Equal Access to Information Act of 2020

Equal Access to Information Act of 2020 This bill requires federal agencies to take specified steps to ensure that individuals with limited English proficiency and people with disabilities can access the services, activities, programs, and benefits of those agencies, particularly during national or public health emergencies or under other specified circumstances. Specifically, each federal agency shall, within specified timeframes conduct demographic assessments of individuals with limited English proficiency and individuals with disabilities who are eligible to be served or likely to be encountered by that agency, establish within the agency a Language Access Working Group, prepare and submit to the Department of Justice (DOJ) an access plan for federally conducted programs and activities, and issue guidance for recipients of federal financial assistance under the agency's jurisdiction. DOJ shall review (1) each plan submitted within 120 days after receipt of the plan, and (2) the most recently submitted plan from each relevant agency not later than 7 days after an emergency has been declared. Agencies shall ensure stakeholder input to ensure meaningful access.

Medicare Orthotics and Prosthetics Patient-Centered Care Act This bill revises payment rules and establishes several requirements relating to coverage of orthotics and prosthetics under Medicare. Specifically, the bill requires suppliers of orthotics and prosthetics to meet certain standards with respect to licensure and accreditation, physical facilities, and liability insurance. Orthotists and prosthetists may also issue written orders for commercial purposes that meet specified standards; such orders must be signed by the treating physician. The bill also prohibits payment under Medicare for certain prosthetics and orthotics that are delivered via drop shipment (i.e., direct shipment to a beneficiary who has not received corresponding patient care from a health care practitioner).

Investments in Rural Transit Act of 2020 This bill increases the federal share of operating costs to 80% for projects in certain rural areas with high transit dependency that receive grants under the Formula Grants for Rural Areas program of the Federal Transit Administration. The program provides capital, planning, and operating assistance to states to support public transportation in rural areas with populations of less than 50,000. To qualify for the increased federal share, a project must serve an area that is an area of persistent poverty (a county in which at least 20% of the population has lived in poverty during the most recent 30-year period); a county in which at least 25% of residents are age 65 or older, a county designated as a health professional shortage area on the basis of a primary care or mental health care shortage, or a county with low population density of not more than 20 people per square mile of land area.

Make Billionaires Pay Act

Make Billionaires Pay Act This bill establishes a tax on the wealth increases of individuals with more than $1 billion in net assets during the COVID-19 (i.e., coronavirus disease 2019) pandemic and requires the Department of Health and Human Services (HHS) to pay the out-of-pocket expenses of individuals receiving medically-necessary care or services for a period of one year. First, the bill requires individuals with net assets of more than $1 billion on December 31, 2020, to pay a tax of 60% on the amount equal to the lesser of (1) the increase in value of their net assets during the period beginning on March 18, 2020, through such date, or (2) the value of their net assets that is greater than $1 billion. The Department of the Treasury must establish rules for the application of this tax to married individuals and this tax is not deductible for the purpose of federal income tax. Further, the bill covers the costs for services provided through public or private health insurance and to uninsured individuals, including prescription drugs and care related to COVID-19, for a period of one year beginning on the date of enactment of this bill. Health insurance plans are prohibited from increasing the cost-sharing requirements of plans while this program is in effect and HHS must report to Congress on the program on a weekly basis.

In addition, HHS must establish a process to accept information voluntarily provided by states concerning their federally supported mental health grants for incorporation into the dashboard. Getting Early Treatment and Comprehensive Assessments Reduces Emergencies Act of 2020 or the GET CARE Act of 2020 This bill directs the Centers for Disease Control and Prevention (CDC) to undertake actions to increase the number of individuals seeking recommended preventive care services, particularly during the COVID-19 (i.e, coronavirus disease 2019) pandemic. It also authorizes the Department of Health and Human Services to award grants to states, other jurisdictions, and certain nonprofits for activities and research related to preventive care services. Specifically, the CDC must award competitive grants to carry out a national campaign to increase awareness of, and disseminate information about, preventive care services. In carrying out the campaign, the CDC must consult with relevant public health and health care experts. The campaign must focus particularly on medically underserved communities, communities of color, and communities disproportionately affected by COVID-19. It must address, among other topics, misinformation about seeking preventive care during the COVID-19 emergency and the safety of health care facilities.

The USPS currently provides this tool to online retailers at no cost. In addition, the ONC must update regulations to require, as a condition of certification, that health information technology use the USPS standard for postal addresses.

Make Medications Affordable by Preventing Pandemic Price gouging Act of 2020 or the MMAPPP Act of 2020 This bill imposes licensing and price restrictions on federally supported drugs and other medicines intended to address COVID-19 (i.e., coronavirus disease 2019) or other public health emergencies. With respect to a COVID-19 drug patent developed using certain types of federal support, any license granted by the federal government shall be open and nonexclusive. Similarly, a licensee or assignee for such a patent shall grant open nonexclusive licenses for the patent. An entity that receives a license shall pay reasonable royalties to (1) the patent holder, or (2) the owner of marketing exclusivity rights granted by the Food and Drug Administration (FDA) that were terminated under this bill. The bill requires that such drugs be offered at a fair and reasonable price based on certain considerations, such as access. If the Department of Health and Human Services (HHS) finds that the price of any drug to address a public health emergency is excessive, HHS must void any FDA-granted exclusivity for the drug and grant open and nonexclusive licenses to other manufacturers. Such licenses are subject to reasonable royalty requirements.

Crisis Assistance Helping Out On The Streets Act or the CAHOOTS Act This bill allows state Medicaid programs to cover certain community-based mobile crisis intervention services for individuals experiencing a mental health or substance-use disorder crisis outside of a facility setting. Among other requirements, such services must be (1) provided by multidisciplinary teams composed of behavioral health professionals who are trained in trauma care and de-escalation techniques, (2) available 24-7, and (3) voluntary for the individual experiencing the mental health or substance-use disorder crisis. The bill provides an enhanced Federal Medical Assistance Percentage (i.e., federal matching rate) for such services, as well as specified funds for state planning and evaluation grants.

Suppress COVID–19 Act of 2020

Suppress COVID-19 Act of 2020 This bill provides additional funding for states, tribes, and territories to procure tests and related supplies and undertake contact tracing and other public health measures to suppress COVID-19 (i.e., coronavirus disease 2019) and the virus that causes it. It also reallocates certain other funding to jurisdictions for such public health measures. The additional amounts provided by the bill are designated as an emergency requirement pursuant to the Statutory Pay-As-You-Go Act of 2010 (PAYGO) and the Senate PAYGO rule, which excludes the budget effects from being counted for purposes of enforcing the PAYGO rules. In particular, the bill authorizes the formation of interstate compacts of states, tribes, and territories to procure COVID-19 tests and supplies, and it specifically reserves a portion of funding for jurisdictions that join compacts that meet requirements for transparency, governance, anti-corruption, and timeliness of test results. The Department of Health and Human Services (HHS) must also support the formation of, and cooperate with, these compacts. The bill also provides additional funding, and reallocates existing funding, specifically for contact tracing and other public health measures. To receive such funding, a jurisdiction must submit a plan, developed with relevant stakeholders, to HHS that details how it will suppress COVID-19 to levels recommended by the Centers for Disease Control and Prevention. HHS must provide guidance and undertake other efforts to coordinate these plans, such as by developing shared indicators. HHS must report within 30 days to Congress concerning the timeline for the distribution of these funds.

TREAT Act

Temporary Reciprocity to Ensure Access to Treatment Act or the TREAT Act This bill temporarily allows, subject to scope of practice and other requirements, a health care professional to provide in-person and telehealth services in any U.S. jurisdiction based on that individual's authorization to practice in any one state or territory. Specifically, health care professionals may provide these services in jurisdictions other than where they are licensed, certified, or authorized to practice for up to 180 days after the end of the COVID-19 (i.e., coronavirus disease 2019) emergency. In addition, the bill provides certain authorities to health care professional regulatory bodies, such as medical boards, to investigate and take disciplinary actions against a professional who provides telehealth services to a patient in that organization's jurisdiction pursuant to this bill. The bill also permits the Department of Health and Human Services to similarly expand the authority of health care professionals to provide these services in the event of future major disasters or emergencies.

K2 Veterans Care Act of 2020 This bill establishes a presumption of service-connection for certain diseases becoming manifest in a veteran who served on active duty at Karshi-Khanabad (K2) Air Base in Uzbekistan between January 1, 2001, and December 31, 2005. Specifically, there must be a presumption of service-connection for veterans who manifest illnesses that have a positive association with exposure to jet fuel, volatile organic compounds, high levels of particulate matter, depleted uranium, asbestos, or lead-based paint, as determined by the National Academies of Sciences, Engineering, and Medicine (NASEM). Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. Veterans who served at K2 Air Base during the specified period are eligible for Department of Veterans Affairs (VA) hospital care, medical services, and nursing home care for an illness that has been determined by NASEM to have a positive association with exposure to jet fuel, volatile organic compounds, high levels of particulate matter, depleted uranium, asbestos, or lead-based paint. The bill also expands the definition of an open burn pit, for purposes of the VA's open burn pit registry, to include burn pits located on land in Uzbekistan. A burn pit is an area used for burning solid waste in open air without equipment.

Safe Authorization for Vaccines during Emergencies Act or the SAVE Act This bill imposes requirements related to the emergency authorization of a vaccine during a declared public health emergency. If a sponsor of a product seeks Food and Drug Administration (FDA) authorization to use the product as a vaccine to address the threat causing the declared public health emergency, both the FDA and the product sponsor must meet with, and present product-related data and information to, the Vaccines and Related Biological Products Advisory Committee. The Department of Health and Human Services may make an exception to this requirement if convening a meeting would not be in the public interest. To receive an emergency authorization, the product sponsor must agree to seek FDA market approval for the vaccine within a certain time period. After an emergency authorization, the Advisory Committee on Immunization Practices shall report recommendations regarding the vaccine to Congress and the Centers for Disease Control and Prevention.

Uterine Fibroid Research and Education Act of 2020 This bill directs specified components of the Department of Health and Human Services to take certain actions to address uterine fibroids (i.e., muscular tumors that grow in the wall of the uterus and may cause pain, heavy menstrual bleeding, and reproductive issues). Specifically, the National Institutes of Health (NIH), working through the Office of Research on Women's Health, must undertake research activities on uterine fibroids. In carrying out this research, the office must coordinate with specified components of the NIH and other federal agencies. In addition, the Centers for Medicare & Medicaid Services must (1) collect data from Medicaid and the Children's Health Insurance Program about treatment and services related to uterine fibroids, and (2) develop a report in coordination with federal partners on federal and state expenditures for these treatments and services. Additionally, the Centers for Disease Control and Prevention (CDC), the Health Resources Service Administration (HRSA), and the Agency for Healthcare Research and Quality (AHRQ) must disseminate information about uterine fibroids, including the elevated risk for minority women and information regarding available treatments. Specifically, the CDC shall disseminate the information to the public, while HRSA and AHRQ shall disseminate it to health care providers.

Organ Donation Clarification Act of 2020 This bill specifies that certain payments and pilot programs relating to organ donation do not violate the National Organ Transplant Act, which prohibits the exchange of valuable consideration for human organs. Specifically, it excludes additional types of reimbursements and payments related to organ donation from the definition of valuable consideration , such as costs for (1) dependent care; (2) certain medical expenses for up to 10 years after a donation; (3) paperwork or legal services; and (4) term life insurance policies, subject to some limitations. In addition, the federal government, states, or local governments may carry out pilot programs to evaluate the effects of removing disincentives or providing noncash benefits on the availability of organs for transplant, provided these programs meet ethical and other conditions.

Increasing National Patient Access To Improved Effective Necessary Mental Health Treatment Act of 2020 or the INPATIENT Act of 2020 This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish programs that test the impact of expanding the coverage of certain psychiatric services under Medicaid. Specifically, the CMS must establish a demonstration program to test the impact of waiving the institutions for mental diseases (IMDs) Medicaid payment exclusion on specified metrics relating to inpatient psychiatric hospital services and substance abuse services. (Current law generally prohibits federal payment under Medicaid for services provided in IMDs for individuals under the age of 65, although states may receive payment through certain mechanisms like Medicaid demonstration waivers.) The CMS must also establish a pilot program to test the impact of eliminating the Medicare 190-day lifetime limit for inpatient psychiatric hospital services, particularly the impact on value, choice, and the alignment of inpatient mental health benefits with inpatient physical health care benefits under Medicare.

Healthy Flights Act of 2020 This bill provides authority for the Federal Aviation Administration (FAA) to impose any requirements on passenger and cargo air travel to protect the health and safety of air carrier crewmembers and passengers and to reduce the spread of such infectious disease through the aviation system during public health emergencies such as COVID-19 (i.e., coronavirus disease 2019). Among other provisions, the bill sets forth requirements relating to the use of masks and other protective equipment for airline passengers and certain airline employees; requires the FAA to provide certain employees, including any air traffic controller and airway transportation systems specialist, with masks and other protective equipment; mandates the development of a national aviation preparedness plan to ensure the aviation system is prepared to respond to epidemics and pandemics of infectious diseases; directs each air carrier operating an aircraft with a seating capacity of 20 or more to implement appropriate measures on a flight in air transportation for the purpose of reducing the likelihood of any passenger or crewmember contracting an infectious disease; requires the FAA to enter into an agreement with the National Academies to conduct a study on the transmission of infectious diseases, including airborne diseases, in the cabins of passenger airplanes; and establishes a Center of Excellence for Infectious Disease Response and Prevention in Aviation within the FAA.
