A bill to amend title 28, United States Code, to provide that the courts of appeals and district courts of the United States may transfer cases improperly filed in those courts to the appropriate court of appeals or district court in order to cure a defect of jurisdiction or venue.

Summary

Requires, if it is in the interest of justice, a United States district court to directly transfer a case which is within the exclusive jurisdiction of the United States courts of appeals and which was erroneously filed with it to an appropriate appellate court. Requires a United States court of appeals to similarly transfer a case which is within the exclusive jurisdiction of United States district courts and which was erroneously filed with it.
