Summary
Transgenic Animal Patent Reform Act - Amends Federal patent law to declare that it shall not be an act of infringement to make or use a patented invention consisting of a genetically altered animal solely for research or experimentation without any commercial intent or purpose. Declares that use of such invention solely to provide information under a Federal law requiring pre-market approval of such invention shall not be deemed a making or using with commercial intent or purpose. States that it shall not be an act of infringement for a person whose occupation is farming to reproduce through breeding, use, or sell a patented transgenic farm animal if the person: (1) earns less than $500,000 in annual gross receipts; (2) conducts farming activities as a single-family enterprise; and (3) is not engaged in growing animals for sale for reproductive purposes. Amends Federal patent application law to authorize the Commissioner of Patents and Trademarks to accept a deposit of biological material to satisfy patent application requirements. Declares that human beings are not patentable subject matter.
