Border Act of 2024 The bill expands Department of Homeland Security (DHS) authority to address the processing of non-U.S. nationals ( aliens under federal law) and provides supplemental appropriations for related purposes. Among other provisions, the bill provides DHS emergency authority to summarily remove or prohibit the entry of certain non-U.S. nationals within 100 miles of the southwest land border. DHS may exercise this authority if DHS encounters an average of 4,000 non-U.S. nationals within a seven-day period. If the number of encounters reach certain higher thresholds, DHS must exercise the emergency authority. This emergency border authority expires after three years and may be modified by the President under specified circumstances. Next, the bill establishes an expedited process that authorizes asylum officers to adjudicate certain asylum claims. Among other provisions, these provisional noncustodial removal proceedings impose certain target timelines for determining asylum claims and limit review of denied claims. The bill also establishes a stricter threshold for individuals to remain in the United States pending adjudication of an asylum petition. The bill extends and establishes immigration pathways for Afghan citizens or nationals, including by (1) making certain individuals admitted or paroled to the United States eligible for conditional permanent resident status, and (2) expanding eligibility for special immigrant visas for certain individuals who were injured while supporting the U.S. mission in Afghanistan. The bill also increases base pay for asylum officers and grants DHS temporary direct hire authority to hire personnel to implement the bill.

This bill authorizes the Department of State to expand certain passport application processing services and directs related changes. The bill requires the State Department to increase (1) the number of companies certified to provide expedited processing (formally known as hand-carry courier services ) of passport applications, and (2) the daily maximum number of passport applications that passport offices may accept from certified passport expeditors. The bill also authorizes the State Department to designate notaries public, among others, as passport acceptance agents. Additionally, the bill provides that passports issued 180 days or more after the bill's enactment shall expire on the passport holder's birthday.

This bill directs U.S. Customs Border and Protection (CBP) to establish procedures for performing repairs and maintenance projects below a certain cost at certain federally owned ports of entry. Specifically, these procedures shall cover repair and maintenance projects at federally owned ports of entry that engage in certain activities, such as entry inspections and activities to prevent the entry of illicit drugs, agricultural pests, and contraband. The procedures shall cover projects that cost no more than $300,000, with this cap to be adjusted annually for inflation. CBP may perform such repair and maintenance projects in accordance with the procedures established under this bill.

Violence Against Women by Illegal Aliens Act This bill establishes certain criminal grounds for making non-U.S. nationals ( aliens under federal law) inadmissible and expands the crimes for which a non-U.S. national is deportable. First, the bill establishes that a non-U.S. national is inadmissible if the individual has admitted to or is convicted of acts constituting the essential elements of domestic violence (i.e., a crime of violence within certain close relationships), a sex offense, or conspiracy to commit a sex offense.  Next, the bill establishes additional grounds for deportation. Under current law, a non-U.S. national is deportable for certain criminal convictions, including domestic violence, stalking, and child abuse. The bill makes any sex offense (including crimes against minors) or conspiracy to commit a sex offense a basis for deportation. The bill also expands the domestic violence crimes that make a non-U.S. national deportable to include physical or sexual abuse or a pattern of coercive behavior when it occurs within certain close relationships.

Emerging Innovative Border Technologies Act This bill requires U.S. Customs and Border Protection (CBP) and the Science and Technology Directorate of the Department of Homeland Security to develop a plan to identify, integrate, and deploy emerging and innovative technologies to improve border security operations. Such technologies may incorporate artificial intelligence, machine-learning, automation, fiber-optic sensing technology, nanotechnology, optical and cognitive radar, modeling and simulation technology, hyperspectral and LIDAR sensors, and imaging, identification, and categorization systems.  The bill authorizes CBP to establish one or more Innovation Teams to research and adapt commercial technologies that may be used by CBP. The plan must describe how the Innovation Teams have been implemented and also detail goals and timelines for adoption of qualifying technologies; metrics and key performance parameters for determining the plan's effectiveness; which technologies used by other federal agencies CBP may also utilize; which existing authorities CBP may use to procure technologies; how CBP legacy border technology programs may be replaced; the expected privacy and security impact of security-related technology on border communities; and recent technological advancements in specified technologies. CBP must provide the plan to Congress within 180 days of the bill’s enactment. The bill also requires CBP to annually report to Congress regarding the activities of the Innovation Teams.
