Summary
Eelnõu eesmärk on anda isikutele uus võimalus teistmisavalduse esitamiseks. Kuni 1. jaanuarini 2006. kehtinud tsiviilkohtumenetluse seadustiku alusel keeldus Riigikohus teistmisavaldusele menetlusluba andmast seaduses vastava aluse puudumise tõttu, samas kui 1. jaanuaril 2006 jõustunud tsiviilkohtumenetluse seadustikus on seaduslik alus teistmisavalduse esitamiseks ette nähtud. Isikute erinev kohtlemine kuupäevast sõltuvalt ei ole põhjendatud.
