Specifically, the bill authorizes additional grants under the Fair Housing Initiatives Program and the Fair Housing Assistance Program, both administered by the Department of Housing and Urban Development (HUD); authorizes additional staffing for the Office of Fair Housing and Equal Opportunity to respond to fair housing complaints arising out of the emergency; authorizes the office to carry out a national media campaign to inform the public of expanded housing rights during the emergency; and requires HUD to prohibit owners of federally assisted dwellings from showing occupied units to prospective tenants during the emergency.

COVID–19 Mortgage Relief Act

COVID-19 Mortgage Relief Act This bill extends protections for renters and mortgage borrowers provided in response to the COVID-19 (i.e., coronavirus disease 2019) emergency, revises bankruptcy provisions, and expands COVID-19 aid programs to include mortgage servicers. Mortgage forbearance may be extended to borrowers for up to 12 months. Currently, borrowers may receive 180 days of forbearance, with an extension of up to an additional 180 days. The bill also expands the forbearance provisions to apply to nonfederally backed mortgages. The bill expands the current moratorium on evictions of renters from property receiving a forbearance to generally protect all such renters, not only renters in federally assisted housing or property that has a federally backed mortgage. The current moratorium on mortgage foreclosures is extended from 60 days beginning on March 18, 2020, to 6 months after enactment of this bill. The bill also expands this moratorium to include nonfederally backed mortgages. Additionally, the bill generally revises bankruptcy provisions. COVID-19 aid is excluded from property subject to bankruptcy proceedings and the homestead exemption available to individual debtors is increased, among other protections. Existing COVID-19 economic aid programs are expanded to include mortgage servicers. The Department of the Treasury must allow mortgage servicers to participate in these programs to receive loans, loan guarantees, and other investments currently offered to eligible businesses, states, and municipalities.

Promoting Access to Credit for Homebuyers Act of 2020 This bill requires Freddie Mac, Fannie Mae, and the Department of Housing and Urban Development to purchase or insure single-family mortgages originated on or after February 1, 2020, on the same terms as they otherwise would despite a borrower entering into, or inquiring about, forbearance due to a COVID-19 (i.e., coronavirus disease 2019) related hardship. This requirement begins 5 days after enactment of this bill and ends 60 days after the end of the period of time a borrower may request a COVID-19 related forbearance. The Federal Housing Finance Agency may not increase fees or otherwise restrict access to credit during the COVID-19 emergency without congressional notice. The Government Accountability Office must report on COVID-19-related assistance to consumers by Freddie Mac, Fannie Mae, and the Federal Housing Administration mortgage insurance programs.

Housing Financial Literacy Act of 2020 This bill modifies the discount given by the Federal Housing Administration (FHA) on single-family mortgage-insurance premium payments for first-time homebuyers who complete a financial-management counseling program. Under current law, the maximum premium amount for such homebuyers is 2.75% of the original insured principal obligation of the mortgage (compared to 3% for other homebuyers). The bill instead requires that the premium amount for such homebuyers (1) in the case of a mortgage insured within four years of enactment, be 25 basis points (0.25% of the original insured principal obligation of mortgage) lower than the amount otherwise established by the FHA; or (2) in the case of a mortgage insured four years after enactment, at a rate set by the FHA that corresponds to the reduced risk of loss due to the counseling.

Repatriation Reimbursement Act

Repatriation Reimbursement Act This bill requires the U.S. commercial airline industry and the Department of State to fully reimburse or waive certain travel expenses for U.S. citizens who seek repatriation to the United States as a result of the COVID-19 (i.e., coronavirus disease 2019) pandemic. The bill requires U.S. commercial airlines to (1) provide cash reimbursements to U.S. citizens for any international flight to the United States cancelled or delayed more than 24 hours as a result of COVID-19 restrictions, (2) waive and reimburse change fees for replacing an international flight ticket, and (3) not charge passengers more for the replacement ticket than what was charged for the original ticket. Such requirements apply to travel expenses incurred on or after December 31, 2019, and on or before September 30, 2020. The State Department must (1) waive any travel expenses paid by it on or after December 31, 2019, for any U.S. citizen who is evacuated from a foreign country and repatriated to the United States due to COVID-19 travel restrictions, or any future pandemic or international crisis; (2) nullify any travel expense promissory note required for reimbursing the State Department; (3) reimburse such individuals for travel expenses associated with evacuation and repatriation, including the costs of flights and ground transportation expenses associated with travel to a foreign airport and from the domestic airport to their homes in the United States; and (4) develop an online reimbursement system for individuals to submit claims for the reimbursement of travel expenses.

Securing America's Critical Minerals Supply Chain Act This bill allows a new tax deduction for 10% of the cost of specified domestically-produced materials if such materials are acquired directly from the domestic smelter or processor of the materials. The bill defines specified domestically-produced materials as materials that are smelted or processed in the United States by direct smelting of ore, from a mine product, by a taxpayer in the trade or business of smelting or processing such materials. The term specified material includes minerals necessary for national defense and security, for U.S. energy infrastructure, for community resiliency, to support domestic manufacturing, agriculture, housing, telecommunications, healthcare, and transportation infrastructure, or for U.S. economic security and balance of trade. The term does not include fuel minerals, water, ice, or snow, or sand, stone, gravel, pumice, pumicite, cinders, or clay.

Indo-Pacific Deterrence Initiative This bill directs the Department of Defense (DOD) to establish the Indo-Pacific Deterrence Initiative. The bill also authorizes various related programs. The initiative shall seek to (1) enhance U.S. presence in the region by positioning U.S. capabilities to allow timely response to adversarial threats, (2) strengthen the capability of U.S. forces and regional allies and partners, and (3) meet objectives under the National Defense Strategy. The U.S. Indo-Pacific Command may carry out social media-related activities to counter misinformation and propaganda in the region. The bill also authorizes for FY2021 various activities and projects, including a permanent and persistent land-based air and missile defense system in Guam; a homeland defense radar in Hawaii; Missile Defense Agency activities in the region; intelligence, reconnaissance, and related capabilities for the U.S. Indo-Pacific Command; a Marine Unit Deployment Program and Marine Corps rotational presence in the region; Air Force and Navy unit pre-positioning for regional activities; DOD procurement of key munitions for the Indo-Pacific Command; military construction, land acquisition, and military family housing functions; a program to enhance communications capabilities with allies and partners in the region; and various training activities, such as joint training through the Combatant Commanders Exercise Engagement and Training Transformation Program.

Rent and Mortgage Cancellation Act of 2020 This bill provides housing assistance during the COVID-19 (i.e., coronavirus disease 2019) public health emergency. Specifically, the bill suspends rental and mortgage payments for primary residences for a period lasting until 30 days after the termination of the federal emergency declaration relating to COVID-19. The Department of Housing and Urban Development (HUD) must establish funds to reimburse lessors and lenders for payments suspended under the bill. In addition, HUD must establish an Affordable Housing Acquisition Fund to support the acquisition of multifamily housing projects by nonprofit organizations, public housing agencies, cooperative housing associations, community land trusts, and state and local governments. For a five-year period, entities that are approved for such assistance shall be provided the first right of purchase with respect to such projects.

Caregivers, Access, and Responsible Expansion for Kids Act of 2020 or the CARE for Kids Act of 20 20 This bill modifies program requirements for the National School Lunch Program and school breakfast program of the Department of Agriculture. A local educational agency (including any school operated by the Bureau of Indian Education) may certify as eligible for free lunches or breakfasts, without further application, the following: children whose placement with a caregiver was carried out with the involvement of an agency that administers a state plan or a tribal child welfare agency, without regard to whether the agency is responsible for the care and placement of the child; children being raised by a relative who receives adoption or guardianship assistance; and children of a family that lives in housing dedicated to low-income families with a caregiver who is a grandparent or another older person who cares for the child full-time or who receives housing or housing assistance under the Native American Housing Assistance and Self-Determination Act of 1996. The bill also extends eligibility for free or reduced-price school lunches for children who were determined to be eligible in the school year prior to placement with a grandparent or relative for the school year immediately following placement. The bill provides children who receive medical assistance under the Medicaid program with direct certification for free lunches and breakfasts under the school lunch and breakfast programs.

Ensuring Homeowner and Occupant Monetary Encouragement and Stability Act or the Ensuring HOMES Act This bill sets forth additional housing protections during the COVID-19 (i.e., coronavirus disease 2019) emergency period. Mortgage holders and lenders are prohibited from requiring payment on a mortgage deferred during the COVID-19 emergency period until the later of (1) the last day of the loan term, or (2) the end of the deferral period. The bill establishes the Tenant Protection Program that provides loans to landlords who waive rent during the COVID-19 emergency period. The bill also provides for forgiveness of these loans if the landlord provides lease extensions and agrees not to evict tenants. This bill applies retroactively to the beginning of the COVID-19 emergency period and applies to any future declared COVID-19 emergency period.

Improving Access to Services Act This bill requires transportation planners to consider projects and strategies to improve safe and convenient access to certain services, including health care facilities, child care, and affordable housing. ( Access is the ability to travel by auto, transit, pedestrian, and bike networks measured in terms of travel times, with impedances for level of travel stress for active travel and costs for low income travelers.) The Department of Transportation must establish minimum standards for states to use in determining and improving safe and convenient access to certain services for all users by all modes of travel. If a state fails to improve access, it must obligate 10% of federal transportation funds apportioned to such state from the previous fiscal year into its efforts to meet the minimum standards to improve access. The bill prohibits metropolitan transportation planning organizations from approving a transportation improvement plan that increases the ratio of automobile to non-automobile access in urbanized areas.

Among other things, the bill provides direct payments to individuals of up to $2,000 a month, subject to limits based on adjusted gross income; establishes digital wallets for individuals without bank accounts to receive such payments; provides for the suspension of specified housing and consumer loan payments, evictions, and foreclosures; creates financial assistance programs regarding housing, student loans, and utilities; establishes credit programs for small businesses, nonprofit organizations, farms, independent contractors, minority depository institutions, and community development financial institutions; authorizes funds for housing assistance, elderly assistance, and emergency production of medical supplies; and provides for investigation, oversight, and other requirements regarding COVID-19 aid. The bill also modifies existing provisions, including those regarding deposit insurance for transaction accounts, Federal Reserve Board purchases of municipal bonds, stock buybacks, required disclosures by issuers of securities, international aid programs, and agency guidance concerning pandemics and major disasters.

Housing is a Human Right Act of 2020 This bill establishes and expands programs to assist homeless and housing-unstable individuals and establishes new real property-related taxes to fund specified Department of Housing and Urban Development (HUD) programs. HUD must establish the Community Development Block Grant Plus Program for state and local governments to assist homeless and housing-unstable individuals as well as cost-burdened households. These funds may be used only for certain activities that assist these populations, including the construction of new affordable housing. The bill also establishes other grant programs to assist these individuals, such as by facilitating access to voting and libraries. Governmental entities may not receive assistance under the bill unless they have, or are working to implement, policies that (1) do not criminally punish homeless individuals for sleeping outside or on public property, and (2) comply with constitutional protections for these individuals' property. In addition, the bill establishes taxes on (1) the sale or exchange of real property of at least $10 million, (2) the sale or exchange of real property involving an anonymous entity, and (3) rent received by landlords that own large amounts of dwelling units. The revenue from these taxes must be credited to various HUD programs in specified percentages. The Government Accountability Office must study (1) the allocation formula for Emergency Food and Shelter grants, (2) recipient compliance with various grant program guidelines, and (3) barriers related to access to essential documents that homeless and housing-unstable individuals face.

This bill suspends foreclosures and establishes a forbearance program for certain federally backed mortgages during the coronavirus (i.e., the virus that causes COVID-19) outbreak and other disasters. Specifically, during the coronavirus outbreak or in an area where another disaster has been declared, a federally backed mortgage servicer is (1) prohibited from initiating a foreclosure, and (2) must suspend any foreclosure procedures. These requirements are lifted 180 days after such a declaration. Borrowers experiencing financial hardships due to the coronavirus outbreak or other disaster may request a forbearance on their federally backed mortgage payment for 180 days, which may be extended for an additional 180 days at the borrower's request. A servicer may not charge fees, interest, or other penalties in connection with the forbearance. Before the end of the forbearance period, a servicer must evaluate a borrower's ability to make regular mortgage payments. If the borrower is unable to return to making regular payments, the servicer must evaluate the borrower for certain loan modification options.
