Summary
Independent Special Prosecutor Act - Authorizes and directs the President to appoint a Special Prosecutor and Deputy Special Prosecutor, by and with the advice and consent of the Senate, within 30 days after the date of enactment of this Act. Authorizes and directs the Special Prosecutor to prosecute in the name of the United States any offense arising out of any provision of the National Security Act or the Central Intelligence Agency Act and any operation or activity carried out through the Central Intelligence Agency or through any agreement with the Central Intelligence Agency in violation of the rights of any person. Spells out specific powers and authority of the Special Prosecutor, including the authority to conduct proceedings before grand juries and to receive appropriate national security clearance and review all evidence sought to be withheld on grounds of national security. Grants the Special Prosecutor the power to appoint, fix the compensation, and assign the duties of such employees as he deems necessary. Authorizes the Special Prosecutor to request assistance from any department or agency of the United States or District of Columbia government. Directs the Special Prosecutor to carry out his duties under this Act within one year, except as necessary to complete trial or appellate action on indictments then pending. Provides that the Special Prosecutor and the Deputy Special Prosecutor may be removed by the President for neglect of duty, malfeasance in office, or violation of this Act, but for no other cause.
