Summary

National Medical Injury Compensation Insurance Act - Adds to the Public Health Service Act a Title XVIII: ' National Medical Injury Compensation Insurance. Directs the Secretary of Health, Education, and Welfare to establish and implement a program of professional liability insurance to health care providers who choose to participate. Requires the Secretary to enter into contracts with health professionals and health care institutions to provide insurance coverage including: (1) insurance for health care providers against loss resulting from tort liability; and (2) no-fault benefits for patients or survivors of patients injured by insured health care providers. Establishes within the Treasury a Medical Injury Compensation Insurance Fund supported by premiums paid by the insureds, and appropriations from general funds. Sets forth conditions of eligibility for such insurance, and procedures for the payment of benefits.
