Summary
Eelnõuga esitatakse uus rahvatervishoiu seaduse terviktekst, mis asendab seni kehtinud rahvatervise seaduse teksti. Eelnõu näeb ette tervikliku rahvatervishoiu meetmete süsteemi. Ajakohastatakse ja täiendatakse ministeeriumide, nende seas Sotsiaalministeeriumi valitsemisala ülesandeid rahvatervishoiu korraldamisel. Kohalike omavalitsuste ülesanded rahvatervishoiu meetmete elluviimisel sätestatakse senisest selgemalt. Eelnõu tugevdab eri osapoolte rolli hinnata oma tegevuste ja otsuste mõju rahvastiku tervisele. Eelnõu ajakohastab ka koolieelsetele lasteasutustele, koolidele ja sotsiaalteenuste osutajatele kehtivaid tervisekaitse-, sealhulgas toitlustamise nõudeid. Muu hulgas suurendatakse koolidirektori rolli tervislikku toitumist soodustava keskkonna loomisel ning sätestatakse tema ülesandena kehtestada nõuded ja piirangud haridusasutuses müügiks pakutavale toidule. Eelnõu muudab ka sotsiaalhoolekande seadust, et oleks üheselt arusaadav, millistele sotsiaalteenustele rahvatervishoiu seaduse alusel kehtestatud tervisekaitsenõuded kehtivad. Eelnõuga keelatakse alla 18-aastastele solaariumi- ja tätoveerimisteenuse osutamine ning ajakohastatakse teistelegi ilu- ja isikuteenustele kehtivaid nõudeid. Seletuskirjas põhjendatakse, et solaarium kuulub WHO hinnangul esimese grupi kantserogeenide hulka, mis tähendab, et selle seos vähki haigestumisega on teaduslikult tõestatud. Ka tätoveerimisega on seotud mitmed terviseohud, mis tulenevad selle käigus kasutatavatest värvainetest. Eelnõu muudab ka reklaamiseadust ja tarbijakaitseseadust, et laiendada Terviseameti järelevalvepädevust ning anda ametile õigus ja kohustus teha inimeste tervise kaitseks järelevalvet toote või teenuse kauplemisvõtte, sealhulgas reklaami õiguspärasuse üle. Eelnõu ajakohastab veel maksimaalseid trahvi- ja sunnirahamäärasid, et need oleksid piisavalt mõjusad.
