Summary

Indian Tribal Justice Act - Establishes: (1) a Tribal Judicial Conference to advise the Director of Tribal Court Administration (Director) in the development of the Survey on Tribal Judicial Systems required by this Act and to carry on a continuous study and review of the operation of tribal judicial systems; (2) the Tribal Judicial Conference Executive Council to promote cooperation and coordination of resources between the Federal Judicial Center, the National Center for State Courts, the Administrative Office of the U.S. Courts, and the Office of Tribal Court Administration for the enhancement of tribal judicial systems; and (3) an Office of Tribal Court Administration (Office) to further the development and enhancement of tribal judicial systems. Requires the Office to provide technical assistance and training, either through direct services or by contract with independent entities, to Indian tribes and tribal judicial systems. Requires the Director to: (1) establish an information clearinghouse (which shall include an electronic database) on tribal judicial systems; and (2) survey conditions of tribal judicial systems to determine the resources needed by Indian tribes to provide for expeditious and effective administration of justice; and (3) annually update the information and findings contained in such survey. Authorizes the Director (to the extent provided in advance in appropriation Acts) to enter into contracts, grants, or agreements with Indian tribes, tribal organizations, or inter-tribal consortia pursuant to the Indian Self-Determination Act for the development, enhancement, or continuing operation of tribal judicial systems on Indian reservations. Sets forth uses for such financial assistance. Requires the Director, with the participation of Indian tribes, to promulgate by regulations a formula which establishes base support funding for tribal judicial systems. Requires the Executive Council to develop appropriate caseload standards and staffing requirements for tribal judicial systems. Authorizes appropriations.
