Summary
Repeals the Gun Control Act of 1968. Reenacts the Federal Firearms Act and a former provision of the Internal Revenue Code relating to machineguns and other firearms. Amends the Federal criminal code to establish mandatory penalties for: (1) using or carrying unlawfully a firearm to commit a felony which may be prosecuted in Federal court; or (2) using or carrying unlawfully a firearm to commit a felony as determined by State law. Sets the term of imprisonment at one to ten years for a first offender and two to 25 years for a second or subsequent offender. Prohibits, in the case of a second or subsequent offender, a suspended or probationary sentence or concurrent sentence running with the term of imprisonment imposed for the offense itself.
