits the use of any phthalate chemical as a food contact substance. (A food contact substance is any substance intended for use as a component of materials used in manufacturing, packing, packaging, transporting, or holding food if such use is not intended to have a technical effect in such food.)

Drug Discount Accountability Act This bill requires the Health Resources and Services Administration to collect a user fee from certain entities participating in the 340B drug pricing program, including critical access hospitals, for activities relating to program oversight and improvement.

Medicare Home Health Flexibility Act This bill establishes circumstances under which an occupational therapist may conduct an initial or comprehensive assessment for an individual who is eligible for home health services under Medicare. Specifically, an occupational therapist may conduct the assessment if the physician's referral order does not include skilled nursing care but does include: (1) occupational therapy, and (2) physical therapy or speech language pathology.

Calls on Congress to increase funding to existing programs that work to educate the public and health care professionals about PrEP. Helping to End Addiction and Lessen Substance Use Disorders Act of 2018 or the HEAL Act of 2018 This bill establishes a series of requirements under Medicare and Medicaid relating to substance-use disorder prevention and treatment, including educational programs, screening requirements, and prescription drug monitoring.

Countering Weapons of Mass Destruction Act of 2018 This bill amends the Homeland Security Act of 2002 to establish in the Department of Homeland Security (DHS) a Countering Weapons of Mass Destruction Office, headed by an Assistant Secretary. The Assistant Secretary shall serve as the principal advisor to DHS on weapons of mass destruction matters and strategies, and on coordinating efforts to counter weapons of mass destruction. The office shall coordinate DHS strategy and policy to plan, detect, and protect against the importation, possession, storage, transportation, development, or use of unauthorized chemical, biological, radiological, or nuclear materials, devices, or agents. The Assistant Secretary shall establish the Securing the Cities program to detect and prevent terrorist attacks and other high consequence events utilizing nuclear or other radiological materials that pose a high risk to homeland security in high-risk urban areas. The bill establishes in the office a Chief Medical Officer who shall serve as the principal advisor to DHS on medical and public health issues. DHS shall transfer to the office all personnel, budget authority, and assets of the Domestic Nuclear Detection Office and the Office of Health Affairs.

Mental Health Care for Children Inhumanely Separated from Parents by the Federal Government Act of 2018 This bill requires the federal government to ensure that children who are separated from their parents at the border by the Department of Homeland Security receive mental health services for free, including a mental health assessment within 24 hours of such separation and annually thereafter. Children who have already been separated (since April 6, 2018) must receive a mental health assessment within 24 hours after enactment of this bill.

Nationally Enhancing the Wellbeing of Babies through Outreach and Research Now Act or the NEWBORN Act This bill requires the Health Resources and Services Administration to support pilot programs that address infant mortality. Specifically, grants must be awarded to local and tribal health departments in areas with the highest rates of infant mortality to establish pilot programs that address specified issues, including birth defects, premature births, and sudden infant death syndrome.

Pharmaceutical Origin Transparency Act of 2018 This bill amends the Federal Food, Drug, and Cosmetic Act to require a drug manufacturer to publish information about each country in which its drugs are manufactured. (A drug is manufactured in a country if the active pharmaceutical ingredient is manufactured in such country.)

Strengthening Antibiotic Oversight Act This bill requires the Food and Drug Administration to review the duration of use of medically-important antibiotics in animals. This applies to antibiotics approved for use in animals for a duration that exceeds 21 days.

Building a Health Care Workforce for the Future Act This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to award matching grants to enable states to implement scholarship programs to ensure an adequate supply of health professionals. Scholarships must cover tuition and educational expenses and provide a cost-of-living stipend. Scholarship recipients must agree to serve as providers in shortage areas in the state for one year for each year they receive the scholarship. HHS may award grants to assist medical schools in developing and strengthening primary care mentorship programs and cultivating leaders in primary care among its students. In order to foster curricular innovations to improve the education and training of health care providers, HHS must award grants to medical and other health professions schools to promote priority competencies that are selected annually by the Advisory Committee on Training in Primary Care Medicine and Dentistry. The National Academy of Medicine (formerly known as the Institute of Medicine) must study the documentation requirements for cognitive services under Medicare, Medicaid, and private health insurers, including whether the requirements are overly burdensome.

Ambulatory Surgical Center Payment Transparency Act of 2018 or ASC Payment Transparency Act of 2018 This bill requires the Centers for Medicare & Medicaid Services (CMS) to specify the criteria used to exclude certain procedures from the list of covered surgical procedures that may be performed in an ambulatory surgical center under Medicare. The CMS may not exclude a procedure on the basis that the procedure can only be reported using an unlisted surgical procedure code. The bill also requires the expert outside advisory panel that reviews the Medicare prospective payment system for hospital outpatient department services to include at least one ambulatory surgical center representative.

Know the Lowest Price Act of 2018 This bill prohibits a health-benefits plan or pharmacy-benefits manager under Medicare or Medicare Advantage from restricting a pharmacy from informing an enrollee of any difference between the price of a drug under the plan and the price of the drug without health-insurance coverage.

Patient Right to Know Drug Prices Act This bill prohibits a health insurance plan or pharmacy benefits manager from restricting a pharmacy from informing an enrollee of any difference between the cost of a drug under the plan and the cost of the drug without health insurance coverage. (Such restrictions are commonly referred to as gag clauses.)

Medicare Secondary Payer and Workers' Compensation Settlement Agreements Act of 2018 This bill alters provisions relating to Medicare secondary payer rules with respect to workers' compensation settlement arrangements. Among other things, the bill provides that a Medicare set-aside fulfills secondary payer obligations if the set-aside is included in the arrangement and meets certain other criteria.

Physician Visa Reform Act of 2018 This bill amends the Immigration and Nationality Act to allow alien physicians who are approved by a state licensing authority to practice medicine in an area having a shortage of health care professionals to engage in medical practice without having to pass the otherwise required medical board examination. The bill also grants such physicians and family members conditional permanent resident status.

Choose Medicare Act This bill requires the Department of Health and Human Services to establish public health plans that are available on health insurance markets, subject to specified requirements; the bill also makes a series of changes related to health insurance costs, including alterations to cost-sharing provisions and the authority to negotiate prices under the Medicare prescription drug benefit.

Dr. Todd Graham Pain Management, Treatment, and Recovery Act of 2018 This bill establishes several requirements for the Centers for Medicare & Medicaid Services (CMS), and alters requirements under Medicare and Medicare Advantage (MA), related to pain management and opioid use. Among other requirements, the CMS must review payments under Medicare for opioid and non-opioid pain management procedures, specifically with respect to ambulatory outpatient surgical procedures and hospital outpatient department services. The CMS must ensure that there are no payment incentives for using opioids instead of non-opioid alternatives and must make revisions accordingly. The bill also requires payment under Medicare to federally qualified health centers and rural health clinics that have health care practitioners who are newly certified to provide medication-assisted treatment (e.g., buprenorphine). The bill also authorizes the suspension of payments to a pharmacy under the Medicare prescription drug benefit and MA prescription drug plans pending the investigation of a credible allegation of fraud by the pharmacy.

Promoting Access to Diabetic Shoes Act This bill allows a nurse practitioner or physician assistant to fulfill documentation requirements for coverage, under Medicare, of special shoes for diabetic individuals. Under current law, such requirements may be satisfied only by a physician.

State-Based Universal Health Care Act of 2018 This bill repeals and replaces existing Section 1332 waiver provisions under the Patient Protection and Affordable Care Act (also known as State Innovation Waivers) with waiver provisions that allow states to establish comprehensive universal health care plans, in accordance with specified requirements.

Overdose Prevention and Patient Safety Act This bill amends the Public Health Service Act to align federal privacy standards for substance use disorder (SUD) patient records more closely with standards under the Health Insurance Portability and Accountability Act (HIPAA). Specifically, the bill authorizes the disclosure of SUD patient records without a patient's written consent to: (1) a covered entity for the purposes of treatment, payment, and health care operations, as long as the disclosure is made in accordance with HIPAA; and (2) a public health authority, as long as the content of the disclosure meets HIPAA standards regarding de-identified information. Current law authorizes disclosure of SUD patient records without a patient's written consent only to medical personnel in a medical emergency, to specified personnel for research or program evaluations, or pursuant to a court order. The bill also repeals and replaces criminal penalties for certain violations involving SUD patient records with the HIPAA civil penalty structure. It also applies HIPAA criminal penalties to wrongful disclosures of SUD patient records. In addition, the bill expands the current prohibition against using SUD patient records in criminal proceedings to include any use in specified federal, state, and local criminal and civil actions. The bill prohibits certain discrimination based on the release of SUD information under this bill.

Sober Home Fraud Detection Act This bill requires the Department of Health and Human Services to publish common indicators of potentially fraudulent or disreputable recovery housing (alcohol- and drug-free shared living environments that promote recovery from substance use disorders), such as with respect to unusual billing practices, longer than average occupancies, and excessive levels of drug testing.

Prematurity Research Expansion and Education for Mothers who deliver Infants Early Reauthorization Act of 2018 or the PREEMIE Reauthorization Act of 2018 This bill reauthorizes through FY2023 and revises the Prematurity Research Expansion and Education for Mothers who deliver Infants Early Act. Among other changes, the Centers for Disease Control and Prevention must publish its research report on its website. Additionally, the bill amends the Public Health Service Act to authorize certain educational programs about preterm birth to also include information relating to substance-use disorders, depression, and immunization.
