To amend the Federal Food, Drug, and Cosmetic Act to provide the Food and Drug Administration with authority to recall food when there is a reasonable basis for believing that the food is adulterated and presents a risk to human health, and for other purposes.

Summary

Amends the Federal Food, Drug, and Cosmetic Act to requires the Secretary of Health and Human Services to order the cessation of the distribution of food if there is a reasonable basis for believing the food is adulterated and a risk to human health. Requires an informal hearing to be held with respect to any such action. Directs the Secretary to vacate an order upon finding that insufficient evidence exists to support it, or to order a recall of food upon finding that such action is necessary. Prohibits noncompliance with such an order. Requires the Secretary to specify a timetable for any recall. Applies special rules for the recall of infant formula.
