Summary

Supplemental Appropriations Act, 1983 - Title I: Chapter I - Makes supplemental appropriations for FY 1983 to the Department of Agriculture for: (1) the Agricultural Research Service's foreign currency program; (2) the Animal and Plant Health Inspection Services; (3) the Agricultural Stabilization and Conservation Service for the payment-in- kind program; (4) the commodity supplemental food program (including a transfer of funds); (5) the food stamp program; and (6) food donations programs. Makes supplemental appropriations for FY 1983 to the Department of Health and Human Services for the Food and Drug Administration. Chapter II - Makes supplemental appropriations for FY 1983 to the Department of Commerce for: (1) the special foreign currency program; (2) the Economic Development Administration; (3) the International Trade Administration; and (4) the National Oceanic and Atmospheric Administration. Makes supplemental appropriations for FY 1983 to the Office of the United States Trade Representative for salaries and expenses and to the Department of State for the payment to the foreign service retirement and disability fund. Makes supplemental appropriations for FY 1983 to the Asia Foundation. Makes supplemental appropriations for FY 1983 to the: (1) Board for International Broadcasting for grants and expenses; and (2) the United States Information Agency for salaries and expenses and acquisition and construction of radio facilities. Makes supplemental appropriations for FY 1983 to the Judiciary for: (1) salaries of judges; (2) defender services; and (3) bankruptcy courts, salaries and expenses. Chapter III - Makes supplemental appropriations for FY 1983 to the Department of Defense-Military for: (1) operation and maintenance, Army, Navy, and Air Force; (2) missile procurement, Army; and (3) other procurement, Army and Air Force. Amends the Department of Defense Appropriation Act, 1983 to exempt specialty metals and chemical warfare protective clothing from the "Buy America" restrictions pursuant to such Act. Declares that obligations incurred or to be incurred in connection with the T-AKX and T-5 programs shall, as long as the Government remains liable for such termination, be considered as obligations on the accounts of the Navy. Prohibits the use of funds made available to the Department of Defense during the current fiscal year to acquire a replacement aircraft for the CT-39 aircraft from other than a United States firm. Requires such replacement aircraft to be assembled in the United States and to use an airframe manufactured in the United States. Chapter IV - Makes supplemental appropriations for FY 1983 to the Department of Defense-Civil for the Corps of Engineers - Civil for general investigations and flood control and coastal emergencies. Modifies the project for flood protection on the Lower San Joaquin River, California, to authorize the Secretary of the Army, acting through the Chief of Engineers, to perform clearing and snagging on the San Joaquin River, California. Requires that funds for the Wister Lake project, Oklahoma, authorized pursuant to the Flood Control Act of 1938, be used to reduce sedimentation impacts. Directs the Secretary of the Army, acting through the Chief of Engineers, to include in the survey report on Threemile Creek, Alabama, the costs and benefits of local improvements initiated subsequent to January 1, 1982, by the city of Mobile, Alabama, for flood damage reduction. Authorizes the Secretary of the Army, acting through the Chief of Engineers, to prepare comprehensive studies and recommendations for the development and efficient utilization of the water and related resources of south-central and southeast Oklahoma and of the Red River and its tributaries in Arkansas, Texas, Louisiana, and Oklahoma. Permits funds for the Beverly Shores, Indiana, project to be used to operate and maintain the emergency shore protection measures. Directs the Corps of Engineers to operate and maintain the Kawkawlin River, MI, project, at full Federal expense. Includes the Control Structure and Lock in the Chicago River within the provisions of P.L. 97-88 pertaining to maintenance and operation of the Chicago Sanitary and Ship Canal of the Illinois Waterway. Makes funds available for channel clearing of Bayou Rigolette in the project Aloha-Rigolette Area, Louisiana. Modifies the Wallisville Reservoir, Texas, project with respect to its physical elements and planned operation. Authorizes the Secretary of the Army to widen the navigation opening of Franklin Ferry Bridge, Alabama. Authorizes the Secretary of the Army, acting through the Chief of Engineers, to reimburse the Ventura Port District, California, for work performed by the Port just prior to February 25, 1983, on the Ventura Marina. Amends the Water Resources Development Act to direct the Secretary of the Army, acting through the Chief of Engineers, to construct an approach roadway to a specified bridge in Clarkston, Washington. Authorizes the Secretary of the Army, acting through the Chief of Engineers, to plan, design, and construct a water intake structure for the Sardis Lake project. Modifies the project for navigation at Moriches and Shinnecock Inlets, New York, to the extent necessary to require the Secretary of the Army, acting through the Chief of Engineers, to provide for the construction of the navigation feature independent of other features. Permits the uniform allowance for uniformed civilian employees of the United States Army Corps of Engineers to be up to $400 annually. Permits the Chief of Engineers to accept the services of volunteers and provide for their incidental expenses to carry out any activity of the Army Corps of Engineers except policy making, law, or regulatory enforcement. Obligates appropriations for the Yatesville Lake construction project to construct the Yatesville Lake project. Provides funds for increased pay costs for Federal employees of the Corps of Engineers. Authorizes the Secretary of the Interior to engage in a feasibility study for the Prairie Bend unit, Pick-Sloan Missouri River Basin program, Nebraska, for irrigation, stabilization of ground-water levels, enhancement of water quality, small community and rural domestic water supplies, and other appropriate purposes. Declares that the portion of the costs of the Upper Colorado River storage project allocated to municipal and industrial use which exceeds a specified amount shall not be reimbursable. Authorizes the Secretary of the Interior to provide adequate access to the McGee Creek recreation areas, Wildlife Management Area, and Natural Scenic Recreation Area, Oklahoma. Requires the Bureau of Reclamation to provide silt-laden water from the North Platte project, Nebraska and Wyoming. Permits the deferral of certain 1983 water service and repayment contract obligations for capital, operation, and maintenance costs associated with federally constructed or assisted projects under the "Special Program for Corn, Grain, Sorghum, Upland Cotton, and Rice." Makes supplemental appropriations for FY 1983 to the Department of Energy for: (1) energy supply, research and development; (2) atomic energy defense activities; (3) the Western Area Power Administration; and (4) the Federal Energy Regulatory Commission. Chapter V - Makes supplemental appropriations for FY 1983 for: (1) multilateral economic assistance; (2) bilateral economic assistance; (3) migration and refugee assistance; (4) the military assistance program; (5) foreign military sales credit; and (6) international military education and training. Prohibits the use of the funds in this chapter to provide assistance to Guatemala. Chapter VI - Makes supplemental appropriations for FY 1983 to the Department of Housing and Urban Development for: (1) annual contributions for assisted housing; (2) rent supplement payments (including transfer of funds and rescission); (3) the housing for the elderly or handicapped fund; (4) payments for operation of low-income housing projects (deferral); and (5) urban renewal programs. Makes supplemental appropriations for FY 1983 to: (1) the Environmental Protection Agency for salaries and expenses and the Hazardous Substance Response Trust Fund; and (2) the Veterans Administration for medical care and construction, major projects. Chapter VII - Makes supplemental appropriations for FY 1983 to the Department of the Interior for: (1) the Bureau of Land Management for management of lands and resources; (2) the United States Fish and Wildlife Service for construction and anadromous fish; (3) the National Park Service for operation of the national park system, construction (including a deferral) and land acquisition and State assistance; (4) the Bureau of Indian Affairs for the operation of Indian programs, construction, road construction, the Papago Trust Fund, and the cooperative fund (Papago); (5) the administration of territories; and (6) the Office of the Solicitor. Rescinds the contract authority of the Land and Water Conservation Fund provided for FY 1983. Transfers specified funds made available to the Geological Survey for exploration of the national petroleum reserve in Alaska to surveys, investigations, and research. Makes supplemental appropriations for FY 1983 to: (1) the Department of Agriculture for the Forest Service; (2) the Department of Energy for the SPR Petroleum Account; (3) the Department of Health and Human Services for Indian health services; (4) the Department of Education for Indian education; and (5) the Smithsonian Institution for salaries and expenses. Prohibits the use of funds during the rest of FY 1983 for: (1) the sale or lease of coal on public lands except for emergency leasing and lease modifications; (2) studying, procurement, leasing, bidding, exploration, or development of the areas identified in the proposed sale notice for the Outer Continental Shelf Oil and Gas Lease Sale numbered 78; or (3) taking actions related to the termination of programs or the closure of facilities funded by the Interior and Related Agencies Appropriation Act, 1983, until enactment of the Interior and Related Agencies Appropriation Act, 1984, or through approved reprogramming procedures. Sets forth specified steps to be taken in order to further the purposes of the Delaware Water Gap National Recreation Area and to provide for public safety in such area. Closes Highway 209 to commercial vehicular traffic except under specified circumstances. Chapter VIII - Makes supplemental appropriations for FY 1983 to the Department of Labor for advances to the Unemployment Trust Fund and the Black Lung Disability Trust Fund. Makes supplemental appropriations for FY 1983 to the Department of Education for higher and continuing education. Chapter IX - Makes supplemental appropriations for FY 1983 to the legislative branch for: (1) payment to specified widows of late Representatives from New York and California; (2) allowances and expenses; (3) the Office of the Attending Physician; (4) official mail costs; (5) salaries and expenses of the Office of Technology Assessment; (6) House office buildings; and (7) the west central front of the Capitol. Limits the annual rate of compensation for any individual employed under the provisions of H. Res. 690, Eighty-ninth Congress. Provides for an allowance of $600 per month for a Senior Medical Officer while on duty in the Attending Physician's Office. Prohibits the use of funds for FY 1983 for any Office of Technology Assessment activity not initiated and approved in accordance with P.L. 92-484, except for the assessment required by P.L. 96-151. Limits the honoraria a Member may receive in any calendar year to no more than 30 percent of his or her aggregate annual salary. Requires the Commission on Executive, Legislative, and Judicial Salaries to include in its first report after enactment of this Act a recommendation for an appropriate salary for Members, assuming a prohibition on the receipt of honoraria. Chapter X - Makes supplemental appropriations for FY 1983 to the Department of Transportation for: (1) the Coast Guard for the National Recreational Boating Safety and Facilities Improvement Fund (liquidation of contract authorization); (2) the Federal Aviation Administration for operations and the aircraft purchase loan guarantee program; (3) the Federal Highway Administration for Federal-aid highways; (4) the National Highway Traffic Safety Administration for State and community highway safety and highway safety education and information; (5) the Federal Railroad Administration for settlements of railroad litigation and railroad rehabilitation and improvement financing funds; (6) the Urban Mass Transportation Administration for urban discretionary grants and the mass transportation capital fund. Prohibits the use of funds for promulgation, administration, or enforcement of any regulation which has the effect of limiting the "Buy American" provisions of the Surface Transportation Assistance Act of 1982. Makes supplemental appropriations for FY 1983 to the Panama Canal Commission for operating expenses. Chapter XI - Makes supplemental appropriations for FY 1983 to the: (1) Department of the Treasury for the U.S. Customs Service; (2) Executive Office of the President for the official residence of the Vice President; and (3) Office of Management and Budget for salaries and expenses. Makes supplemental appropriations for FY 1983 to the General Services Administration for: (1) the Federal Buildings Fund; (2) payment to Civil Service Retirement and Disability Fund; and (3) the Merit Systems Protection Board. Prohibits the use of any of the funds appropriated under this Act to implement, administer, or enforce the proposed Office of Personnel Management regulations cconcerning pay-for-performance, reductions-in-force, scope of collective bargaining, and rules governing overtime pay which were published in the Federal Register on March 30, 1983, unless and until the Comptroller General completes a review of such regulations. Prohibits the use of any funds appropriated by this Act by the Internal Revenue Service to: (1) enforce any ruling which would subject to a tax the value of campus lodging furnished by an educational institution to an employee; and (2) conduct any other activity with respect to the assessment or collection of any such tax on such value. Title II: Increased Pay Costs for the Fiscal Year 1983 - Makes supplemental appropriations for FY 1983 for increased pay costs to the legislative branch for the: (1) House of Representatives; (2) joint items; (3) Congressional Budget Office; (4) Architect of the Capitol; (5) Library of Congress; (6) General Accounting Office; (7) Copyright Royalty Tribunal; and (8) Office of Technology Assessment. Makes supplemental appropriations for FY 1983 for increased pay costs to the Judiciary for the: (1) United States Court of Appeals for the Federal Circuit; (2) United States Court of International Trade; (3) Courts of Appeals, District Courts, and other judicial services (including transfer of funds); (4) Administrative Office of the United States Courts; and (5) Federal Judicial Center. Makes supplemental appropriations for FY 1983 for increased pay costs to the Executive Office of the President for the: (1) White House Office; (2) Executive Residence at the White House; (3) special assistance to the President; (4) Council of Economic Advisers; (5) Office of Policy Development; (6) National Security Council; (7) Office of Administration; (8) Office of Management and Budget; (9) Office of Federal Procurement Policy; (10) Office of Science and Technology Policy; and (11) Office of the United States Trade Representative. Makes supplemental appropriations for FY 1983 to the Agency for International Development for operating expenses. Makes supplemental appropriations for FY 1983 (including transfers of funds) to the Department of Agriculture for the: (1) Federal Crop Insurance Corporation; (2) Rural Electrification Administration; (3) Soil Conservation Service; (4) Federal Grain Inspection Service; (5) Agricultural Marketing Service; (6) Food Safety and Inspection Service; (7) Food and Nutrition Service; (8) Agricultural Stabilization and Conservation Service; and (9) Forest Service. Makes supplemental appropriations for FY 1983 to the Department of Commerce for: (1) general administration; (2) the Bureau of the Census; (3) economic and statistical analysis; (4) the International Trade Administration; (5) the Minority Business Development Agency; (6) the National Oceanic and Atmospheric Administration (including transfer of funds); (7) the Patent and Trademark Office; and (8) the National Bureau of Standards. Makes supplemental appropriations for FY 1983 to the Department of Defense-Civil for the Department of the Army for: (1) the Corps of Engineers - Civil; and (2) the Soldiers' and Airmen's Home. Makes supplemental appropriations for FY 1983 to the Department of Energy for: (1) the Energy Information Administration; and (2) economic regulation. Transfers specified funds within the Department of Health and Human Services to the: (1) Food and Drug Administration; (2) Health Resources and Services Administration; (3) Centers for Disease Control; (4) National Institutes of Health; (5) Alcohol, Drug Abuse, and Mental Health Administration; (6) Assistant Secretary for Health; (7) Health Care Financing Administration; and (8) Social Security Administration. Transfers various funds of the Federal Housing Administration to the Department of Housing and Urban Development for salaries and expenses. Makes supplemental appropriations for FY 1983 to the Department of the Interior for the: (1) Bureau of Land Management; (2) Bureau of Reclamation; (3) United States Fish and Wildlife Service; (4) National Park Service; (5) Geological Survey; (6) Minerals Management Service; (7) Office of Surface Mining Reclamation and Enforcement; (8) Bureau of Mines; (9) Bureau of Indian Affairs; (10) Office of Territorial and International Affairs; (11) Office of the Solicitor; (12) Office of the Secretary; and (13) Office of the Inspector General. Makes supplemental appropriations for FY 1983 to the Department of Justice for: (1) general administration; (2) the United States Parole Commission; (3) various legal activities; (4) the Federal Bureau of Investigation; (5) the Drug Enforcement Administration; (6) the Immigration and Naturalization Service; (7) the Federal Prison System; and (8) the Office of Justice Assistance, Research, and Statistics (transfer of funds). Makes supplemental appropriations for FY 1983 to the Department of Labor for international commissions. Transfers specified funds within the Department of Labor to the: (1) Employment and Training Administration; (2) Employment Standards Administration; (3) Occupational Safety and Health Administration; (4) Bureau of Labor Statistics; and (5) departmental management. Makes supplemental appropriations for FY 1983 to the Department of State for: (1) administration of foreign affairs (transfer of funds); and (2) international commissions. Makes supplemental appropriations for FY 1983 to the Department of Transportation for the Saint Lawrence Seaway Development Corporation. Transfers specified funds appropriated to the Department of Transportation to: (1) the Office of the Secretary; (2) the Coast Guard; (3) the Federal Aviation Administration; (4) the Federal Highway Administration; (5) the National Highway Traffic Safety Administration; (6) the Federal Railroad Administration; (7) the Urban Mass Transportation Administration; and (8) the Office of the Inspector General. Makes supplemental appropriations for FY 1983 to the Department of the Treasury for: (1) the United States Customs Service; (2) the Internal Revenue Service; and (3) the United States Secret Service. Transfers specified funds appropriated to the Department of the Treasury to: (1) the Office of the Secretary; (2) the Federal Law Enforcement Training Center; and (3) the Bureau of Alcohol, Tobacco and Firearms. Makes supplemental appropriations for FY 1983 to the National Aeronautics and Space Administration for research and program management. Makes supplemental appropriations for FY 1983 to the Veterans Administration for specified programs. Makes supplemental appropriations for FY 1983 to the following independent agencies: (1) Administrative Conference of the United States; (2) Advisory Council on Historic Preservation; (3) Arms Control and Disarmament Agency; (4) Civil Aeronautics Board; (5) Commission of Fine Arts; (6) Commission on Civil Rights; (7) Committee for Purchase from the Blind and Other Severely Handicapped; (8) Consumer Product Safety Commission; (9) Equal Employment Opportunity Commission; (10) Farm Credit Administration; (11) Federal Communications Commission; (12) Federal Election Commission; (13) Federal Emergency Management Agency; (14) Federal Home Loan Bank Board; (15) Federal Savings and Loan Insurance Corporation; (16) Federal Labor Relations Authority; (17) Federal Maritime Commission; (18) Federal Mediation and Conciliation Service; (19) Federal Trade Commission; and (20) General Services Administration, Federal Buildings Fund. Title III: Requires expedited payment for the damages incurred in the earthquake at Coalinga, California, and surrounding areas. Provides for such emergency assistance in amounts necessary for individual and public relief and restoration. Title IV: General Provisions - Prohibits any part of any appropriation contained in this Act from remaining available for obligation beyond the current fiscal year unless expressly so provided. Increases, generally, the ceilings on amounts which may be expended for personal services to the extent necessary to meet increased pay costs authorized by or pursuant to law.
