Summary

Amends the Native American Graves Protection and Repatriation Act to require written consent, if Native American remains are excavated or removed for purposes of study, from: (1) lineal descendants (if known); or (2) the appropriate Indian tribe or Native Hawaiian organization. Sets forth the following requirements for inadvertent discoveries: (1) the appropriate Indian tribe or native Hawaiian organization be notified, with respect to tribal lands; and (2) any person or entity that disposes of or controls any such cultural item adhere to the applicable requirements for intentional excavation and removal.
