Summary
Amends the Fishermen's Protective Act of 1967 to require that, when a fee regarded by the United States as being inconsistent with international law must be paid for a U.S. vessel to transit the waters of a foreign nation on a voyage between points in the United States (including a point in the exclusive economic zone or an area whose jurisdiction is in dispute), the owners of the vessel shall be reimbursed by the Secretary of State. Requires the Secretary to immediately notify such nation of the imposition of such fee and take appropriate action against such nation to be reimbursed for that amount. Repeals a provision requiring that fees charged to U.S. commercial fishermen to cover reimbursement costs for seized U.S. commercial fishing vessels in foreign ports be based on at least one-third of the Federal contribution for such costs. Allows such fees to be collected regardless of whether needed to carry out specified purposes of the Act. Extends such reimbursement provisions through October 1, 1998. Directs: (1) the Secretary of State to publish at least annually a list of those nations that impose fees for transit passage through their waters on commercial fishing vessels registered under U.S. law; and (2) the Secretary of the Treasury to withhold the clearance required for entry into the navigable waters of the United States west of 122 degrees west longitude from commercial fishing vessels registered under the laws of a nation on that list, with exceptions. Specifies that the owner or master of a vessel which enters the navigable waters of the United States in violation of such provision shall be in violation of the Magnuson Fishery Conservation and Management Act.
