Summary

We call on the UK Government to ensure that spouses who have entered or applied to come to the UK via family visas are not unfairly affected by retrospective changes to rules relating to Indefinite Leave to Remain. Families make life-changing decisions based on the immigration rules in place when they apply. We believe it is unfair for new rules to be applied retrospectively to those, including spouses, who have already entered via the legal visa route. We call on the Government to protect existing spouse visa holders and applicants from retrospective changes to ILR eligibility requirements and to recognise the emotional, financial, and mental health impact that changing rules have on families. We feel that those who have followed the legal process should be able to rely on the rules that were in place when they applied.
