Summary
Eelnõuga võetakse Eesti õigusesse üle ELi direktiiv, millega kehtestatakse Euroopa elektroonilise side seadustik (sidedirektiiv), mille ülevõtmise tähtaeg on 21. detsember 2020. Seletuskirjas märgitakse, et võrreldes 2002. aastaga, mil liberaliseeriti telekommunikatsiooni turg ja võeti vastu uus õigusraamistik, on elektroonilise side turg kiiresti edasi arenenud ja elektroonilise side sektor on muutunud majanduselu tähtsamaks osaks. Sidesektor on digitaalmajanduse võimaldaja. Sellega koos on muutunud ka elektroonilise side teenuse tarbijate käitumisharjumused, üha enam kasutatakse traditsiooniliste sideteenuste (telefoni- ja mobiiltelefoniteenus) asemel andmesidel põhinevadi uusi teenuseid nn OTT-teenuseid (Over The Top teenus), mis pakuvad traditsioonilistele sideteenustele sarnaseid teenuseid. OTT-teenused on näiteks Skype, WhatsApp, Viber jt. Eelnõuga suurendatakse tarbijaõigusi, seda eelkõige sideteenuse lepingu lepingueelse teabe ja lepingu lühikokkuvõtte esitamise näol. Lepingueelse teabega antakse tarbijale võimalikult üksikasjalik ülevaade pakutavast sideteenusest, mis peaks ära hoidma arusaamatusi lepingus sätestatud sideteenuse ja reaalsuse vahel.
