A bill to repeal the Gun Control Act of 1968, to reenact the Federal Firearms Act, to make the use of a firearm to commit certain felonies a Federal crime where that use violates State law, and for other purposes.

Summary

Repeals the Gun Control Act of 1968. Reenacts the Federal Firearms Act and a former provision of the Internal Revenue Code relating to machineguns and other firearms. Amends the Federal criminal code to establish mandatory penalties for: (1) using or carrying unlawfully a firearm to commit a felony which may be prosecuted in Federal court; or (2) using or carrying unlawfully a firearm to commit a felony as determined by State law. Sets the term of imprisonment at one to ten years for a first offender and two to 25 years for a second or subsequent offender. Disallows in the case of a second or subsequent offender a suspended or probationary sentence or concurrent sentence running with the term of imprisonment imposed for the offense itself.
