National Disaster Tax Relief Act of 2017 This bill amends the Internal Revenue Code to modify various tax deductions, credits, and requirements that affect disaster areas and U.S. possessions. With respect to areas in which a federally declared disaster occurred from 2012 through 2022, the bill allows: expensing of certain disaster expenses, modifications to rules regarding the deduction of losses attributable to disasters, additional new markets tax credits, an exclusion from gross income for certain cancellations of indebtedness, additional advance refundings of certain tax-exempt bonds, and additional low-income housing tax credit allocations. The bill permanently: (1) excludes from gross income disaster mitigation payments received from state and local governments, and (2) allows taxpayers to create tax-exempt catastrophe savings accounts to pay expenses related to a major disaster. With respect to U.S. possessions, the bill: repeals the limitation on the amount of distilled spirits excise taxes covered over (paid) to the treasuries of the Virgin Islands and Puerto Rico, makes permanent the tax deduction for income attributable to domestic production activities in Puerto Rico, modifies the rules for claiming the refundable portion of the child tax credit, and requires the Department of the Treasury to make payments to certain U.S. possessions to either compensate for revenue lost due to specified provisions in the bill or allow residents to benefit from the provisions.

End For-Profit Prisons Act of 2017 This bill requires the Department of Justice (DOJ) to phase out existing contracts with private prison companies and private community confinement facilities. It amends the federal criminal code to require federal employees to perform the core correctional services—housing, safeguarding, protecting, and disciplining of offenders—at correctional facilities used by the Bureau of Prisons (BOP) or the U.S. Marshals Service. The bill also prohibits the BOP from entering into or maintaining contracts with private companies to manage community confinement facilities (e.g., halfway houses). DOJ must evaluate the effectiveness of and develop guidelines for programs to improve community reintegration at community confinement facilities. The Marshals Service must annually inspect each correctional facility it uses for confinement. The BOP must provide to prisoners, as part of prerelease procedures, information and counseling about: criminal record expungement; educational, employment, and treatment programs; and applications for public assistance programs. The BOP must also provide prisoners with post-release information about fines, assessments, surcharges, restitution, and other penalties.

The bill amends the Disaster Relief Act of 1970 to permit: (1) the use of SBA and Farm Service Agency (formerly, Farmers Home Administration) loans for enterprises that are vital to recovery efforts in a disaster area (including debris removal services, manufactured housing, gasoline, telecommunications, or building materials); and (2) such loans to waive any required evaluation of creditworthiness in exchange for a fee set by the SBA or the Farm Service Agency.

Lead-Safe Housing for Kids Act of 2017 This bill amends the Lead-Based Paint Poisoning Prevention Act to direct the Department of Housing and Urban Development (HUD) to promulgate regulations that: require owners of certain housing to initiate a lead-based paint hazard risk assessment before a family with a child under age six occupies such housing, unless lead-based paint has already been removed; state that a visual assessment alone is not sufficient for these purposes; and require owners to control lead-based paint hazards identified in the assessment within 30 days and provide certain notices to residents of the housing. These regulations shall apply to housing receiving federal assistance that was constructed before 1978, but exclude: single-family housing covered by an application for mortgage insurance under the National Housing Act, or multi-family housing that is covered by such an application but does not receive any other federal housing assistance. HUD regulations shall also require emergency relocation of such families, without placement on a waitlist, penalty (including rent payments to be made for that dwelling unit), or lapse in assistance, to a unit that was constructed in 1978 or later or to another unit of covered housing that has no lead-based paint hazards.

Animal Emergency Planning Act of 2017 This bill amends the Animal Welfare Act to require research facilities, dealers, exhibitors, intermediate handlers, and carriers (covered persons) to develop, document, and follow a contingency plan to provide for the humane handling, treatment, transportation, housing, and care of their animals in the event of an emergency or disaster. The plan must: identify situations that the covered person might experience that would trigger the need to implement the measures identified in the plan; outline tasks to be carried out in response to emergencies or disasters; establish a chain of command and identify the individuals responsible for fulfilling the tasks; and address how response and recovery will be handled in terms of materials, resources, and training needed. Covered persons must review their plan at least annually, train personnel in their roles and responsibilities as outlined in the plan, and provide training when the plan changes.

For individuals and businesses located in or investing in the affected areas, the bill allows: expensing of certain disaster expenses, increased deductions for charitable contributions for disaster relief, modifications to rules regarding the deduction of losses attributable to disasters, waivers of certain mortgage revenue bond requirements, an extension of the additional depreciation allowance for business property (bonus depreciation), an increased new markets tax credit limitation, penalty-free distributions from retirement plans, an additional tax exemption for individuals who are displaced, an exclusion from gross income for certain cancellations of indebtedness, a modified rule for determining the earned income of individuals for the earned income tax credit and the child tax credit, an increased rehabilitation tax credit for buildings, additional advance refundings of certain tax-exempt bonds, disaster area recovery bonds, additional low-income housing tax credit allocations, payments of disaster assistance to tax-exempt mutual ditch or irrigation companies without affecting their tax-exempt status, an exclusion from gross income for disaster mitigation payments received from state and local governments, a deduction for payments to a tax-exempt natural disaster fund, a five-year replacement period for property for purposes of the exclusion of gain from an involuntary conversion, a tax credit for a portion of the wages paid to employees, and an enhanced deduction for medical expenses.

Off Fossil Fuels for a Better Future Act This bill transitions away from fossil fuel sources of energy to clean energy sources (e.g., energy efficiency, energy conservation, and renewable energy). By 2027: (1) 80% of electricity sold must be generated from clean energy resources, (2) 80% of new vehicle sales from manufacturers must be sales of zero-emission vehicles, and (3) 80% of train rail lines and train engines must be electrified. By 2035: (1) 100% of electricity must be generated from clean energy resources, (2) 100% of vehicle sales from manufacturers must be zero-emission vehicles, and (3) 100% of train rail lines and train engines must be electrified. The bill establishes a car allowance rebate system within the Department of Transportation to provide economic incentives for consumers to purchase new, clean energy vehicles. No federal permits for new major fossil fuel projects may be issued in 2018 and thereafter. The bill amends the Internal Revenue Code to: (1) terminate specified fossil fuel subsidies, (2) permanently extend renewable electricity production tax credits for electricity generated from wind, and (3) permanently extend a business energy investment tax credit for solar or wind energy technologies. A Community Assistance Fund is established for specified industrial and energy efficiency programs. The bill permanently reauthorizes the Weatherization Assistance Program, which provides energy efficiency retrofits of low-income homes. It prohibits exports of domestically produced crude oil and natural gas, including liquefied natural gas. The Center for Clean Energy Workforce Development is established within the Department of Labor.

Rent Relief Act of 2017 This bill amends the Internal Revenue Code to allow a refundable tax credit for individuals who pay rent for a principal residence that exceeds 30% of the individual's gross income for the taxable year. The amount of the credit ranges from 10% to 100% of the excess, depending on the gross income of the taxpayer. The credit is not available for taxpayers with gross income that exceeds $125,000. Rent that exceeds 150% of the fair market rent for the residence may not be taken into account for the purpose of determining the amount of the credit. For individuals who reside in government-subsidized housing, the bill allows a credit equal to 1/12 of the rent paid by the taxpayer (and not subsidized under the program) during the year with respect to the residence.

Tenant Protection Act This bill amends the Fair Credit Reporting Act to prohibit a consumer reporting agency from creating a report containing a landlord-tenant court or other housing court record unless: the case resulted in a judgment of possession, the decision is not being appealed, and the record is not more than three years old. If a person takes an adverse action against a consumer based upon a housing court record, the person must provide the consumer a free copy of the report. A person who willfully creates a housing court report that contains an inaccuracy is civilly liable to the consumer. The Consumer Financial Protection Bureau must: (1) issue regulations that direct tenant rating agencies to create a central source for consumers to obtain reports and submit disputes, and (2) report on tenant rating agency compliance.

Marijuana Justice Act of 2017 This bill amends the Controlled Substances Act: to remove marijuana and tetrahydrocannabinols from schedule I; and to eliminate criminal penalties for an individual who imports, exports, manufactures, distributes, or possesses with intent to distribute marijuana. It prohibits and reduces certain federal funds for a state without a statute legalizing marijuana, if the Bureau of Justice Assistance determines that such a state has a disproportionate arrest rate or disproportionate incarceration rate for marijuana offenses. The bill directs federal courts to expunge convictions for marijuana use or possession. Finally, it establishes in the Treasury the Community Reinvestment Fund. Amounts in the fund may be used by the Department of Housing and Urban Development to establish a grant program to reinvest in communities most affected by the war on drugs.

Taxpayer Protections and Market Access for Mortgage Finance Act of 2017 This bill amends the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 to direct the Federal Housing Finance Agency (FHFA) to establish guidelines requiring the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) to engage in significant, increasing, and varied credit-risk transfer transactions. A "risk transfer transaction" provides for: (1) the sale, disposition, retention, or transfer within the private sector of credit risk on a one- to four-family residential mortgage loan or a pool of such loans that back securities on which the enterprise guarantees the timely payment of principal and interest; or (2) the retention by the private sector of any such credit risk in connection with the sale of any such loan or security to an enterprise. The enterprises may set and publish guarantee fees commensurate with the reduced credit risk resulting from any new risk transfer transactions. The bill exempts certain swaps entered into for the purpose of transferring or sharing credit risk in connection with a risk transfer transaction from the Commodity Exchange Act. The FHFA must also require Fannie Mae and Freddie Mac to establish: (1) a five-year pilot program under which each enterprise must annually engage in at least one front-end risk transfer transaction in which at least 75% of the transferred credit risk is transferred to bank or non-bank mortgage originators having under $10 billion in assets, and (2) a pilot program to increase the amount of risk that is shared by the enterprises using private mortgage insurance.

Housing Accountability Act of 2017 This bill amends the United States Housing Act of 1937 to provide statutory authority for the requirement for an entity receiving low-income housing assistance payments for existing public housing units to maintain decent, safe, and sanitary conditions for any structure covered under a payment contract. The Department of Housing and Urban Development (HUD) shall develop a process by which a Performance-Based Contract Administrator shall, on a semiannual basis, conduct a survey of the tenants of each such structure to identify consistent or persistent problems with the structure's physical condition or its manager's performance. A structure shall be referred to HUD for remediation if the administrator identifies such a problem based on the survey or any other observation made by the administrator during the normal course of business. HUD may impose a penalty on the structure's owner if the structure does not satisfactorily meet this bill's requirements or is repeatedly referred to HUD for remediation by an administrator through the process. Collected amounts shall be used solely for supporting safe and sanitary conditions at applicable structures or for HUD-designated tenant relocation, with priority given to tenants of the penalized structure. This bill shall not apply to voucher program property.

Canadian Snowbird Visa Act This bill amends the Immigration and Nationality Act to authorize the Department of Homeland Security to admit into the United States as a nonimmigrant visitor for a period not to exceed 240 days during any single 365-day period a Canadian citizen who: (1) is at least 50 years old, (2) maintains a Canadian residence and owns a U.S. residence or has rented a U.S. accommodation for the duration of such stay, (3) is not inadmissible or deportable, (4) will not engage in employment or labor for hire in the United States other than for a non U.S.-based person or entity by whom the Canadian citizen was employed in Canada or for whom the Canadian citizen performed services in Canada, and (5) will not seek any form of assistance or benefit under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996. The spouse of such person may be admitted under the same terms except that he or she is not required to separately satisfy the residence/housing requirements. The bill grants a person so admitted nonresident alien tax status.
