Summary

Keep the 5-year ILR route for people already in the UK and do not apply new settlement rules retrospectively. Future changes should apply only to new arrivals. We support waiting up to 10 years for access to public funds if the 5-year ILR pathway is protected. Don’t move the goalposts for those already here. People already lawfully living in the UK should remain eligible for Indefinite Leave to Remain (ILR) after 5 years under the rules in place when they arrived. New settlement rules should apply only to future arrivals, not retrospectively. If the Government extends access to public funds, we support waiting up to 10 years, as proposed by the Justice and Home Affairs Committee, while retaining the existing 5-year ILR route.
