Refurbishing the Pillars of American Exceptionalism Act of 2020 This bill addresses various issues including immigration, health care, firearms, abortion, and taxes. Among other things, this bill limits who may receive citizenship by virtue of being born in the United States; repeals the Patient Protection and Affordable Care Act; prohibits providing an abortion if the fetus has a detectable heartbeat, with some exceptions; removes from federal jurisdiction any case seeking the review of any law or regulation that limits or regulates abortions; repeals certain nutritional standards for national school lunch and school breakfast programs; prohibits the state or local regulation of firearm silencers; makes English the official language of the United States and authorizes a person injured by a violation of this provision to sue; caps noneconomic damages at $250,000 in any health care lawsuit; repeals federal income taxes, payroll taxes, and estate taxes; and establishes a national sales tax.

Delivering Optimally Urgent Labor Access for Veterans Affairs Act of 2020 or the DOULA for VA Act of 2020 This bill requires the Department of Veterans Affairs (VA) to establish a five-year pilot program to furnish doula services to pregnant veterans who are enrolled in the VA health care system. The program must furnish doula services through eligible entities by expanding the VA's Whole Health model to measure the impact that doula support services have on birth and mental health outcomes of pregnant veterans. The Whole Health model is a holistic approach that looks at the many areas of life that may affect health in order to make a health plan suited for each individual based on his or her health goals.

Improving Seniors' Timely Access to Care Act of 2020 This bill establishes several requirements and standards relating to prior authorization processes under Medicare Advantage (MA) plans. Specifically, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.

Secure Data and Privacy for Contact Tracing Act of 2020 This bill requires the Centers for Disease Control and Prevention to award grants to public health agencies in states, tribes, and territories to incorporate digital contact tracing technology in COVID-19 (i.e., coronavirus disease 2019) contact tracing programs. This technology must meet requirements with respect to contact tracing functions, data security and privacy, and voluntary use. Grantees that develop or procure technology that does not meet these requirements lose eligibility for this funding and future funding for COVID-19 contact tracing technology. Furthermore, as a condition of receiving funding, grantees must (1) undertake an independent security assessment, and (2) develop a plan that delineates how the technology augments existing COVID-19 contact tracing and response efforts and addresses interoperability and protections to limit access to the data. In addition, the bill expressly applies federal privacy standards for the use and disclosure of personal health information by health care providers, health plans, health clearinghouses, and their business associates to contact tracing technology and its use. Current law provides an exception to these standards for personal health information used by, or disclosed to, a public health authority that is legally authorized to collect the information. The bill also prohibits the use of data derived from the contact tracing technology in legal proceedings or for immigration enforcement. The Government Accountability Office must evaluate this program.

Enhancing the Security of the U.S. Pharmaceutical Supply Chain Act of 2020 This bill provides tax credits for manufacturing certain priority medicines and establishes an expedited review procedure for drug manufacturers seeking to transition from foreign manufacturing to domestic manufacturing. The Department of Health and Human Services (HHS) must publish annually a list of priority drugs and active pharmaceutical ingredients that (1) are necessary for use in a public health emergency, (2) are at high risk of becoming in short supply, and (3) have a vulnerable global supply chain. The bill provides a tax credit for 50% of a manufacturer's direct and indirect costs incurred in a taxable year for the production of a drug or active ingredient that was on this list in any of the five preceding years. Furthermore, the Food and Drug Administration (FDA) must expedite the review and approval of a supplemental application that seeks to transfer manufacturing of an already-approved drug or active pharmaceutical ingredient to a domestic establishment. (A supplemental application generally involves a change, such as a manufacturing change, to an existing application for FDA market approval.) The bill imposes various requirements for this expedited review, including a deadline for the FDA to take action on such a supplemental application within six months of submission. HHS shall also establish the Facility Transfer Working Group to assist with evaluating such applications and provide advice and feedback to applicants upon request.

Remote, Coastal, and Small Watersheds Act of 2020 This bill authorizes the U.S. Army Corps of Engineers in conducting a study of hurricane and storm damage reduction to recommend certain projects in remote, coastal, and small watersheds without the need to demonstrate that the projects are justified solely by national economic development benefits. In considering whether to recommend a project, the Corps must consider the benefits of the project to (1) public health and safety of the local community and communities that are located in the region to be served by the project and that will rely on the project, (2) hurricane and storm damage effects on local and regional economic opportunities, (3) welfare of the regional population to be served by the project, or (4) social and cultural value to the local community and communities that are located in the region to be served by the project and that will rely on the project.

Pandemic Supplies Production Act This bill directs the President to immediately use existing authorities under the Defense Production Act of 1950 to ensure the supply of ventilators, N-95 respirator masks, and other personal protective equipment to address COVID-19 (i.e., coronavirus disease 2019). That act confers upon the President a broad set of authorities to influence domestic industry in order to provide essential materials and goods needed for the national defense. It also directs the Defense Logistics Agency within the Department of Defense to take certain actions to manage the distribution of materials to respond the COVID-19 emergency, as well as future emergencies or disasters. This agency is responsible for supply or service activities common to all military departments.

Community Integration Act of 2020 This bill requires a state Medicaid program to, with respect to an individual who requires a level of care provided in a nursing facility, intermediate care facility for the developmentally disabled, institution for mental disease, or other similar setting (1) provide the individual with the choice and equal opportunity to receive such care in a home- and community-based setting; and (2) meet specified requirements relating to the provision and availability of care in such a setting, including a requirement to develop a statewide plan to increase affordable and accessible housing for individuals with disabilities.

Emergency Direct Payments for Families and Workers Act of 2020 This bill allows individual taxpayers an additional 2020 recovery rebate in the form of a refundable income tax credit in the amount of $1,200 ($2,400 for joint returns). An additional $500 rebate is provided to each qualifying child of the taxpayer. A recovery rebate is a one-time stimulus payment made to eligible taxpayers in response to the COVID-19 (i.e., coronavirus disease 2019) public health emergency. The amount of the recovery rebate is reduced by a specified percentage of the amount an individual's adjusted gross income exceeds $75,000 ($150,000 for joint returns). Individual taxpayers and their children must have a valid identification number (i.e., Social Security account number) to claim a rebate. The Department of the Treasury must conduct a public awareness campaign to inform taxpayers of the availability of the rebate.

Improving Diagnosis in Medicine Act of 2020 This bill requires the Agency for Healthcare Research and Quality to provide grants for Research Centers of Diagnostic Excellence to support research in diagnostic quality, safety, and value and establishes the federal Interagency Council on Improving Diagnosis in Health Care within the Department of Health and Human Services. Research centers must use funds to conduct diagnostic safety and quality research, including high-impact research on novel solutions to reduce patient harm, and to support initiatives to improve diagnosis in medicine. Other activities may include developing and training the diagnostic research workforce and developing and validating measures to assess diagnostic errors.
