Summary

National Land Remote-Sensing Policy Act of 1991 - Amends the Land Remote-Sensing Commercialization Act of 1984 to establish a Landsat Joint Program Office (JPO) to manage the Landsat satellite system (in lieu of management by the Department of Commerce). Requires the major funding and management responsibilities for the JPO to be shared equally between the National Aeronautics and Space Administration (NASA) and the Department of Defense, with responsibilities for other agencies and departments as designated by the President. Requires the JPO to seek public comment at least once annually and make biennial reports to the Congress and the President. Establishes a 120-day expedited process for the procurement of a successor to Landsat 6 (Landsat 7), and the right to market and distribute successor data. Sets forth an alternative competitive process, if necessary. Requires the re-negotiation of the contract for Landsat 6 for certain modifications with respect to pricing, distribution, acquisition, and access of Landsat 1 through 6 unenhanced data. Requires a report to the Congress if agreement is not reached within 120 days of enactment of this Act. Restricts the transfer of responsibilities of the Secretary of Commerce to the JPO until the launch of Landsat 6 satellite or as otherwise agreed. Repeals provisions concerning commercialization of the Landsat system. Revises provisions concerning the licensing of private remote-sensing space systems. Repeals the specific authority of agencies other than NASA to conduct research and development on space remote-sensing. Requires all unenhanced data gathered by the Federal Government to be made available to nonprofit entities at the marginal cost of acquisition, reproduction, and transmission, if the Federal agency that gathers the data determines that it will not be used for any commercial purpose. Directs the President to establish a five-year technology demonstration program to promote the development and demonstration of advanced land remote-sensing component, sensors, and system designs. Allows such program to be carried out in part with private sector funding. Requires the JPO to have a coordinating role in the program. Requires a report to the Congress on program progress. Requires an assessment of options for a successor land remote-sensing system to Landsat 7 with respect to: (1) private sector funding and management; (2) an international consortium for funding and management; (3) Federal funding and management; and (4) a cooperative effort between the Federal Government and the private sector. Expresses a preference for a private sector system. Revises provisions concerning the nondiscriminatory availability of unenhanced data to provide that such data shall be made available to all users without preference, bias, or any other special arrangement regarding delivery, format, pricing, or technical considerations which would favor one customer or class of customers over another. Provides an exception for nonprofit entities. Requires the Secretary of Commerce to develop enforcement procedures to prevent nonprofit entities from using data for commercial purposes.
