Give Kids a Chance Act of 2023 This bill authorizes certain targeted clinical trials involving combinations of drugs to treat pediatric cancer. Specifically, the bill modifies requirements relating to molecularly targeted pediatric cancer investigations so as to authorize investigations of new drugs that are used in combination with active ingredients that have already been approved and that (1) have been determined to be the standard of care for treating a pediatric cancer, or (2) have been approved to treat an adult cancer and are directed at molecular targets for pediatric cancer. The Food and Drug Administration must issue guidance and report on the bill's implementation. The Government Accountability Office must report on the effectiveness of the bill's changes with respect to the development of pediatric cancer drugs.

Expanded Telehealth Access Act This bill expands the types of health care practitioners who may provide telehealth services under Medicare. Specifically, the bill permanently allows audiologists, physical therapists, occupational therapists, speech-language pathologists, and other providers designated by the Centers for Medicare & Medicaid Services to provide telehealth services under Medicare. It also specifically allows occupational therapy assistants and physical therapist assistants to provide such services.

Medicaid Third Party Liability Act This bill modifies requirements relating to Medicaid third-party liability. Current law generally requires legally liable third parties (e.g., health insurers) to pay claims before Medicaid. However, Medicaid must pay first (and seek reimbursement from liable third parties) for claims for (1) preventive pediatric care, and (2) services for an individual for whom child support enforcement is being conducted by the state. The bill repeals these exceptions. Current law also requires state Medicaid programs to take all reasonable measures to identify legally liable third parties. The bill specifically prohibits federal Medicaid payment for services to individuals for whom third-party insurance information was not obtained and verified by the state.

Helping Ensure Access to Local TeleHealth Act of 2023 or the HEALTH Act of 2023 This bill modifies requirements relating to Medicare coverage of telehealth services, including services that are furnished by federally qualified health centers (FQHCs) and rural health clinics (RHCs). Specifically, the bill expands coverage to include audio-only telehealth services. It also permanently allows FQHCs and RHCs to serve as the distant site (i.e., the location of the health care practitioner) for telehealth services and excludes such services from certain geographic restrictions. Payment must be made in the same manner as for non-telehealth services, rather than in accordance with a separate methodology determined by the Centers for Medicare & Medicaid Services.

Humanitarian Standards for Individuals in U.S. Customs and Border Protection Custody Act This bill imposes requirements and standards related to the care of non-U.S. nationals ( aliens  under federal law) in U.S. Customs and Border Protection (CBP) custody. CBP must conduct an initial health screening of each individual in custody to identify those with acute conditions and high-risk vulnerabilities and to provide appropriate healthcare. CBP must conduct the screening within 12 hours of each individual's arrival at a CBP facility, and within 6 hours for certain priority individuals such as children and individuals with disabilities. The bill imposes various requirements related to providing such screenings, such as providing interpreters, chaperones, and mental health treatment when necessary. CBP must ensure detainees have access to drinking water, toilets, sanitation facilities, hygiene products, food, and shelter. The bill imposes certain standards relating to such requirements, such as the minimum amount of drinking water for each detainee and the acceptable temperature range of the shelters. The Department of Homeland Security (DHS) must enter into memoranda of understanding with various government agencies to address instances when surge capacity is necessary. The DHS Office of the Inspector General must conduct unannounced inspections of ports of entry, border patrol stations, and detention facilities and report the results to Congress. The Government Accountability Office must assess CBP's management of such facilities, whether CBP and DHS processes are in compliance with this bill's requirements, and the behavior of CBP personnel in carrying out this bill. DHS shall publicly release on its website, on a quarterly basis, aggregate data on complaints of sexual abuse at CBP facilities.

Safe Medicine Act This bill addresses issues related to the manufacture of drugs, including essential medicines. The Department of Health and Human Services, the Department of Defense, and the Department of Veterans Affairs must jointly develop and implement a strategy to increase the domestic production of essential medicines, medical countermeasures, and critical inputs. If the Food and Drug Administration determines that a drug or active pharmaceutical ingredient is manufactured in a country that may be producing contaminated drugs or ingredients due to systemic manufacturing-related problems, the labeling for that drug or ingredient must have a boxed warning about the potential for contamination. For government procurement purposes, the President's authority to waive certain purchasing requirements that discriminate against foreign products may not be used to waive any preferences for goods that are essential medicines, medical countermeasures, or critical inputs.

Expanded Coverage for Former Foster Youth Act This bill modifies provisions relating to the coverage of former foster youths under Medicaid. Under current law, a state Medicaid program must cover former foster youths until the age of 26 if the youths were in a state's foster care system at the age of 18 and were enrolled in a state's Medicaid program while in foster care. The bill requires state Medicaid programs to also cover former foster youths who were placed in a legal guardianship with a kinship caregiver or were emancipated from foster care before the age of 18. The bill repeals the provision that requires former foster youths to have been enrolled in a state Medicaid program while in foster care in order to qualify for Medicaid coverage until the age of 26. The bill also requires states to establish Medicaid outreach and enrollment programs for former foster youths.

Seniors’ Access to Critical Medications Act of 2023 This bill allows physicians to dispense outpatient prescription drugs and related supplies to patients outside of their office buildings without violating certain prohibitions under the Stark law (i.e., the Physician Self-Referral Law) for Medicare and Medicaid. Current law requires physicians to dispense outpatient prescription drugs and related supplies to patients in their office buildings in order to qualify for an exception (the in-office ancillary services exception) under the Stark law. The bill specifies that, beginning on May 11, 2023, physicians may dispense outpatient prescription drugs and related supplies in locations other than their office buildings. The bill also requires the Centers for Medicare & Medicaid Services to withdraw specified guidance that contradicts the bill’s changes.

Temporary Reciprocity to Ensure Access to Treatment Act or the TREAT Act This bill temporarily authorizes the interstate provision of mental health telehealth services during a declared national emergency. Specifically, subject to scope of practice and other requirements, a health care professional may provide mental health services via telehealth in any U.S. jurisdiction based on that individual's authorization to practice in any one state or territory. The bill also provides certain related powers to health care professional regulatory bodies, such as medical boards. Specifically, a regulatory body may investigate and take disciplinary actions against a professional who provides services pursuant to this bill to a patient in that body's jurisdiction.
