Right to Contraception Act

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances the safety of contraception and cannot be achieved through less restrictive means. The bill also specifies that the prohibition preempts inconsistent state and local laws and applies in spite of other federal laws, including the Religious Freedom Restoration Act of 1993. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Greater Access to Telehealth Act This bill modifies the extension of certain Medicare telehealth flexibilities after the end of the COVID-19 public health emergency. Specifically, the bill provides that certain flexibilities continue to apply until December 31, 2026, if the emergency period ends before that date. The bill allows beneficiaries to continue to receive telehealth services at any site, regardless of type or location (e.g., the beneficiary's home); occupational therapists, physical therapists, speech-language pathologists, and audiologists to continue to furnish telehealth services; federally qualified health centers and rural health clinics to continue to serve as the distant site (i.e., the location of the health care practitioner); evaluation and management and behavioral health services to continue to be provided via audio-only technology; and hospice physicians and nurse practitioners to continue to complete certain requirements relating to patient recertifications via telehealth. The bill also delays implementation of certain in-person evaluation requirements for mental health telehealth services until January 1, 2027, or the first day after the end of the emergency period, whichever is later.

Expressing the sentiment of Congress that the Department of Health and Human Services should declare the monkeypox outbreak a public health emergency.

Rural Physician Workforce Production Act of 2022

Rural Physician Workforce Production Act of 2022 This bill allows certain hospitals to receive additional payment under Medicare for full-time equivalent residents who receive training in rural areas. Specifically, hospitals, critical access hospitals, sole community hospitals, and rural emergency hospitals may elect to receive payment for time spent by a resident in a rural training location if the resident trains for at least eight weeks in the location and the hospital pays the salary and benefits of the resident during this time. Additionally, hospitals may receive payment for all time spent by residents in a residency program in which 50% of all training is in rural locations, regardless of where the training occurs or specialty. Payments are based on the difference between the total amount of eligible payments (as determined by the Centers for Medicare & Medicaid Services) and the amount of graduate medical education payments received (if applicable).

Preventing Abortion Sanctuaries Act This bill prohibits the Department of Health and Human Services from providing funding to a state that permits abortions or that facilitates interstate travel for abortions. In particular, the prohibition on funding applies to any state that lacks laws providing gestational protection at any stage of development; establishes a fund, commission, or similar entity to provide direct financial or logistical support to an individual traveling to the state to receive an abortion; or prohibits enforcement of another state's laws authorizing civil actions against those who receive or seek abortions, perform or induce abortions, or otherwise aid or abet such conduct.

Chai Suthammanont Healthy Federal Workplaces Act of 2022

Chai Suthammanont Remembrance Act of 2022 This bill requires federal agencies to establish and publish safety plans that contain certain information for on-site employees and contractors during a nationwide public health emergency declared for an infectious disease. Specifically, the bill requires each agency to post a safety plan on its website that includes (1) the agency's mitigation efforts, including personal protective equipment provided and testing for on-site workers; (2) guidance on cleaning protocols and occupancy limits; (3) protections for employees whose work requires them to travel off-site; and (4) protocols that ensure the continuity of operations. Each agency must communicate the plan to new employees, contractors, and subcontractors not later than 30 days after an employee is hired or a contract is entered. Each agency's Office of Inspector General must report on whether the agency has published and implemented its safety plan.

Improving DATA in Public Health Act

Improving Data Accessibility Through Advancements in Public Health Act or the Improving DATA in Public Health Act This bill addresses the collection and reporting of public health data with a particular focus on electronic health information. Specifically, the Centers for Disease Control and Prevention (CDC) must designate data and technology standards for public health data systems no later than two years after enactment of this act. These standards must, among other requirements, align with standards designated by the Office of the National Coordinator for Health Information Technology (ONC). In addition, the ONC must study matters concerning the use of standards for certain laboratory information. Further, the CDC may require, subject to some limits, additional reporting of public health and health care data by health care providers, health departments, and other entities for public health surveillance. The CDC must establish a committee to advise on the implementation of this reporting. Additionally, the bill addresses agreements regarding access to, exchange of, and use of public health data, including for public health preparedness and response activities. The Department of Health and Human Services (HHS) must develop or update interagency agreements while the CDC and the Office of the Assistant Secretary for Preparedness and Response may develop and update agreements with health departments and other nonfederal entities. The bill also requires HHS to award grants and other support for developing and disseminating best practices to collect electronic health information. Entities eligible for the awards include state, tribal, and local governments; health care providers; and nonprofits.

Clinics that receive funding to provide family planning services must offer each patient with a positive pregnancy test the opportunity for nondirective counseling on (1) prenatal care and delivery; (2) infant care, foster care, and adoption; and (3) pregnancy termination. This counseling must include referrals if requested by a patient. Additionally, if a funding recipient makes subawards for the provision of family planning services, the recipient may not prohibit an entity from participating in a subaward program for reasons other than the entity's inability to provide family planning services.

Federal Mask Mandate Limitations Act

Federal Mask Mandate Limitations Act This bill requires prior congressional approval of any executive agency mandate that requires wearing masks or face coverings on commercial aircraft, trains, vessels, and public transportation. Before such a mandate may take effect, an agency must publish in the Federal Register and provide Congress and the Government Accountability Office (GAO) with scientific data, cost-benefit and economic impact analyses, and other information about the mandate's rationale. The GAO must, within 15 days, provide a report to Congress that assesses (1) the agency's compliance with the bill's provisions, and (2) the effect of the mask mandate on private-sector activity. Generally, the mandate shall not go into effect unless Congress approves it through a joint resolution; the bill sets procedures for the consideration of the joint resolution. However, the mandate may temporarily go into effect without congressional approval if the President determines the mandate is necessary to address (1) imminent health or safety threats or other emergencies, (2) the enforcement of criminal laws, or (3) national security.

Protecting Access to Medication Abortion Act

Protecting Access to Medication Abortion Act This bill directs the Food and Drug Administration (FDA) to take steps to allow patients to receive prescriptions for mifepristone, a drug approved by the FDA for medical abortion, via telehealth and for prescriptions for the drug to be filled by mail. (Mifepristone is subject to a Risk Evaluation and Mitigation Strategy, which imposes various safety-related requirements. During the COVID-19 public health emergency, the FDA suspended enforcement of the current strategy's requirement that the drug must be dispensed in person, and this suspension is still in effect. In December 2021, the FDA stated the data supported modifying the strategy to remove the in-person dispensing requirement.) Under this bill, the FDA must require the holder of the relevant approved drug application to submit a proposal to modify the strategy. The modification shall (1) remove the in-person dispensing requirement, (2) allow patients to access prescriptions for mifepristone via telehealth, and (3) authorize all pharmacies certified to dispense mifepristone to patients to do so via mail.

James M. Inhofe National Defense Authorization Act for Fiscal Year 2023

James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 This bill authorizes Department of Defense (DOD) activities for FY2023 and addresses other issues. For example, the bill authorizes the procurement of various items, including Ship-to-Shore Connector craft and replenishment oiler ships; limits or prohibits the retirement or reduction of certain weapons systems, including intercontinental ballistic missiles and certain aircraft; reduces inventory requirements for certain air refueling aircraft; requires the Government Accountability Office to assess the efforts to modernize the propulsion systems of the F-35 aircraft; requires DOD to conduct a pilot program on the use of sustainable aviation fuel; prescribes end strengths for the branches of the Armed Forces; expands Selective Service registration requirements, which currently apply only to qualifying male citizens, to cover all qualifying citizens; prohibits inducting any person into the Armed Forces under certain authorities without an act of Congress; requires the Army to establish sex-neutral fitness standards for combat military occupational specialties that are higher than those for noncombat specialties; requires DOD to reissue and update certain instructions relating to the confidentiality of servicemembers receiving mental health care; establishes regional centers of excellence for providing military specialty care; requires DOD to develop and issue implementing guidance for risk management for DOD pharmaceutical materiel supply chains; extends the authorities for certain activities in Iraq and Syria, including assistance to counter the Islamic State of Iraq and Syria; and prohibits using funds authorized by this bill for DOD participation in Saudi Arabia's offensive operations against the Houthis in Yemen unless specifically authorized by statute.

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances access to contraception and cannot be achieved through less restrictive means. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Protect S.T.A.T.E. Lines Act

Protect Statutory Termination of Abortions from Taxpayer-funded Excursions Lines Act or the Protect S.T.A.T.E. Lines Act This bill prohibits, subject to some exceptions, the use of federal funds to pay for an individual's interstate travel for an abortion. The funding prohibition does not apply to abortions performed in cases of rape or incest or when necessary to resolve a pregnancy-related physical condition that endangers the individual's life.

Standing with Moms Act This bill requires the Department of Health and Human Services (HHS) to disseminate information about pregnancy-related resources. Specifically, HHS must maintain a public website (life.gov) that lists such resources that are available through federal, state, and local governments and private entities. Additionally, HHS must maintain on its website a portal that provides a user, based on the user's responses to a series of questions, tailored information about pregnancy resources available in the user's zip code and risks related to abortion. HHS must develop a plan to conduct follow-up outreach to users of the portal (if the user consents to the outreach). States must recommend resources that meet criteria set by HHS for including through the portal. HHS may award grants to states to establish or support a system that aggregates resources to include on the portal. Further, the Health Resources and Services Administration must share information about life.gov and the portal through the Maternal Mental Health Hotline. HHS must also ensure that the life.gov website and hotline are available to families who speak languages other than English. The bill excludes from life.gov, the portal, and the hotline resources provided by entities that (1) perform, induce, refer for, or counsel in favor of abortions; or (2) financially support such entities. The bill also requires HHS to report on traffic to life.gov and the portal, gaps in services available to pregnant and postpartum individuals, and related matters.

CONNECT Act of 2022
