Summary
Mike Partin Law Enforcement Officers' Protection Act - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to reduce by 25 percent funds available to a State under the drug control and system improvement grant (Byrne) program unless the State has in effect a law which provides for: (1) felony penalties punishable by imprisonment for a term exceeding one year if a motorist or pedestrian who intends to elude or flee knowingly or wantonly disobeys a law enforcement officer's order to stop and the person is fleeing immediately after committing an act of domestic violence, driving under the influence of alcohol or any other substance or combination of substances, driving while his or her driver's license is suspended, or the person, by fleeing or eluding, is the cause of, or creates substantial risk of, death or serious physical injury to any person or property; and (2) criminal penalties punishable by imprisonment for a term of less than one year if a motorist or pedestrian who intends to elude or flee knowingly or wantonly disobeys a law enforcement officer's order to stop, causing or creating a substantial risk of physical injury to a person or property. Provides for redistribution of any funds to participating States that have such a law in effect. Directs the Attorney General to issue regulations to ensure compliance with this Act.
