Parental Accessibility Rights for Emergency and Negligent Treatment Act This bill expands the scope of advance directive policies and related disclosures for providers under Medicaid and the Children's Health Insurance Program (CHIP). Specifically, providers (e.g., hospitals, hospice programs, and home health care providers) must have advance directive policies for minors (rather than only adults) and must disclose such policies on the provider's website and upon request. Providers must also disclose information regarding (1) an individual's rights with respect to life-sustaining procedures, including hydration and sustenance; and (2) whether parental consent is required to provide, withdraw, or deny life-sustaining procedures, or to institute a do-not-resuscitate order, for a minor.

Ending the Diagnostic Odyssey Act of 2019 This bill allows state Medicaid programs to cover whole genome sequencing services for certain individuals. Specifically, states may cover such services for individuals under the age of 21 (or a lower age, if the state chooses) and for former foster youth under the age of 26 who (1) have been referred or admitted to an intensive care unit or seen by a medical specialist for a suspected genetic or undiagnosed disease, or (2) are suspected by a medical specialist to have a neonatal- or pediatric-onset genetic disease. The Centers for Medicare & Medicaid Services may award grants to assist states in developing plans to cover such services.

Personalized Care Act of 2019 This bill revises provisions relating to health savings accounts (HSAs), including to redefine eligible individual for HSA purposes to allow increased participation in HSAs, increase the limit on contributions to HSAs, permit the payment of health insurance premiums from HSAs, include within the definition of qualified medical expenses periodic fees paid for medical services and amounts paid by a member of a health care sharing ministry, treat periodic provider fees as deductible medical expenses, allow payment of over-the-counter medicines or drugs from HSAs, and lower the 20% penalty for nonqualified distributions from HSAs to 10%. .

Ambulatory Surgical Center Quality and Access Act of 2019 This bill establishes and modifies certain requirements relating to Medicare payments for ambulatory surgical center (ASC) services. Specifically, the bill (1) requires the payment system for ASC services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revises quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) requires the Centers for Medicare & Medicaid Services (CMS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.)

Pursuing Equity in Mental Health Act of 2019 This bill establishes programs to support school-based mental health services and address racial and ethnic mental health disparities, among other provisions. Specifically, the Substance Abuse and Mental Health Services Administration (SAMHSA) must award grants for school- and community-based, mental health services. Such services must be trauma-informed and designed to provide comprehensive, culturally-appropriate interventions at a school-wide level. Further, the bill requires the SAMSHA to award grants that address racial and ethnic health disparities by (1) providing integrated health care in areas with a high proportion of racial and ethnic minority groups and (2) developing national programs for health professionals to reduce such disparities. The bill also (1) reauthorizes the minority fellowship program to support the education of mental health professionals who provide services to racial and ethnic minorities, (2) establishes a commission to research the effects of social media use on adolescents, and (3) prohibits the use of federal funds for specified conversion therapy in the context of sexual orientation or sexual identity.

Prevent Interruptions in Physical Therapy Act of 2019 This bill allows a physical therapist to receive payment under Medicare for services provided to the physical therapist's patients by another physical therapist through a qualifying temporary arrangement, regardless of the geographic area or population served. Currently, physical therapists may only receive payment with respect to such arrangements for services provided in medically underserved, rural, or health professional shortage areas.

SESTA/FOSTA Examination of Secondary Effects for Sex Workers Study Act or the SAFE SEX Workers Study Act This bill requires the Department of Health and Human Services to study the impacts of the reduction in access to client-screening, information-sharing, and harm-reduction websites resulting from the Allow States and Victims to Fight Online Sex Trafficking Act of 2017 on individuals engaged in adult, consensual sex work. The study must utilize community-based nonprofits to conduct surveys and interviews of sex workers to collect information about (1) experiences of violence from clients; (2) interactions with law enforcement; (3) experiences with exploitation; and (4) the impact on housing stability and mental health, among other effects.

Lower Insulin Costs Now Act This bill requires the Food and Drug Administration (FDA) to continue to review applications for certain biological products under an earlier review process, notwithstanding recent FDA guidance. (A 2009 law established a new procedure for approving biological products but allowed certain products in an already approved product class to receive approval under the earlier procedure until March 23, 2020; subsequently, in December 2018, the FDA issued guidance stating that an application filed under the earlier procedure that is not approved by March, 23, 2020, will not be approved.) The bill requires the FDA to continue reviewing an application filed not later than March 23, 2019, under the earlier procedure, even if it was not approved as of March 23, 2020. Such an application not approved after October 1, 2022, shall be deemed withdrawn. Such an approved application shall be deemed a biological product license.

Liver Illness Visibility, Education, and Research Act of 2019 This bill expands and coordinates activities related to the research of liver cancer and liver disease, including causes, prevention, detection, and treatment. Specifically, the National Cancer Institute must establish an inter-institute working group to coordinate efforts to cure liver cancer and liver disease, including research into such cases resulting from hepatitis B, and may award grants to develop preventative and diagnostic measures as well as support for experimental treatment options. The bill further establishes grant programs, administered by the Centers for Disease Control and Prevention, to support liver disease prevention services, diagnostics, and hepatitis tracking programs and to raise awareness about liver disease within high-risk communities. The renamed National Institute of Diabetes and Digestive, Kidney, and Liver Diseases also must prioritize programs addressing liver disease, including (1) establishing a national clearinghouse for patient data and (2) developing or expanding the centers for research of liver disease.

Support And Value Expectant Moms and Babies Act of 2019 or the SAVE Moms and Babies Act of 2019 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner to also act as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

Fracturing Responsibility and Awareness of Chemicals Act or the FRAC Act This bill revises requirements governing hydraulic fracturing operations under the Safe Drinking Water Act. Hydraulic fracturing or fracking is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the geological formation. The bill repeals the exemption for such operations relating to oil and natural gas production activities under the act. The bill allows the Environmental Protection Agency (EPA) to prescribe regulations that authorize a state to seek primary enforcement responsibility for hydraulic fracturing operations for oil and natural gas without seeking to assume primary enforcement responsibility for other types of underground injection control wells. The bill requires public disclosure of the chemicals used in hydraulic fracturing operations. The chemicals intended for use in underground injections must be disclosed before the operations commence. The chemicals actually used must be disclosed the end of the operations. In the event that the proprietary chemical formula of a chemical used in such hydraulic fracturing is necessary for medical diagnosis, treatment, or emergency response, hydraulic fracturing operations must disclose the formula or the specific chemical identity of a trade secret chemical to the state, the EPA, a first responder, or a health care practitioner upon request, regardless of the existence of a written statement of need or a confidentiality agreement.

Food Safety Modernization for Innovative Technologies Act This bill provides statutory authority for joint agency jurisdiction over food intended for humans that is produced using animal cell culture technology. The FDA shall regulate food derived from cell lines of animals other than livestock or poultry, and the Department of Agriculture shall regulate food derived from cell lines of livestock and poultry.

Expanded Food Safety Investigation Act of 2019 This bill provides that the Food and Drug Administration (FDA) may, under specified circumstances, request access to a concentrated animal-feeding operation (i.e., a stabled or confined animal-feeding operation) to conduct microbial sampling. Specifically, the bill allows the FDA to request access if the FDA determines that sampling is necessary to facilitate an investigation of a foodborne-illness outbreak, determine the cause of the outbreak, or address other public health needs. The bill provides that such an operation shall be subject to penalties for refusing such a sampling.

Veterans Health Administration Caregiver Retention and Eligibility Determination Act of 2019 or the VHA CRED Act of 2019 This bill requires the Veterans Health Administration (VHA) of the Department of Veterans Affairs (VA) to prescribe regulations, administrative guidance, and management controls applicable to the credentialing of certain appointed health care positions. Under the bill, VHA personnel who verify credentials for appointees, review qualifications for such persons, or hire such persons must undergo periodic training to review relevant law and policy regarding provider qualifications for VHA employment. The bill requires the VHA to enroll health care appointees in continuous query of their record within the National Practitioner Data Bank. The VHA must also develop and implement a mechanism for monitoring the continuous query and updating information within the VA's credentialing system. At least once a year, the VHA must audit its appointed health care employees who have an adverse action reported on the National Practitioner Data Bank.

Territories Medicare Prescription Drug Assistance Equity Act of 2019 This bill makes certain subsidies under the Medicare prescription drug benefit available to beneficiaries who reside in Puerto Rico or another U.S. territory. Current law makes such beneficiaries ineligible for premium and cost-sharing subsidies, but establishes a process for U.S. territories to apply for financial assistance with respect to the provision of Medicare prescription drugs. The bill eliminates this process and makes the subsidies available to beneficiaries who reside in a U.S. territory and are otherwise eligible.
