Ensuring Disaster Recovery for Local Communities Act of 2019

Ensuring Disaster Recovery for Local Communities Act of 2019 This bill addresses relief for areas impacted by a major disaster. Specifically, the Department of Housing and Urban Development must provide disaster recovery assistance under the Community Development Block Grant program to states, local governments, certain territories, and Indian tribes. In addition, the Government Accountability Office must report on an existing grant program designed to help communities implement mitigation measures to reduce the risk of loss of life and property in future disasters.

Veterans Residential Care Choice Act

Veterans Residential Care Choice Act This bill authorizes the Department of Veterans Affairs (VA) to place certain veterans in licensed or certified residential care facilities at the request of such veterans. Specifically, the bill concerns veterans to whom the VA is required to provide domiciliary, nursing home, adult day health, or hospital care. Licensed or certified residential care facilities include, but are not limited to, assisted living facilities, basic care facilities, community residences, enriched housing programs, homes for the aged, personal care homes, and shared housing establishments. Under the bill, the VA may enter into a contract or agreement with a licensed or certified residential care facility if the cost of the facility is less than the cost of providing care to such veterans through any other available option.

Affordable Housing and Area Median Income Fairness Act of 2019

Affordable Housing and Area Median Income Fairness Act of 2019 This bill modifies the means by which eligibility for low-income housing assistance and tax credits is determined. The Department of Housing and Urban Development (HUD) is prohibited from considering the New York counties of Westchester and Rockland as within the New York City metropolitan area when determining or establishing area median incomes and income ceilings and limits for the purposes of eligibility for low-income housing assistance. HUD must also assess alternative methods for calculating area median income as well as alternative metrics for use in programs administered by HUD that would make housing more affordable for low-income families in urban areas nationwide. HUD, for the purposes of low-income housing tax credits and exempt facilities bonds, may not apply high housing cost adjustments for any jurisdiction when calculating the area median income or any related metric. A jurisdiction may petition HUD to apply such an adjustment, however. Qualified low-income buildings may not receive a low-income housing credit unless they provide to the relevant housing credit agency certain information required by HUD to determine program compliance. The bill also authorizes through FY2029 certain assistance for jurisdictions for which HUD has applied, or would have applied in the absence of this bill, a high housing cost adjustment.

Basic Assistance for Students In College Act or the BASIC Act This bill directs the Department of Education (ED) to award planning and implementation grants to institutions of higher education in order to identify and meet the basic needs of students, including food, housing, transportation, and health care. ED must also implement an agreement to (1) share data with other federal agencies in order to identify students who may be eligible for certain federal benefits; and (2) coordinate efforts to enroll those students in federal benefits programs, including Medicaid and the Supplemental Nutrition Assistance Program.

CARE for Kids Act of 2019

Caregivers, Access, and Responsible Expansion for Kids Act of 2019 or the CARE for Kids Act of 2019 This bill modifies program requirements for the National School Lunch Program and school breakfast program of the Department of Agriculture. A local educational agency (including any school operated by the Bureau of Indian Education) may certify as eligible for free lunches or breakfasts, without further application, the following: children whose placement with a caregiver was carried out with the involvement of an agency that administers a state plan or a tribal child welfare agency, without regard to whether the agency is responsible for the care and placement of the child; children being raised by a relative who receives adoption or guardianship assistance; and children of a family that lives in housing dedicated to low-income families with a caregiver who is a grandparent or another older person that cares for the child full-time or that receives housing or housing assistance under the Native American Housing Assistance and Self-Determination Act of 1996. The bill also extends eligibility for free or reduced-price school lunches for children who were determined to be eligible in the school year prior to placement with a grandparent or relative for the school year immediately following placement. The bill provides children who receive medical assistance under the Medicaid program with direct certification for free lunches and breakfasts under the school lunch and breakfast programs.

Farm Workforce Modernization Act of 2019

Farm Workforce Modernization Act of 2019 This bill contains provisions related to alien farmworkers, including provisions establishing a certified agricultural worker (CAW) status and changing the H-2A temporary worker program. The Department of Homeland Security (DHS) may grant CAW status to an applying alien who (1) performed at least 1,035 hours of agricultural labor during the two-year period prior to October 30, 2019, (2) was inadmissible or deportable on that date, and (3) has been continuously present in the United States from that date until receiving CAW status. The bill imposes additional crime-related inadmissibility grounds on CAW applicants and makes some other grounds inapplicable. CAW status shall be valid for 5.5 years and may be extended. DHS may grant dependent status to the spouse or children of a principal alien. An alien with a pending application may not be detained or removed by DHS and shall be authorized for employment until DHS makes a final decision on the application. A CAW alien (and dependents) may apply for lawful permanent resident status after meeting various requirements, including performing a certain amount of agricultural labor for a number of years. DHS shall create an electronic platform for (1) filing H-2A petitions, (2) facilitating the processing of H-2A cases, and (3) providing agencies a single tool for obtaining H-2A-related case information. The bill makes various changes to the H-2A program, such as (1) modifying the method for calculating and making adjustments to the H-2A worker minimum wage, (2) specifying how an employer may satisfy requirements that it attempted to recruit U.S. workers, (3) requiring H-2A employers to guarantee certain minimum work hours, and (4) making the program available for year-round agricultural work and reserving a visa allocation for the dairy industry. DHS shall establish a pilot program allowing certain H-2A workers to apply for portable status, which gives the worker 60 days after leaving a position to secure new employment with a registered H-2A employer. DHS shall establish an electronic system patterned on the E-Verify Program for employers to verify an individual's identity and employment authorization. Employers hiring individuals for agricultural employment must use the system. This bill permanently establishes the Housing Preservation and Revitalization Program, which provides financing assistance for rural rental housing and off-farm labor housing and rental assistance for qualified tenants of such housing. It also authorizes the Department of Agriculture to provide various assistance, including funding for insuring loans and grants for new farmworker housing.

Sandy Duplication of Benefits Fairness Act This bill expands the applicability of the waiver of the prohibition against duplication of benefits for disaster relief recipients following Superstorm Sandy. Under current law, the waiver period extends from January 1, 2016, through December 31, 2021. This bill begins that period on October 1, 2012, through December 31, 2021. This change would permit individuals who suffered losses resulting from Superstorm Sandy and who initially applied for and received federal benefits, including Small Business Administration disaster relief loans, to receive additional federal benefits, including funds under the Department of Housing and Urban Development Block Grant for Disaster Relief (CDBG-DR), without having to repay such additional benefits.

Native American Housing Affordability Act of 2019

Native American Housing Affordability Act of 2019 This bill allows the Department of Housing and Urban Development (HUD) to more expeditiously issue a certificate of guarantee for certain loans related to Native American housing. Specifically, HUD may take such action before receiving the required trailing documents if the originating lender agrees to indemnify HUD for any losses during the period in which the required trailing documents are outstanding.

Global Child Thrive Act of 2019 This bill reauthorizes for FY2020-FY2025 programs to provide assistance to orphans and other vulnerable children in developing countries. The bill also requires the U.S. Agency for International Development to direct relevant executive branch agencies to incorporate early childhood development into current programs and promote inclusive early childhood development in partner countries. Such actions to promote early childhood development shall build on existing U.S. plans and strategies and aim to (1) prevent unnecessary family-child separation, (2) assist families with children with disabilities, and (3) help countries transition from child care protection systems that rely on residential care (such as orphanages and children's homes) to ones focused on family-based care.

Housing for Homeless Students Act of 2019

Housing for Homeless Students Act of 201 9 This bill modifies the low-income housing tax credit to allow certain low-income building units that provide housing for homeless children, youth, or veterans who are full-time students to qualify for the credit. To qualify for the credit, the full-time student must have been a homeless child or youth during any portion of the seven-year period prior to occupying the housing unit or a homeless veteran during any portion of the five-year period prior to occupying the unit.

Healing Communities through Health Care Act

Healing Communities through Health Care Act This bill establishes and revises programs to support health care and related services in communities that exhibit indicators that lead to adverse health outcomes. Specifically, the bill requires the Department of Health and Human Services (HHS) to conduct innovative demonstration projects through the Medicaid program in six states to provide housing services to individuals with behavioral health needs who are experiencing housing insecurity, including referrals to housing services from within a health care setting. The bill reauthorizes the HHS health-care occupation education and training grants program for low-income individuals and extends eligibility for such grants to hospitals. The National Institutes of Health also must establish and support a clinical research network to study trauma-informed, community-based interventions for victims of violence. Further, the Health Resources and Services Administration (HRSA) must grant a preference for funding specified health career programs in communities that have high rates of community trauma, such as elevated intergenerational poverty, drug-overdose deaths, or violence-related injuries or deaths. The bill also reauthorizes through FY2025 the HRSA National Health Service Corps, which supports education and student loan repayment for eligible primary care providers in health-professional shortage areas. Additionally, the bill expands the availability of funds for local workforce boards to support employer-sponsored employee training programs that have demonstrated specified results.

Caring Homes and Improved Lives for Dependents (CHILD) Act This bill requires states to consider foster family homes or cottage homes to be the least restrictive setting for children who have attained six years of age and have been removed from their homes, if suitable relatives or other designated caregivers are not available. A cottage home is a residential operation in which not more than 12 children reside; that implements a trauma-informed treatment plan for its residents; that involves family members of a child in the treatment for the child, and maintains contact with the family of the child, if available and if the involvement is clinically appropriate for the well-being of the child; that is licensed by the state where it is located; and that is accredited. The bill makes cottage homes eligible for foster care maintenance payments.

Building Age-Friendly Communities Act

Building Age-Friendly Communities Act This bill modifies an existing committee and makes other changes to incorporate age-friendly communities in federal programs and services for older adults. The bill defines age-friendly communities as those that (1) are taking steps to meet local needs for accessible housing, transportation, and public spaces, as well as for civic participation and social connectedness; and (2) have a plan to guide those efforts. Specifically, the bill renames the Interagency Coordinating Committee on Aging as the Interagency Coordinating Committee on Age-Friendly Communities and more specifically focuses the committee's work on promoting and developing these communities. The committee must also work with the Centers for Disease Control and Prevention and relevant federal agencies to develop recommendations for evidence-based prevention programs and home modifications to reduce and prevent falls among older adults. In addition, the Administration on Aging may provide technical assistance to state and local governments and others on age-friendly communities.

Specifically, the bill requires each state or local government that receives a Community Development Block Grant from the Department of Housing and Urban Development or a Surface Transportation Block Grant from the Department of Transportation to develop and implement a strategy to support zoning policies or regulatory initiatives that create a more affordable, elastic, and diverse housing supply. Additionally, the bill establishes a tax credit for individuals who spend more than 30% of their adjusted gross income on rent and requires the Department of the Treasury to make advance payments of this credit to eligible taxpayers who elect that option. The bill also requires Treasury to establish a Rainy Day Savings Program to allow an eligible taxpayer to defer 20% of the amount that would otherwise be refunded to the taxpayer. Treasury must invest the deferred amount and later disburse that amount, along with any interest, to the taxpayer.

Tribal Energy Reauthorization Act

Tribal Energy Reauthorization Act This bill reauthorizes through FY2030 certain energy grant programs and otherwise revises the activities of the Office of Indian Energy Policy and Programs within the Department of Energy. Specifically, the office must consider the fiscal ability of an Indian tribe, intertribal organization, or tribal energy development organization to meet cost-sharing requirements for energy projects; give priority to partnering with state and local organizations when providing technical assistance to tribes; designate a liaison to ensure that tribes are aware of federal grants and funding opportunities; and develop an energy strategy for tribes in the Arctic to address climate change. The bill also authorizes the office to provide grants for providing or expanding electricity to the homes of members of tribes that are acquired, constructed, or improved with federal funds. Currently, such grants may only be used to provide electricity on Indian land.

Ending Homelessness Act of 2019

Ending Homelessness Act of 2019 This bill provides additional funding for, and otherwise addresses, assistance to homeless individuals and families. The funding provided by the bill is designated as emergency spending, which is exempt from discretionary spending limits. Specifically, the bill provides additional FY2020-FY2024 funding for the Department of Housing and Urban Development (HUD) to (1) award emergency relief grants to address unmet needs of homeless populations in jurisdictions with the highest need, and (2) provide additional incremental rental voucher assistance for individuals and families who are homeless. The bill also provides FY2022-FY2024 funding for HUD to award grants to provide outreach and coordinate services for individuals and families who are homeless or formerly homeless. Further, the bill provides additional annual funding beginning in FY2020 for the Housing Trust Fund (dedicated to affordable housing for extremely low-income and very low-income families) and incremental project-based voucher and rental assistance. During the first five fiscal years in which such additional funding is available, HUD must ensure that priority for occupancy in assisted units is given to individuals and families who are homeless. Further, units receiving such assistance may not require families to contribute more than 30% of their adjusted income towards rent. Additionally, the bill provides FY2020 funding for HUD to provide technical assistance to states, local governments, and nonprofit organizations to integrate and coordinate homeless assistance with federal health care programs. Finally, the bill permanently reauthorizes certain homeless assistance grants and makes permanent the U.S. Interagency Council on Homelessness.

Manufactured Housing Community Sustainability Act of 2019

Manufactured Housing Community Sustainability Act of 2019 This bill amends the Internal Revenue Code to allow a business-related tax credit equal to 75% of the gain from the sale or exchange of real property to a qualified manufactured home community cooperative or corporation if  (1) the property is acquired for use as a manufactured home community, (2) the seller (or any related person) owned the property for the entire two-year period before the sale or exchange, and (3) the property is transferred subject to a binding covenant that the property will be used as a manufactured home community for at least 50 years or the maximum permissible term under state laws that restrict such covenants to a lesser term.. A "qualified manufactured home community cooperative or corporation" is a cooperative or a nonprofit corporation established pursuant to the laws of the state in which the property is located. The bill specifies membership and governance requirements for the communities owned by the cooperative or nonprofit corporation. The bill also imposes a tax on buyers who violate the covenant to use the property for manufactured housing.

Stephanie Tubbs Jones Assets for Independence Reauthorization Act of 2019 This bill reauthorizes through FY2024 and otherwise makes changes to certain demonstration projects that fund individual development accounts (IDAs). (IDAs are matched savings accounts through which low-income individuals may save targeted amounts for qualifying purposes such as first-time home ownership or post-secondary education.) Specifically, the bill (1) expands qualifying expenses for purposes of education and home replacement, repair, or improvement; (2) allows public housing agencies to participate in demonstration projects; (3) increases income eligibility limits; and (4) makes other changes with respect to terminated projects, reporting, and other requirements. The Department of Health and Human Services must give special consideration to applications from certain categories of individuals, including individuals who are or have been in foster care. In addition, an individual who is a recent or current victim of domestic violence shall not, for purposes of project participation, fail to qualify as a first-time homebuyer by reason of having a co-ownership interest in a principal residence with a person who committed domestic violence against the individual.

Protecting Privacy in Our Homes Act This bill requires manufacturers of internet-connected devices that are not specifically marketed as cameras or microphones to disclose to consumers whether a camera or microphone is a component of such device.

Lead-Free Future Act of 2019

Lead-Free Future Act of 2019 This bill addresses lead-based hazards, and their abatement, in residential properties. Specifically, the bill requires the Department of Housing and Urban Development (HUD) to award grants to state and local governments and certain nonprofit organizations for the purpose of evaluating and reducing lead-based hazards in residential properties constructed before 1978. Additionally, the Department of Health and Human Services (HHS) may award grants to state and local governments to monitor blood lead levels in infants, children, and pregnant women and to educate the public on the risks of lead poisoning. To be eligible to receive funding from these grant programs and others addressing lead poisoning, a state or local government must have a blood lead reference level (i.e., the minimum concentration of lead at which it is recommended that public health actions be taken) at or below the level used by the Centers for Disease Control and Prevention. Applicants must also conduct an environmental investigation to identify environmental sources of lead exposure in residential properties and childcare facilities occupied by a child with an elevated blood lead level. In addition, HUD, the Department of Agriculture, the Federal Housing Finance Agency, and the Department of Veterans Affairs must require alignment with specified federal laws, including those related to lead-risk assessment and lead-hazard remediation, as a condition of eligibility for federal mortgage programs and certain federally supported housing. These agencies must also test and remedy lead hazards in such housing.

Direct CARE Opportunity Act

Direct Creation, Advancement, and Retention of Employment Opportunity Act or the Direct CARE Opportunity Act This bill directs the Department of Labor to award grants to recruit, retain, or provide advancement opportunities to direct care workers. The term "direct care worker" includes home health aides, psychiatric aides, nursing assistants, and personal care aides who assist seniors and persons with disabilities in their homes.

Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2020 This bill provides FY2020 appropriations for the Department of Agriculture (USDA), the Food and Drug Administration, and Related Agencies. The bill provides appropriations to USDA for Agricultural Programs, including the Office of the Secretary, Executive Operations, the Office of the Chief Information Officer, the Office of the Chief Financial Officer, the Office of Civil Rights, Agriculture Buildings and Facilities, Hazardous Materials Management, the Office of Inspector General, the Office of the General Counsel, the Office of Ethics, the Economic Research Service, the National Agricultural Statistics Service, the Agricultural Research Service, the National Institute of Food and Agriculture, the Animal and Plant Health Inspection Service, the Agricultural Marketing Service, and the Food Safety and Inspection Service. The bill also provides appropriations to USDA for Farm Production and Conservation Programs, including the Farm Production and Conservation Business Center, the Farm Service Agency, the Risk Management Agency, and the Natural Resources Conservation Service. The bill provides appropriations to the Federal Crop Insurance Corporation Fund and the Commodity Credit Corporation Fund. For USDA Rural Development programs, the bill includes appropriations for Rural Development Salaries and Expenses, the Rural Housing Service, the Rural Business-Cooperative Service, and the Rural Utilities Service. Within the Food and Nutrition Service budget, the bill includes appropriations for Child Nutrition Programs; the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC); the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program); the Commodity Assistance Program; and Nutrition Programs Administration. Within the Foreign Agricultural Service budget, the bill provides appropriations for Food for Peace Title II Grants and McGovern-Dole International Food for Education and Child Nutrition Program Grants. The bill also provides appropriations for the Food and Drug Administration and the Farm Credit Administration. Additionally, the bill sets forth requirements and restrictions for using funds provided by this and other appropriations Acts.
