HAMDT 361 (100th)

? An amendment to provide that applicable state law would govern generic drug substitution under Medicare, and to further provide that " a preprinted indication alone" would not suffice to prevent generic substitution. ? The provisions of the bill being struck require that, in order for Medicare to reimburse for a higher-price brand name drug when a generic is available, the physician must indicate in his own handwriting on the prescription form that the brand-name drug is medically necessary.
