Summary
Gun Sale Anti-Fraud and Privacy Protection Act - Amends Brady Handgun Violence Prevention Act provisions regarding the National Instant Background Check System (NICS) to require the destruction of all records relating to the receipt of a firearm that would not violate State or Federal prohibitions, other than the identifying number and the date a call was assigned (current law), consistent with the Attorney General's responsibility under the Act to ensure privacy of the system and to prevent system fraud and abuse, but in no event fewer than 90 days after the licensee first contacts the system with respect to the transfer. Directs: (1) the Department of Justice and its divisions, including the Federal Bureau of Investigation, during the period that records are maintained, to make those records available to the Department of the Treasury and its divisions, including the Bureau of Alcohol, Tobacco, and Firearms, for the purpose of conducting system audits to detect fraud and misuse, and to protect the privacy and security, of the system; and (2) the Department of the Treasury to maintain and destroy those records in accordance with all statutory requirements imposed on the Department of Justice.
