Summary

Emergency Unemployment Compensation Extension Act - Title I: Amendments to the Emergency Unemployment Compensation Program - Amends the Emergency Unemployment Compensation Act of 1974 to extend the emergency benefits program thereunder to allow the payment of compensation for weeks of unemployment ending after March 31, 1977, and before March 31, 1978. Directs a determination of whether an emergency benefit period exists for each area of a State rather than only on a Statewide basis. Revises the method of determining emergency on and off indicators by altering the reference periods for which the unemployment rate must exceed or be less than five percent. Eliminates use of the State extended unemployment compensation account established in the Unemployment Trust Fund by certain provisions of the Social Security Act in financing payments to the States which are attributable to compensation paid to individuals for weeks of unemployment ending after March 31, 1977. Declares ineligible for emergency compensation for specified periods any individual who fails to actively engage in seeking work, accept an offer of suitable work, or apply for any suitable work to which he was referred by the appropriate State agency. Makes specified exceptions to such rule. Declares ineligible for further emergency benefits and subject to prosecution any individual who knowingly made a false statement of, or failed to disclose, a material fact which misrepresentation resulted in overpayment of emergency benefits. Authorizes a State to require repayment of excess emergency benefits to the appropriate State agency in the case of individuals who received benefits to which they were not entitled. Permits a State to waive such repayment if it determines that the excess payment was made without fault of the recipient and such repayment would be inequitable and contrary to good conscience. Sets forth guidelines relative to repayment of excess benefits. Directs the Secretary of Labor to arrange for modification of State emergency compensation agreements to reflect the revisions in the emergency unemployment compensation program made by this Act. Title II: Repayment of State Loans - Amends the Internal Revenue Code to extend the date after which the limit total credits allowable to a taxpayer with respect to the Federal unemployment tax are to be reduced an additional five percent in States having a balance of certain advances in its unemployment account. Title III: Technical Amendments to Unemployment Compensation Amendments of 1976 - Amends the requirement of the Unemployment Compensation Amendments of 1976 that State law conform to certain of its provisions relative to employees of educational and nonprofit institutions, pregnant women, and use of the reimbursement method by local governments by January, 1978, to grant a one year extension to those State whose legislatures do not meet in a regular session which closes during calendar year 1977. Amends the Internal Revenue Code to permit payment of unemployment compensation to aliens who, although not lawfully admitted for permanent residence or permanently residing in the United States under color of law, are lawfully present for the purposes of performing the services with respect to which compensation is requested. Extends the deadlines for the completion and transmittal of the interim and fiscal reports of the National Commission of Unemployment Compensation.
