This bill revises requirements related to voter removal programs. Currently, each state must conduct a general program that makes a reasonable effort to remove the names of ineligible voters from the official lists of eligible voters by reason of (1) the death of the voter, or (2) a change in the residence of the voter. A state may meet this requirement by establishing a program under which change-of-address information is provided by the U.S. Postal Service (USPS). This bill removes the ability of states to rely on this change-of-address information provided by the USPS for the purpose of removing the names of ineligible voters from the official lists of eligible voters.

Uniform Postal Data Acquisition for Transparency and Early Detection within the United States Postal Service Act or the UPDATED USPS Act This bill modifies requirements relating to advance electronic information for cargo. Specifically, the bill eliminates a restriction on the use of advance electronic information for commercial enforcement, and waivers of the requirement to transmit advance electronic information for countries. U.S. Customs and Border Protection (CBP) must refuse entry for any international mail shipments for which advance electronic information is not transmitted for shipments received after December 31, 2023. By December 31, 2023, the U.S. Postal Service (USPS) must arrange for the transmission to CBP of information for all international mail shipments. The USPS, at least every 30 days, must publish the number of such shipments for which the information was not transmitted to CBP during the preceding 30-day period. The bill requires monthly reports of specified information, including the volume of international mail shipments and other cargo received by the USPS and private sector importers for which advance electronic information is submitted.

United States Postal Service Shipping Equity Act

United States Postal Service Shipping Equity Act This bill authorizes the mailing of alcoholic beverages by certain entities in accordance with the delivery requirements otherwise applicable to a privately carried shipment. The authorization applies to an entity (including a winery, brewery, beverage distilled spirits plant, or other wholesaler, distributer, importer, or retailer of alcoholic beverages) that has registered with, obtained a permit from, or obtained approval of an application from the Department of the Treasury. The bill directs the U.S. Postal Service (USPS) to prescribe regulations (1) requiring direct delivery to a duly authorized agent at a postal facility or to the addressee, who must be at least 21 years of age and present a valid, government-issued photo identification at the time of delivery; (2) prohibiting such alcoholic beverages from being for resale or any other commercial purpose; and (3) requiring such entity to certify that the mailing is not in violation of applicable laws or regulations and to provide other information as directed by the USPS. The U.S. district courts shall have jurisdiction to render judgment upon any claim brought by a state, local, or tribal government against the USPS of a violation of state, local, or tribal law regarding the sale, mailing, transportation, or importation of alcoholic beverages into any U.S. state, territory, or district. The USPS shall not be liable for interest prior to judgment or for punitive damages.

Easy Access to Mail Act This bill establishes procedures for the U.S. Postal Service (USPS) regarding the use of centralized delivery of the mail with respect to residential housing units. Specifically, the bill provides that, for any housing development with respect to which the primary mode of mail delivery is any such mode except for centralized delivery on the date of this bill's enactment, the USPS may not change such mode of delivery to centralized delivery; and prohibits the USPS from requiring centralized delivery with respect to any housing development constructed after this bill's enactment without prior approval from the local legislative body, or, in the absence of a local legislative body, the legislature of the state with jurisdiction over the affected property. If approval for centralized delivery is granted, at least 60 days before commencing such delivery the local postmaster shall provide (1) written notice to any other units of local government and any planning commissions located within the applicable county; and (2) a period of 60 days for public comment from residents, property owners, and home builders within such county regarding the use of centralized delivery at the applicable housing development. The Postal Regulatory Commission shall ensure that the USPS does not change any USPS policy in effect on the date of enactment that would result in a disproportionate negative affect on rural, lower income, elderly, disabled, or predominately minority communities.

Election Mail Act This bill addresses the delivery and processing of election mail for federal elections, including by establishing certain standards for mail-in ballots. Specifically, the bill requires the U.S. Postal Service (USPS) to ensure (to the maximum extent practicable) same-day processing of mail-in ballots, postmark each ballot, carry election mail (e.g., voter registration applications and mail-in ballots) as first-class mail that is free of postage, appoint an election mail coordinator at each area office and district office, and consult annually with Indian tribes regarding barriers to voting for eligible voters living on Indian lands. The bill prohibits the USPS, within 120 days of a federal election, from making any operational change that would restrict the prompt and reliable delivery of election mail. Each state and jurisdiction must provide with each mail-in ballot a return envelope with an intelligent mail barcode. This requirement does not apply to a state or jurisdiction that uses an alternative system that enables voters to track the ballot through the mail. The bill requires election officials to count mail-in ballots that are postmarked by election day and arrive within seven days after the election.

Agency Accountability Act of 2023

Agency Accountability Act of 2023 This bill requires any agency that receives a fee, fine, penalty, or proceeds from a settlement to deposit the amount in the general fund of the Treasury. The bill also prohibits the funds from being used unless the funding is provided in advance in an appropriations bill. The bill includes exceptions for funds to be paid to a whistle-blower, loan guarantee programs, or insurance programs. The requirements do not apply to the U.S. Postal Service or the U.S. Patent and Trademark Office (PTO). The Department of Commerce and the PTO must report annually to Congress on funds collected by the PTO from a settlement. The bill also requires offsetting receipts and collections to be treated as revenue for the purpose of carrying out the Congressional Budget Act of 1974 and other laws. (Offsetting receipts and collections are funds collected by agencies from other government accounts or from the public in businesslike or market-oriented transactions. Under current law, the collections are treated as negative budget authority and outlays rather than revenue and may be used to offset spending for budget enforcement purposes.)

STOP Act 2.0

STOP Act 2.0 This bill revises requirements related to advance electronic data (AED) on international mail shipments. (The STOP Act of 2018 requires international mail shipments coming into the United States to have AED to address the threat of synthetic opioids and other dangerous items.) Specifically, the bill establishes a new criminal penalty for knowingly misrepresenting the country of origin of an international mail shipment in order to avoid AED requirements. Additionally, five years after enactment, the bill terminates U.S. Customs and Border Protection's authority to exclude countries from AED requirements. The bill establishes additional reporting requirements related to AED, including a requirement for the Department of Homeland Security (DHS) to report the results of randomized tests of packages entering the United States. Further, the bill authorizes DHS, the Department of Justice, and the U.S. Postal Service to enter into partnerships with private parcel services or other private information technology entities to develop technology and processes for identifying the origin of fentanyl, other synthetic opioids, and other narcotics and psychoactive substances. The bill also authorizes DHS to share with and receive information from foreign governments regarding (1) shippers with a history of transporting illegal substances, and (2) best practices for detecting the substances. U.S. Customs and Border Protection must train its officers in detecting illicit fentanyl and other synthetic opioids. Finally, the bill directs the Government Accountability Office to evaluate the implementation of the STOP Act of 2018.

Fairness in Fentanyl Sentencing Act of 2023 This bill modifies the drug quantity thresholds that trigger a mandatory minimum prison term for a defendant who manufactures, distributes, imports, exports, or possesses with intent to distribute fentanyl. Specifically, the bill reduces from 400 to 20 grams the fentanyl quantity and from 100 to 5 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for high-level first-time or repeat offenders. It also reduces from 40 to 2 grams the fentanyl quantity and from 10 to 0.5 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for low-level first-time or repeat offenders. Additionally, the bill directs the U.S. Postal Service to increase the availability of chemical screening devices and dedicate the appropriate number of personnel to interdict fentanyl and other substances that are unlawfully imported into the United States.
