The bill also authorizes health care providers of the Department of Veterans Affairs to provide information to veterans regarding participation in federally approved cannabis clinical trials.

Medical Innovation Act of 2022

Medical Innovation Act of 2022 This bill requires certain drug manufacturers to make payments to fund research supported by the Food and Drug Administration (FDA) and the National Institutes of Health (NIH). A drug manufacturer with over $1 billion in net income in a fiscal year that has entered into a relevant settlement agreement regarding specified violations must pay 0.75%-1.5% of its net income to the Department of Health and Human Services for each of its covered blockbuster drugs. A covered blockbuster drug is a drug that has at least $1 billion in net sales in a year and was developed, in whole or in part, through federal investments in medical research. Payments are divided between the FDA and the NIH in proportion to the discretionary funding of those agencies, excluding FDA user fees. Payments are not disbursed if appropriations for the FDA or the NIH are lower than in the prior fiscal year. Priorities for payments must include advancing regulatory science for medical products and research related to diseases that disproportionately account for federal health care spending. A covered blockbuster drug for which a manufacturer has not made a required payment is considered misbranded and subject to prohibitions on introducing or receiving misbranded drugs in interstate commerce.

RARE Act of 2022

Rare disease Advancement, surveillance Research, and Education Act of 2022 or the RARE Act of 2022 The bill reauthorizes through FY2028 the National Institutes of Health Rare Disease Regional Centers of Excellence and expands activities to facilitate research and increase awareness of rare diseases and conditions. (Rare diseases and conditions are those with a prevalence of fewer than 200,000 individuals in the United States.) The Centers for Disease Control and Prevention may expand infrastructure and activities to track the epidemiology of up to four rare diseases and conditions and incorporate this information into a National Rare Disease or Condition Surveillance System. The Agency for Healthcare Research and Quality must expand its activities to increase health care providers' awareness of rare diseases and conditions. The National Academies of Sciences, Engineering, and Medicine, or another appropriate entity, must update the 2010 report Rare Diseases and Orphan Products: Accelerating Research and Development.

Protecting Life from Chemical Abortions Act This bill prohibits certain changes made by the Food and Drug Administration (FDA) to dispensing requirements for mifepristone. (Mifepristone is a drug that is approved to end pregnancies through 10 weeks gestation when used in conjunction with the drug misoprostol. The procedure is often referred to as medication abortion or the abortion pill.) The FDA regulates the use of mifepristone through the Mifepristone Risk Evaluation and Mitigation Strategy (REMS) program. The program requires health care providers to comply with certain requirements in order to prescribe or dispense mifepristone to end a pregnancy; the program previously included an in-person dispensing requirement that required mifepristone to be directly dispensed to patients in clinics, medical offices, or hospitals. During the COVID-19 public health emergency, the FDA temporarily stopped enforcing the in-person dispensing requirement, which allowed mail-order pharmacies to fill and dispense mifepristone prescriptions. The bill prohibits the FDA from (1) exercising any enforcement discretion with respect to program requirements, or (2) reducing program protections until every state submits certain data regarding abortions to the Centers for Disease Control and Prevention. The bill also generally prohibits the declaration of a public health emergency with respect to abortions.

Medicare for America Act of 2019 [ sic ] This bill establishes several health insurance programs and otherwise modifies certain requirements relating to health care coverage, costs, and services. In particular, the bill establishes a national health insurance program to be administered by the Department of Health and Human Services (HHS). Among other requirements, the program must (1) cover all U.S. residents; (2) cover specified items and services, including hospital services, prescription drugs, dental services, and home- and community-based long-term care; and (3) be fully implemented in 2026. HHS must also offer a transitional public health option that provides certain minimum coverage through health insurance exchanges in 2024 and 2025. The bill also makes a series of other changes to health care and tax provisions. For example, the bill (1) allows federal funds to be used for abortions; (2) sunsets a specified tax reform law that, among other things, repealed the penalty for failing to maintain minimum essential health coverage; and (3) prohibits excessive prices for prescription drugs and medical devices, as determined by a newly established federal regulatory board.

Health Enterprise Zones Act of 2022

Health Enterprise Zones Act of 2022 This bill provides for the designation of Health Enterprise Zones in certain geographic areas with documented and measurable health disparities. This designation, which expires 10 years after the date on which the first zone is designated, confers eligibility for certain grants, Medicare incentive payments, student loan repayment programs, and tax credits for those working to reduce health disparities and improve health outcomes in these zones. Specifically, community-based nonprofits or local government agencies, in coalition with health care providers, social service organizations, and others, may apply to the Department of Health and Human Services (HHS) for the designation. The application must include a plan to reduce health disparities and achieve other outcomes. In implementing the program, HHS must consult with, among others, the Department of Housing and Urban Development. When approving applications, HHS shall consider factors including geographic diversity and the commitment of supporting funds from the private sector. HHS (1) may award grants to organizations or agencies that applied for the designation to support activities aligned with their plans, and (2) must carry out a student loan repayment program for health care providers who agree to provide services in a Health Enterprise Zone. In addition, the bill establishes tax credits for employers that hire, and individuals who work as, Health Enterprise Zone workers.

The bill also requires the CDC to educate pregnant people, their employers, and their health care providers about evidenced-based health information concerning COVID-19 and pregnancy; the Department of Health and Human Services to convene a task force to develop recommendations on the provision of maternity care during the COVID-19 (and future) public health emergencies with a particular focus on communities of color and rural populations; the Occupational Safety and Health Administration to issue an emergency temporary standard to protect employees who are at risk from occupational exposure to COVID-19 that considers the risks and needs of pregnant and postpartum employees; and the Government Accountability Office to report on maternal health and public health preparedness, including prenatal, labor and delivery, and postpartum care during the COVID-19 emergency.

As a condition of funding from the National Institutes of Health (NIH) for a clinical trial investigating a drug or device, a sponsor's application must include certain information related to diversity in its trial, such as goals for recruiting and retaining trial participants and plans for achieving the recruitment and retention goals and implementing less-burdensome clinical trial follow-up requirements. A sponsor must also annually share demographic data of clinical trial participants with the NIH. Further, the NIH and the Food and Drug Administration must carry out a national campaign to increase awareness about the need for diverse clinical trials.

This bill maintains the liability protections for a volunteer practitioner who provides services through a different community health center if the center (1) seeks the assistance of the volunteer practitioner to respond to a declared emergency, and (2) promptly notifies the Department of Health and Human Services that the volunteer practitioner will be providing services.

RISE from Trauma Act

Resilience Investment, Support, and Expansion from Trauma Act or the RISE from Trauma Act This bill establishes and extends various programs to support infants, children, youth, and families who have experienced, or may experience, trauma. Specifically, the bill allows federal agencies to use specified discretionary funds to implement pilot projects to improve outcomes for children experiencing trauma. It also requires the Department of Health and Human Services to provide tool kits and other guidance to train frontline service providers and certain community members about trauma, toxic stress, and resilience. In addition, the Department of Justice (DOJ) must establish a national center to disseminate to law enforcement agencies best practices and other assistance to enhance interactions with infants, children, youth, and families who are exposed to violence and trauma. Furthermore, the bill establishes grants for multi-sector demonstration projects to prevent and mitigate trauma and toxic stress; interventions to improve outcomes for hospital patients who experience drug overdoses, suicide attempts, or violent injury; and clinical training in infant and early childhood mental health. The bill also authorizes DOJ grants to reduce violence and substance use by preventing children's trauma from exposure to violence and substance use. Additionally, it incorporates trauma-informed practices and otherwise addresses trauma in programs for health care professional education, increasing access to health services, and training for educators.

Accessible Care by Curbing Excessive lawSuitS Act of 2022 or the ACCESS Act of 2022 This bill establishes rules for health care lawsuits where some amount of coverage or care was provided or paid for by a federal program, regardless of the number of other parties to the claim. The bill sets a three-year maximum statute of limitations from the date of the injury, subject to specific exceptions. Further, noneconomic damages (e.g., damages for pain and suffering) are limited to a maximum of $250,000. The bill permits courts to supervise and limit contingent fees paid to attorneys and sets a maximum contingent fee percentage based on a downward sliding scale as a damages increase. The bill permits either party to introduce evidence of collateral source benefits (e.g., workers’ compensation programs, accident insurance coverage, or other future benefit). Statements by a health care provider expressing fault, sympathy, or apology are, however, inadmissible as evidence of liability. Additionally, a plaintiff must give 90 days’ notice to the health care provider before filing a lawsuit. When filing a health care lawsuit, plaintiffs also must simultaneously submit an affidavit in support of the claim from a health care professional who meets the standards for an expert witness that are provided in the bill. This bill generally does not preempt state laws that impose additional limits on health care liability claims.

The National Institutes of Health must also prioritize certain research projects on new and existing medications for pregnant and lactating women based on need, feasibility, and the potential impact of the research.
