Summary

Directs the Secretary of the Army to delegate authority to States with respect to planning and location of structures, and excavation, dredging or filling of the waters of the United States. Limits such delegation to only those bodies of water where there is no substantial waterborne interstate transportation of commercial goods. Requires that States, as a condition of such delegation: (1) enact legislation to adequately protect Federal interests in such waters, and (2) establish a permit program at least as effective as Federal procedures.
