DIVISION A--FURTHER ADDITIONAL CONTINUING APPROPRIATIONS ACT, 2019 Further Additional Continuing Appropriations Act, 2019 (Sec. 101) This division amends the Continuing Appropriations Act, 2019 to provide continuing FY2019 appropriations to several federal agencies through the earlier of February 8, 2019 (December 21, 2018, under current law), or the enactment of the applicable appropriations legislation. It is known as a continuing resolution (CR) and ends the partial government shutdown that began when the existing CR expired because seven of the remaining FY2019 appropriations bills have not been enacted. (Five of the FY2019 appropriations bills were enacted earlier this year, including: the Department of Defense Appropriations Act, 2019; the Energy and Water Development and Related Agencies Appropriations Act, 2019; the Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2019; the Legislative Branch Appropriations Act, 2019; and the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2019.) The CR extends through February 8, 2019: the Department of Homeland Security Chemical Facility Anti-Terrorism Standards Program; the authority for the Department of Health and Human Services Biomedical Advanced Research and Development Authority to withhold from public disclosure certain technical data or scientific information that reveals vulnerabilities of existing medical or public health defenses against biological, chemical, nuclear, or radiological threats; and an exemption from antitrust laws for meetings and consultations to discuss the development of certain vaccines and drugs related to public health threats such as bioterrorism, pandemics, or epidemics. Additionally, the CR has the effect of extending through February 8, 2019, several authorities and programs that were extended in prior CRs, including: the National Flood Insurance Program, the Violence Against Women Act, the authority for the Environmental Protection Agency to collect and spend certain fees related to pesticides, the Temporary Assistance for Needy Families (TANF) program, and several authorities related to immigration. The CR also delays the release of required Congressional Budget Office and Office of Management and Budget sequestration reports. DIVISION B--MEDICAID EXTENDERS (Sec. 101) The division amends the Deficit Reduction Act of 2005 to make appropriations for FY2019, and otherwise revise, the Money Follows the Person Rebalancing Demonstration Program (Under this program, the Centers for Medicare & Medicaid Services must award grants to state Medicaid programs to assist states in increasing the use of home and community care for long-term care and decreasing the use of institutional care.) (Sec. 102) Additionally, the division temporarily extends the applicability of Medicaid eligibility criteria that protect against spousal impoverishment for recipients of home and community-based services. (Sec. 103) The division also reduces the federal medical assistance percentage (i.e., federal matching rate) for states that have not implemented asset-verification programs for determining Medicaid eligibility. (Sec. 104) The division reduces funding available to the Medicaid Improvement Fund beginning in FY2021. (Sec. 105) This section exempts the budgetary effects of this division from: (1) the Pay-As-You-Go (PAYGO) rules established by the Statutory Pay-As-You-Go Act of 2010 and the FY2018 congressional budget resolution, and (2) certain budget scorekeeping guidelines. It also requires any debits on the statutory PAYGO scorecard for 2019 to be transferred to the 2020 scorecard. (The Statutory Pay-As-You-Go Act of 2010 prohibits certain legislation from increasing the budget deficit. PAYGO scorecards are used to enforce the requirements and determine whether a sequestration order implementing spending cuts is necessary.)

Medicare Advantage Bill of Rights Act of 2018 This bill establishes limits on the removal of Medicare Advantage (MA) providers by MA organizations. Within 60 days before the first day of the annual coordinated election period for an MA plan, an MA organization may remove a provider from the plan only if the provider is: (1) medically negligent, (2) in violation of a legal or contractual requirement, or (3) otherwise unfit to furnish items and services as required. An MA organization may remove a provider from an MA plan only after the completion of a fair notice and appeal process. Additionally, the MA organization must: (1) provide written notification of the removal to each enrollee receiving items or services from the provider, and (2) ensure that the removal satisfies certain continuity of care requirements. The bill also establishes network adequacy requirements. Specifically, when establishing a plan network, an MA organization shall consider specified factors related to provider availability and the timely provision of care. Furthermore, an MA organization must annually certify to the Centers for Medicare & Medicaid Services that providers in each of its plan networks are able to provide services and meet enrollees' needs as required. Sanctions for noncompliance with the bill's requirements apply.

FEMA Modernization Act of 2018 This bill provides for the reorganization of the Federal Emergency Management Agency (FEMA), including by requiring FEMA to ensure that its Office of Response and Recovery is divided into an Office of Disaster Response and an Office of Disaster Recovery and to report on its ability to support a state managed and locally executed casework management system to coordinate and deliver direct assistance to disaster survivors. Disaster Recovery Small Business Grant Act The bill establishes within the Small Business Administration an Office of Disaster Recovery Small Business Grants. It also reauthorizes through FY2029 the temporary reassignment of state and local personnel during a public health emergency.

Sugar-Sweetened Beverages Tax Act of 2018 or the SWEET Act This bill amends the Internal Revenue Code to impose an excise tax on the sale or transfer of any specified sugar-sweetened beverage product by the manufacturer, producer, or importer thereof. The tax rate is 1 cent per 4.2 grams of caloric sweetener contained in such product. This bill transfers revenues from the tax to the Prevention and Public Health Fund for the sole purpose of funding programs and research to reduce the human and economic costs of diabetes, obesity, dental caries, and other diet-related health conditions in priority populations.

Safe Food Act of 2018 This bill establishes the Food Safety Administration (FSA) as an independent agency to administer and enforce food safety laws. The functions of specified federal agencies that relate to the administration or enforcement of food safety laws are transferred to the FSA. The FSA is directed to: promulgate regulations to protect the food supply from contamination; implement federal food safety inspection, labeling, enforcement, and research efforts to protect the public health; develop consistent and science-based standards for safe food; prioritize federal food safety efforts and deployment of resources to achieve the greatest benefit in reducing foodborne illness; administer a national food safety program based on an analysis of the hazards associated with different foods and the processing of different foods; require that all food and feed facilities register before operation or importation of food, feed, or ingredients; establish an accreditation system for foreign governments seeking to certify food for importation to the United States; establish requirements for tracing food and animals from point of origin to retail sale; establish and administer a food safety technology program to foster innovations with the potential to improve food safety; maintain or access an active surveillance system of food and epidemiological evidence; establish a sampling system to monitor contaminants in food; rank categories of food based on their health hazard; establish a national public education campaign on food safety; and conduct research relating to food safety. This bill includes provisions regarding prohibited acts, recall authority, penalties for violations of food safety laws, whistle-blower protection, and civil actions.

Preserve Access to Affordable Generics and Biosimilars Act This bill amends the Federal Trade Commission Act to authorize the Federal Trade Commission to initiate proceedings against parties to any agreement resolving or settling a patent infringement claim in connection with the sale of a drug or biological product. Such an agreement, with specified exceptions, is presumed to have anticompetitive effects and violates this bill if the filer of an abbreviated new drug (generic) application or a biosimilar biological product application: (1) receives anything of value; and (2) agrees to limit or forego research, development, manufacturing, marketing, or sales of the generic drug or biosimilar biological product for any period of time.

Competitive Health Insurance Reform Act of 2018 This bill amends the McCarran-Ferguson Act to declare that nothing in that Act modifies, impairs, or supersedes the operation of antitrust laws with respect to the business of health insurance, including the business of dental insurance. This declaration does not apply to a contract, combination, or conspiracy to: (1) collect, compile, or disseminate historical loss data; (2) determine a loss development factor for historical loss data; (3) perform actuarial services if the collaboration does not involve a restraint of trade; or (4) develop or disseminate a standard insurance policy form if adherence to the form is not required. Prohibitions against unfair methods of competition apply to the business of health insurance without regard to whether the business is for profit.

State Accountability, Flexibility, and Equity for Hospitals Act of 2018 or the SAFE Hospitals Act of 2018 This bill alters Medicaid requirements relating to payment for inpatient hospital services that are provided by disproportionate share hospitals (DSHs). (DSHs are hospitals that receive additional payment under Medicaid for treating a large share of low-income patients.) Among other changes, the bill requires state Medicaid programs to adopt a payment methodology that meets certain criteria, including by prioritizing payments based on the DSH tier for which the hospital qualifies; tiers are determined based on factors such as the hospital's Medicaid inpatient utilization rate. The bill also incorporates state poverty ratios (i.e., the number of qualifying low-income individuals in a state compared to all states) into the formula for determining state DSH allotments under Medicaid. The bill phases in application of the revised formula over the course of 10 to 15 years.

Preserving Access to Orphan Drugs Act of 2018 This bill amends the Patient Protection and Affordable Care Act to expand the definition of orphan drug for purposes of the annual fee paid by brand name prescription drug manufacturers and importers to include medications for rare conditions that were, prior to 2011, approved or in clinical trials. (Drug manufacturers and importers pay an annual fee based on their sales of brand name prescription drugs, excluding sales of orphan drugs.)

Mobile Health Record Act of 2018 This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish a program that enables Medicare enrollees to connect claims data with trusted applications, services, and research programs. The program must allow an enrollee to access claim information through a mobile health record application that is chosen by the enrollee and that is also approved by the CMS, in accordance with specified requirements. Information must be made available to such applications in a similar manner as under the current Blue Button 2.0 program. The bill also allows states that choose to develop or purchase similar applications for Medicaid enrollees to receive federal payment for the associated costs. Currently, the CMS administers the Blue Button program, which allows Medicare enrollees to download and save health information on personal computers or other devices. The CMS subsequently launched the Blue Button 2.0 program, which allows enrollees to link health information with mobile applications (these applications are posted on the CMS website, but are not endorsed by the CMS).

Veterans' Right to Breathe Act This bill provides a presumption of service connection for certain diseases for burn pit-exposed veterans. Under a presumption of service connection, specific disabilities diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. A burn pit-exposed veteran is a veteran who was stationed at a location where an open burn pit (an area used for burning solid waste in open air without equipment) was used while deployed on or after September 11, 2001.

Humane Retirement Act This bill requires animal care committees at entities that receive federal funds for biomedical or behavioral research to make reasonable efforts to find parties to adopt dogs and cats that have been retired from research. Prior to euthanizing, the animal care committee must assess the temperament of the dog or cat to determine whether it is suitable for adoption and, if so, make reasonable efforts to offer the dog or cat to an adopting party.

Cancer Drug Coverage Act of 2018 This bill requires health plans that cover anticancer medications administered by a health care provider to provide no less favorable cost sharing for patient-administered anticancer medications. This requirement applies to medications that are (1) approved by the Food and Drug Administration; (2) medically necessary for the cancer treatment; and (3) clinically appropriate in terms of type, frequency, extent site, and duration. To comply with this requirement, health plans may not, with respect to anticancer medications (1) change or replace benefits to increase out-of-pocket costs, (2) reclassify benefits to increase costs, or (3) apply more restrictive limitations to orally administered medications than to intravenously administered or injected medications.

Creating Access to Residency Education Act of 2018 This bill amends the Public Health Service Act to require the Centers for Medicare & Medicaid Services to award grants or enter into contracts to create or expand medical residency training programs in states where there are fewer than 30 medical residents per 100,000 people. An awardee of a grant or contract provides a lower ratio of matching funds if its residency training program is in the field of primary care.
