Respect State Housing Laws Act This bill eliminates a provision that requires a 30-day notice period before a landlord may begin eviction proceedings against a tenant in federally assisted or federally backed housing.

Home Internet Accessibility Act This bill requires the Government Accountability Office (GAO) to report on broadband internet capacity in housing that is supported by the Department of Housing and Urban Development (HUD) or the Department of Agriculture. In its report, the GAO must identify such housing that lacks broadband capacity and estimate the costs and time frame necessary to provide broadband capacity in such housing. Additionally, HUD must develop a plan for retrofitting such housing to provide the capacity for broadband internet.

Homelessness and Behavioral Health Care Coordination Act of 2023 This bill requires the Department of Housing and Urban Development (HUD) to award competitive grants to improve coordination of health care and homelessness services for individuals who are homeless, have significant behavioral health issues (e.g., mental health and substance use disorders), and voluntarily seek assistance. Entities eligible for these five-year grants include local and tribal governments, public housing agencies that administer housing choice vouchers, and certain nonprofits. The bill prohibits grant funds from being used to pay for rent or health care, except to increase the availability of Naloxone (i.e. medication that reverses opioid overdoses) and provide training for its administration. Further, the bill requires HUD to establish an interagency working group to (1) consult on the grant program, and (2) develop and circulate materials for providers of health care and homelessness services that simplify the services each offers in order to help each sector better understand the other.

Reimbursing Border Communities Act of 2023 This bill requires the Department of Homeland Security to make grants to certain border communities for expenses related to security measures along the southern border. Specifically, the local government of a community is eligible for a grant if it is located within 200 miles of the border and is not a sanctuary jurisdiction as defined by the bill. Additionally, no grant may be used to reimburse nonprofit organizations, fund legal representation, or provide educational, housing, food, or health care resources to a non-U.S. national ( alien under federal law).

Housing Oversight and Mitigating Exploitation Act of 2023 or the HOME Act of 2023 This bill requires oversight and investigations into potentially unfair pricing practices in the residential rental and single-family housing markets. The bill makes it unlawful to rent or sell a dwelling unit or single-family home at an unconscionably excessive and exploitative price during a housing emergency declared by the President. The Department of Housing and Urban Development (HUD) and state attorneys general may enforce these provisions. In addition, HUD must carry out investigations and other activities to address market manipulation and the role of institutional investors in the pricing of rental units and single-family homes. In particular, HUD must investigate market manipulation and price gouging practices that affect rent or sale prices; establish an office to collect, monitor, and analyze data on housing markets to support competitive market practices, identify market manipulation, and facilitate enforcement of housing protections; and monitor housing markets to determine whether any single purchaser is purchasing an excessive amount of housing. Further, the bill directs various federal agencies to (1) collect data and identify practices that unfairly prevent rental housing applicants and tenants from accessing or staying in housing, and (2) identify anti-competitive behaviors in the single-family home and residential rental markets. The bill also requires the Federal Housing Finance Agency to establish standards and criteria for Fannie Mae and Freddie Mac regarding purchases of mortgages on multifamily rental housing. The standards and criteria must ensure certain renter protections and prevent egregious rent increases for the tenants in such housing.

Justice for All Act of 2023 This bill prohibits discrimination based on sex, sexual orientation, gender identity, or race-related characteristics in schools, businesses, federally funded programs, and other settings. It also provides statutory authority for and expands the types of civil actions that may be brought for violations. For example, the bill expands provisions under the Civil Rights Act of 1964 so as to (1) prohibit federally funded programs from discriminating based on sex or religion; and (2) prohibit public accommodations, including stores and transit services, from discriminating based on sex. The bill defines sex to include sex stereotypes, pregnancy, childbirth, sexual orientation, gender identity, and sex characteristics. It also expands the definition of race to include traits that have been historically associated with race (e.g., natural hair textures). The expanded definitions apply to the Civil Rights Act of 1964, the Fair Housing Act (discrimination in public and private housing), and Title IX of the Education Amendments of 1972 (discrimination based on sex in federally funded educational programs). Further, the bill provides statutory authority for disparate impact or intentional discrimination claims under the aforementioned acts, as well as the Age Discrimination Act of 1975 (discrimination based on age by federally funded programs) and the Rehabilitation Act of 1973 (discrimination based on disability by federally funded programs). The bill also includes other provisions that address (1) profiling by law enforcement officers, (2) employer liability with respect to civil rights violations, (3) predispute arbitration agreements in civil rights cases, and (4) governmental immunity in suits involving constitutional violations.

Native American Direct Loan Improvement Act of 2023 This bill revises the Native American Direct Loan (NADL) program, which is administered by the Department of Veterans Affairs (VA). Under the NADL program, the VA makes loans directly to Native American veterans to purchase, construct, improve, or refinance their homes located on federal trust land. Specifically, the bill expands the NADL program by allowing Native American veterans to refinance other existing mortgage loans on the same property if certain conditions are met. Additionally, the bill requires the VA to conduct additional program outreach by partnering with local service providers (e.g., tribal organizations and nonprofit organizations) to conduct outreach, homebuyer education, housing counseling, and post-purchase education. The bill directs the VA to assign a sufficient number of personnel to carry out the NADL program, including construction and valuation specialists to assist with issues unique to new construction and renovations on trust land. The bill also authorizes the VA to make a loan with a 1% interest rate to a Native community development financial institution to allow the institution to relend loan amounts to qualified Native American veterans residing on federal trust land.

Healthy Foundations for Homeless Veterans Act This bill permanently authorizes the Department of Veterans Affairs (VA) to use specified funding to provide assistance to homeless veterans and veterans participating in the Department of Housing and Urban Development-VA Supportive Housing (HUD-VASH) program. Additionally, the VA may collaborate with one or more organizations to manage the use of VA land for homeless veterans for living and sleeping. (Under current law, similar authorities have been temporarily provided to the VA for the duration of the COVID-19 public health emergency.)

Investing in State Energy Act of 2023 This bill revises requirements concerning the distribution of funds under the Weatherization Assistance Program (WAP) and the State Energy Program (SEP) to state agencies and local partners that implement energy initiatives. Under WAP, the Department of Energy (DOE) reduces energy costs for low-income households by increasing the energy efficiency of their homes. Under SEP, DOE supports state energy conservation plans and energy security. This bill requires DOE, upon receiving state or area plans under WAP or SEP, to distribute funds to the recipients of the funding as quickly as practicable. Within 60 days of Congress making the funds available for WAP and SEP, DOE must (1) provide application guidance for financial assistance, and (2) publish the allocation of financial assistance to be provided to states under the programs.

The Hurricanes of 2022 Disaster Relief Rectification Act The bill rescinds certain unobligated disaster relief funds that were provided by the Disaster Relief Supplemental Appropriations Act, 2023 and provides additional funding to assist states, territories, and federal facilities impacted by Hurricanes Fiona, Ian, or Nicole. The bill also modifies various policies and programs related to disaster assistance, including to allow certain disaster relief funds to be provided as block grants to eligible states and territories, require the Federal Emergency Management Agency (FEMA) to reimburse local governments and electric cooperatives for certain interest payments for loans related to disasters, establish a process for states to request waivers of restrictions related to the deployment of FEMA travel trailers or manufactured housing units in flood hazard areas, establish a pilot program under which FEMA may make grants to Florida for elevating structures located in areas that have special flood hazards or in other areas of flood risk, and require the Department of Agriculture to make specified revisions to the regulations for the Emergency Watershed Protection Program.

This bill modifies the process for repaying service members and veterans who paid to keep benefits under the Montgomery GI Bill, but later chose to utilize Post-9/11 GI Bill benefits. Specifically, the bill removes the requirement for the Department of Veterans Affairs (VA) to issue the repayments with the last monthly housing stipend under the Post-9/11 GI Bill. This requirement has limited the repayments to individuals who are receiving stipends. Under the bill, the VA must make such a repayment before the exhaustion of the individual's entitlement to education assistance.

Lifting Local Communities Act This bill specifies that government entities may not discriminate against religious organizations when awarding federal funds for social services programs (i.e., government programs that provide services for low-income individuals and communities, such as child care, transportation, employment, housing, and meal services). Specifically, religious organizations are eligible to apply for and receive federal funds to provide services for social services programs on the same basis as private, nonreligious organizations. Additionally, government entities may not discriminate against private organizations on the basis of religion when selecting funding recipients. Organizations that receive federal funds for social services programs may not discriminate against individuals on the basis of religion when providing services. If an individual objects to the character or affiliation of a private organization that is providing a service as part of a social services program, government entities must provide the individual with reasonable alternatives. Religious organizations may bring civil actions against entities for violations.

Choice in Affordable Housing Act of 2023 This bill establishes programs and grants to incentivize landlord participation in the Housing Choice Voucher program (i.e., Section 8 tenant-based housing assistance). The bill authorizes the Department of Housing and Urban Development (HUD) to provide one-time incentive payments to landlords, security deposit payments, bonuses to public housing agencies that employ landlord liaisons, and amounts for other recruitment purposes. The bill also reauthorizes through FY2028 the Tribal Housing and Urban Development-Veterans Affairs Supportive Housing program. Additionally, the bill allows dwelling units to meet Housing Choice Voucher program inspection requirements by satisfactory inspection through participation in other housing programs. Landlords not yet participating in a low-income housing assistance program may request inspection by a public housing agency to determine whether the dwelling meets requirements prior to selection by a tenant. Finally, HUD must expand the use of an alternative method of calculating fair market rent for purposes of the Housing Choice Voucher program.

Return Home to Housing Act This bill increases the maximum rate of per diem payments provided by the Department of Veterans Affairs (VA) to entities (i.e., grant recipients or authorized entities) that furnish services and transitional housing to homeless veterans. The bill also specifies that the VA may adjust the per diem rate in response to an emergency.

Let's Get to Work Act of 2023 This bill modifies and expands work requirements under the Supplemental Nutrition Assistance Program (SNAP) and certain housing programs of the Department of Housing and Urban Development (HUD). Specifically, the bill repeals the temporary suspension of work requirements due to COVID-19 that allowed participants who would have lost eligibility due to such requirements to continue to receive SNAP benefits. It also expands work requirements under SNAP to apply to all able-bodied adults receiving benefits who are under the age of 60 (currently 50) as well as to individuals who have children over the age of 6. The bill exempts from work requirements an individual who is responsible for a dependent and married to, and resides with, an individual who is in compliance with the work requirements. The bill terminates a state's authority to provide exemptions to individuals who do not meet work requirements. Additionally, the bill establishes work requirements for families residing in public housing by applying SNAP work requirements to the HUD public housing and tenant-based rental assistance (voucher) programs.

Protect Communities from a Porous Border Act of 2023 This bill requires the Department of Homeland Security (DHS) to notify a state before placing a non-U.S. national ( alien under federal law) in that state and gives the state final authority to prohibit such a placement. At least 10 business days before placing (e.g., detaining or housing) such an individual in a state, DHS must provide certain information to that state, including (1) the individual's biographic and biometric information, including DNA; and (2) a certification that the biometric and biographic information has been checked in various law enforcement and counterterrorism databases. No federal court shall have jurisdiction to review (1) the requirements and procedures established under this bill, or (2) a decision by a state to prohibit the placement of such an individual in the state. The bill also prohibits any federal official from waiving any of the bill's requirements.

Affordable Housing Equity Act of 2023 This bill requires allocations through 2033 of low-income housing credit amounts for buildings designated to serve certain low-income households (i.e., aggregate household income does not exceed the greater of 30% of area median gross income, or 100% of an amount equal to the federal poverty line). The bill also increases the rate of the low-income housing credit for projects designated to serve such low-income households.

Public Housing Emergency Response Act This bill authorizes additional assistance from the Public Housing Capital Fund to public housing agencies (PHAs) based upon capital needs as determined by the PHA's most recent physical needs assessment. The physical needs assessment identifies work that a PHA would need to undertake to bring its units up to certain energy conservation standards and other standards.

Post-Disaster Assistance Online Accountability Act This bill establishes a centralized location to publish information on disaster assistance provided by federal agencies. The Small Business Administration, the Department of Housing and Urban Development, and any agencies providing disaster assistance must make available to the public on a quarterly basis information regarding (1) the total amount of assistance provided by the agency; (2) the amount provided that was expended or obligated; and (3) all projects or activities for which assistance was expended, obligated, or used.

Drug Testing for Welfare Recipients Act This bill requires the Temporary Assistance for Needy Families program, the Supplemental Nutrition Assistance Program, and specified public housing programs to subject individuals to substance-abuse screening and to deny benefits for individuals who test positive for a controlled substance.

Stop Human Trafficking in School Zones Act This bill establishes an enhanced penalty—an additional prison term of up to five years—for certain human trafficking offenses and sex offenses involving minors that occur within 1,000 feet of the real property comprising a school, school-sponsored activity, playground, or public housing facility; or within 100 feet of certain other places where children gather (e.g., a youth center or swimming pool). The additional prison term must be served consecutively with the prison term imposed for the underlying offense.

No Free Rent for Freeloaders Act of 2023 This bill directs the Department of Housing and Urban Development (HUD), on an annual basis, to monitor the extent of noncompliance of public-housing tenants with certain community service and economic self-sufficiency requirements, determine the aggregate amount provided in federal subsidies for all public-housing dwelling units that were occupied by noncompliant tenants, and publish this amount in the Federal Register. In each fiscal year, the amount as determined and published for the preceding fiscal year must be rescinded from funds made available for HUD's Management and Administration account.

Veterans, Women, Families with Children, Race, and Persons with Disabilities Housing Fairness Act of 2023 or the Housing Fairness Act of 2023 This bill expands efforts to detect and address housing discrimination. Specifically, the Department of Housing and Urban Development (HUD) must conduct a nationwide testing program to (1) detect and document differences in the treatment of prospective renters, homebuyers, or mortgage borrowers; (2) measure patterns of adverse treatment because of the race, color, religion, sex, familial status, disability status, or national origin of a renter, homebuyer, or borrower; and (3) measure the prevalence of such discriminatory practices across housing and mortgage lending markets. The bill also reauthorizes through FY2027 the Fair Housing Initiatives Program, which supports organizations that provide direct assistance to individuals who have been victims of housing discrimination. Additionally, HUD must implement a grant program to assist public and private nonprofit organizations in (1) conducting comprehensive studies on the causes or effects of housing discrimination and segregation, and (2) implementing pilot projects that test solutions to help prevent or alleviate housing discrimination and segregation.

Alternative Data for Additional Credit FHA Pilot Program Reauthorization Act This bill establishes a pilot program for an additional credit rating system for use by mortgage lenders. Specifically, the program must utilize one or more commercially available credit scoring models that apply additional credit information about borrowers who have insufficient credit histories for purposes of determining their creditworthiness for mortgages insured by the Federal Housing Administration.
