Summary

Drug Traffic Deterrent Act - Provides that any person at least eighteen years of age who is not himself an addict, and who knowingly or intentionally distributes or possesses with intent to distribute specified narcotic drugs to any person shall be sentenced to a term of imprisonment of not less than ten years or more than twenty years. States that if any person commits such a violation after one or more prior convictions for such an offense punishable under this section, such person shall be sentenced to the term of life imprisonment. Stipulates that in the case of any sentence imposed under this section, imposition or execution of such sentence shall not be suspended, probation shall not be granted, and no parole shall be granted until three-fourths of such sentence shall have been served or twenty years of a life sentence. Makes it unlawful for two or more persons to conspire to obstruct the enforcement of the criminal laws of a State or political subdivision thereof with the intent to facilitate the illegal distribution of specified narcotic drugs. Provides that whoever violates this section shall be punished by imprisonment for not less than five and not more than ten years. Authorizes judicial officers to order the pretrial detention of a person charged with unlawful distribution or possession with intent to distribute specified narcotic drugs if such person has been previously convicted for such an offense. Sets forth procedures applicable to pretrial detention hearings held pursuant to this Act.
