The Government should keep the current 5-year qualifying period for Indefinite Leave to Remain and ensure that no new rules are applied retrospectively to people already on a valid route to settlement. Any changes should apply only to new applicants. Retrospective immigration changes would unfairly disrupt the lives of individuals who have planned their future around the existing 5-year ILR route. People already living, working and contributing to the UK should not have the terms of their settlement route changed suddenly. Stability and fairness require that new rules only affect future applicants.

We call on the Government to apply new immigration rules only to future arrivals. Applying them retrospectively breaches trust, violates legitimate expectations, is cruel to those already on their route to settlement, and conflicts with ECHR and family law protections. We request this because the retrospective application of the November 2025 Earned Settlement proposals is inherently unjust. Individuals already residing in the UK or progressing towards settlement have organized their lives based on existing regulations. Retroactive changes breach trust, violate legitimate expectations, inflict hardship, and conflict with ECHR and family law, undermining fairness and legal certainty.

The British public has never had any choice in the levels of the migrant population within the Country. Currently, any Government can increase or decrease migrant levels as they see fit. These levels should be made transparent and a compulsory disclosure within every Party Manifesto. By definition, by not having predetermined migrant levels, means that any level of immigration is “uncontrolled” This is widely accepted as the single biggest topic for the electorate today, yet it has never had any say in the matter. The fact this is not disclosed by any political party is making the topic divisive in the absence of any template. The electorate should be able to make their own decision based on each Parties Manifesto pledge as to what is appropriate for themselves.
