A bill to amend title XVI of the Social Security Act to provide that attorneys' fees allowed in administrative or judicial proceedings under such title, in cases where the claimants are successful, shall be paid by the Secretary of Health, Education, and Welfare.

Summary

Amends title XVI (Supplemental Security Income) of the Social Security Act to require the Secretary of Health, Education, and Welfare to set and pay a reasonable attorneys' fee in any claim before the Secretary for benefits under that title where the claimant is successfully represented by an attorney, and entitled to past-due benefits. Provides that whenever a court renders a judgment favorable to a claimant under title XVI the court may determine and allow a reasonable attorneys' fee where the claimant was represented by an attorney. Sets forth criminal penalties for any attorney charging any fee in excess of that allowed by the court.
