A bill to amend title 28 of the United States Code to provide for Federal payment of certain expenses of States in connection with habeas corpus proceedings in Federal courts.

Summary

Provides, in connection with habeas corpus proceedings in Federal courts, for Federal payment of expenses by States whenever the State produces any part of the record as a result of the applicant challenging the sufficiency of the evidence in the State court proceeding. Provides that whenever a proceeding instituted in a Federal court by an application for a writ of habeas corpus by a person in custody pursuant to the judgment of a State court terminates adversely to the applicant, the United States shall bear the costs of court, including all witness and marshal fees and allowances, of such proceeding to the extent such costs are not recoverable from the applicant.
