Atomic Energy Advancement Act This bill establishes various requirements to accelerate the deployment of nuclear energy technologies, such as advanced nuclear reactors. Specifically, the bill sets forth requirements that direct the Nuclear Regulatory Commission (NRC) to efficiently license and regulate nuclear energy activities. The bill also revises the NRC's hiring process to enable the NRC to respond to a severe shortage of candidates or a critical hiring need by using direct hiring for certain positions to carry out NRC's responsibilities and activities in a timely, efficient, and effective manner. It also reduces certain licensing fees charged by the NRC for advanced nuclear reactors. Further, it authorizes the Department of Energy (DOE) to make awards that pay for certain licensing fees. Additionally, the bill directs the NRC to promulgate a final rule that implements a process to facilitate efficient and timely environmental reviews of nuclear reactor applications. The NRC must also develop and implement strategies to enable efficient and timely licensing reviews for, and to support the oversight of, nuclear facilities at brownfield sites, including sites with retired fossil fuel facilities. Next, the bill sets forth requirements for expediting certain licensing decisions for new nuclear reactors that will use a previously licensed design and will be on or adjacent to a site on which a nuclear reactor already operates or previously operated. It also establishes a pilot program that allows DOE to make long-term power purchase agreements for power generated by commercial nuclear reactors. Finally, the bill establishes requirements concerning international nuclear energy cooperation and safety.

Increasing Nuclear Safety Protocols for Extended Canister Transfers Act or the INSPECT Act This bill requires the Nuclear Regulatory Commission to assign a resident inspector to each commercial nuclear power plant that has permanently ceased operation. The inspector must (1) conduct inspections of decommissioning activities and spent nuclear fuel transfer activities, and (2) remain at the plant until all fuel is transferred from its spent fuel pools to dry storage.

Provide Logistical Aid to airports via advanced Nuclear Energy Act or the PLANE Act This bill directs the Nuclear Regulatory Commission (NRC), the Federal Aviation Administration (FAA), and other agencies to establish procedures to deploy microreactors at airports. A microreactor is an advanced nuclear reactor, including a portable nuclear reactor, that has an electricity generating capacity of not more than 20 megawatts of electricity and not more than 100 megawatts of thermal energy. Specifically, deployment procedures must be established to respond to a primary power source disruption event stemming from a natural disaster. The FAA, the NRC, the Federal Emergency Management Agency, and the Department of Energy must collaborate to establish these procedures to deploy microreactors as soon as practicable.  After these procedures are finalized, the FAA must update the agency's guidance to consider the use of microreactors in airport emergency plans. Further, the FAA must update the airport emergency plan requirements to encourage certified airports to consider utilizing microreactors to provide backup power in the case of an emergency event that results in a primary power source disruption.

Advanced Nuclear Feasibility Act This bill directs the Department of Energy to establish a grant program for feasibility studies to site, construct, and operate advanced nuclear reactors (e.g., certain nuclear power plants with significant improvements, such as additional safety features and a lower cost of electricity). Institutions of higher education, private individuals, private companies, or local governments may apply for grants if they are located in a state or territory that has an appropriate plan in effect for furthering the deployment of advanced nuclear reactors. Those states and territories may also apply for grants.

National Defense Authorization Act for Fiscal Year 2024 This bill authorizes FY2024 appropriations and sets forth policies for Department of Defense (DOD) programs and activities, military construction, and the national security programs of the Department of Energy (DOE). The bill authorizes appropriations, but does not provide budget authority, which is provided by appropriations legislation.  DIVISION A--DEPARTMENT OF DEFENSE AUTHORIZATIONS TITLE I--PROCUREMENT This title authorizes appropriations for the acquisition or modification of various military items (such as aircraft, ships, tracked combat vehicles, missiles, and ammunition) and sets policy for certain procurement programs. TITLE II--RESEARCH, DEVELOPMENT, TEST, AND EVALUATION This title authorizes appropriations for research, development, test, and evaluation (RDT&E) and sets policy for certain RDT&E activities, such as microelectronics and artificial intelligence. TITLE III--OPERATION AND MAINTENANCE This title authorizes appropriations for operation and maintenance (O&M) and sets policy for certain O&M programs, such as sustainable aviation fuel and the treatment of perfluoroalkyl and polyfluoroalkyl substances (PFAS). TITLE XIV--OTHER AUTHORIZATIONS This title authorizes appropriations for specified working capital and revolving funds and for other programs, including chemical agents and munitions destruction, drug interdiction and counter-drug activities, and the defense health program. It also sets policy regarding national defense stockpile requirements. TITLE XV--SPACE ACTIVITIES, STRATEGIC PROGRAMS, AND INTELLIGENCE MATTERS This title sets policy for various matters related to space activities, nuclear forces, missile defense, and electronic warfare. TITLE XVI--CYBERSPACE-RELATED MATTERS This title sets policy on cyberspace-related matters, such as cyber incident reporting. TITLE XVII--SPACE FORCE PERSONNEL MANAGEMENT This title sets policy with regards to the management of Space Force military personnel, including (1) transitions between active, inactive, and retired status; (2) appointment and promotion of officers; (3) enlistment qualifications; and (4) separations. TITLE XXVII--BASE REALIGNMENT AND CLOSURE ACTIVITIES This title authorizes appropriations for base realignment and closure activities as authorized by the Defense Base Closure and Realignment Act of 1990. Civil Nuclear Export Act of 2023

Civil Nuclear Export Act of 2023 This bill provides the Export-Import Bank with certain authorities to finance nuclear exports. Specifically, the bill allows the Export-Import Bank to provide financing for liquid metal fast breeder nuclear reactors and nuclear fuel reprocessing facilities if they are otherwise permitted by law. Additionally, the bill expands the China and Transformational Exports Program (CTEP) by making nuclear facilities eligible for financing under the program. Currently, the bank may extend loans, guarantees, and insurance to advance the comparative leadership of the United States with respect to China in specified export areas (e.g., artificial intelligence, biotechnology, and wireless communications equipment). This bill expands those areas to include civil nuclear facilities, materials, technologies and related goods and services that support the development of an effective nuclear energy sector. The bill also revises the financial limitation on the outstanding aggregate amount of all of the bank's loans, guarantees, and insurance. In particular, the bill exempts those amounts attributed by the bank to CTEP, as long as that financing does not exceed a specified amount. The bill also increases from 2% to 4% the bank's default rate cap. Further, the bill allows the bank to exclude financing under CTEP from this default rate, subject to approval of the bank's board of directors. The bill establishes liability limits for damages that are caused by nuclear projects financed by the bank.

Spent Fuel Prioritization Act of 2023 This bill requires the Department of Energy (DOE), in determining the order for accepting high-level radioactive waste or spent nuclear fuel for disposal or storage under the Nuclear Waste Policy Act of 1982, to prioritize the acceptance of waste or fuel from certain civilian nuclear power reactors. DOE must give the highest priority to decommissioned or decommissioning reactors located in areas (1) with large populations, (2) with high earthquake hazards, and (3) where the continued storage of high-level radioactive waste or spent nuclear fuel poses a significant national security concern.

Advanced Reactor Coordination Act or the ARC Act This bill directs the President to consider the feasibility of leveraging existing activities or frameworks or, as necessary, establishing an Advanced Reactor Coordination and Resource Center to assist embarking civil nuclear nation countries in developing or expanding civil nuclear energy programs. An  embarking civil nuclear nation means a country that (1) does not have a civil nuclear energy program; (2) is in the process of developing or expanding a civil nuclear energy program; (3) is in the process of selecting, developing, constructing, or utilizing advanced light water reactors, advanced nuclear reactors, or advanced civil nuclear technologies; or (4) had an annual per capita gross domestic product of no more than $28,000 in 2020. The term excludes China, Russia, Belarus, Iran, North Korea, Cuba, Venezuela, Syria, Burma, and certain countries that pose an unusual and extraordinary threat to the United States or support acts of international terrorism. The term  civil nuclear means activities relating to nuclear plant construction or operations, nuclear fuel services, nuclear energy financing, nuclear plant regulation, nuclear medicine, nuclear safety, community engagement, infrastructure support for nuclear energy, nuclear plant decommissioning, nuclear liability, safe storage and disposal of spent nuclear fuel, environmental safeguards, nuclear nonproliferation and security, and technology related to such activities.

Avoid Our Adversaries and Buy American Nuclear Act This bill requires the Department of State to launch an international initiative to assist certain nations to develop civil nuclear energy programs.  The bill authorizes the State Department to award grants to nations for (1) activities related to the development of civil nuclear energy programs, and (2) building technical capacities related to those activities. The bill also authorizes the State Department to provide financial assistance to nations for the purpose of contracting with U.S. nuclear energy companies for advisors to assist with establishing a civil nuclear program.  The bill excludes Russia, China, Iran, North Korea, and certain other countries from receiving assistance under this initiative.

Sanction Russian Nuclear Safety Violators Act of 2023 This bill requires the President to impose sanctions on foreign persons who endanger the integrity, safety, or undermine Ukrainian operational control of the Zaporzhzhia nuclear power plant in southeastern Ukraine.  The sanctions include (1) asset blocking; (2) visas, admission, or parole into the United States; and (3) revocation of current visas. The bill limits such sanctions as they apply to international obligations, to humanitarian assistance, or to those seeking to reestablish Ukrainian operational control of the Zaporzhzhia nuclear power plant.

International Nuclear Energy Act of 2023 This bill addresses U.S. cooperation with other nations on nuclear energy-related issues. For example, the bill requires the President, in coordination with international partners, to hold a biennial conference on civil nuclear safety, security, safeguards, and sustainability; the Department of State to meet with ally or partner nations for the purpose of collaborating on research, development, licensing, and deployment of advanced nuclear reactor technologies for civil nuclear energy; the State Department to provide financial assistance to embarking civil nuclear nations for developing civil nuclear energy programs; and the establishment of a working group to develop a 10-year civil nuclear trade strategy with biennial targets for the export of civil nuclear technologies. Furthermore, the President must launch an international initiative to modernize outreach to embarking civil nuclear nations to improve the importation and exportation of civil nuclear technology and materials. This initiative may include establishing cooperative financing relationships for the export of such technology and materials. The bill also authorizes the Department of Energy to support regulatory development, design, and deployment activities related to certain small modular reactor projects.

This bill prohibits federal funds from being used to carry out the Green Power Partnership unless the Environmental Protection Agency (EPA) includes nuclear power as a green source of energy when determining whether a program participant meets the partnership's requirements concerning electricity usage. The Green Power Partnership is a voluntary program that encourages organizations to use green power in order to reduce environmental impacts associated with electricity use. In return for technical assistance and recognition, the partners commit to use green power for all, or a portion, of their annual electricity consumption.

North American Transatlantic Resource Security Partnership Act of 2023 This bill requires or authorizes actions to reduce the reliance of U.S. partners and allies on Russian energy and minerals. The bill requires the Departments of Energy (DOE) and the Interior to establish a program to reduce such reliance by specified allied and partner nations (including Japan, Korea, Ukraine, and NATO members). Under the program, the departments shall develop and provide to such nations domestic resources, materials, or equipment, along with financial and technical assistance. The departments must also establish a program to promote cooperation with Mexico and Canada on energy issues. DOE must seek to establish an energy center with these countries to develop academic cooperation on energy-related topics, such as energy innovation technology and engineering. These departments must also establish a supply chain reliability assurance program to (1) prioritize domestic activities, such as energy production and mining, that ensure secure supply chains; and (2) facilitate collaboration with Mexico, Canada, industry, and other federal agencies to develop a reliable domestic supplier base of critical energy materials and technologies (for example, those related to high-performance computing, energy storage, and nuclear energy). The bill requires the Export-Import Bank to establish a portfolio to provide financing to certain energy infrastructure and critical minerals projects. The bill also statutorily authorizes the U.S. International Development Finance Corporation to provide financing and other types of support for projects related to any type of energy (including fossil fuels, renewables, and nuclear energy). The corporation may not prohibit support for a project due to the type of energy involved.

Global Nuclear Energy Assessment and Cooperation Act This bill establishes requirements concerning international nuclear energy cooperation and safety. Specifically, the Department of Energy (DOE) must develop and carry out a program to train foreign nuclear energy experts and standardize safety practices. DOE must also study the global status of the civilian nuclear energy industry and its supply chain. In addition, the bill prohibits any person from possessing or owning enriched uranium from Russian or China unless specifically authorized by the Nuclear Regulatory Commission (NRC). NRC may not issue a license to possess or own such fuel if DOE and the Department of State determine that the possession or ownership would pose a threat to national security. NRC must establish an International Nuclear Reactor Export and Innovation Branch within its Office of International Programs to carry out and coordinate certain nuclear reactor export and innovation activities. NRC must also identify in its annual budget justification such activities.
