Summary
Eelnõuga ühtlustatakse VõrdKS-i kohaldamisala selliselt, et usutunnistuse või veendumuste, vanuse, puude või seksuaalse sättumuse alusel oleks diskrimineerimine keelatud samas ulatuses nagu rahvuse, rassi ja nahavärvuse puhul. See tähendab diskrimineerimise keeldu lisaks töö- ja kutseõppe valdkondadele sotsiaalhoolekande-, tervishoiu- ja sotsiaalkindlustusteenuse, sealhulgas sotsiaaltoetuste saamisel; hariduses; ning avalikkusele pakutavate kaupade ja teenuste, sealhulgas eluaseme kättesaadavuses. Seaduse muutmisega saavad kõik nimetatud rühmad pöörduda võrdõigusvoliniku poole. Muudatused on kavandatud jõustuma 1. juulil 2023. Lisaks seaduse kohaldamisala laiendamisele sisaldab eelnõu paari normitehnilist või täpsustavat muudatust, sh puudega inimeste õiguste ja vabaduste tagamise meetmeid, seoses jõustuva toodete ja teenuste ligipääsetavuse direktiiviga. Muudatus laiendab võrdõigusvoliniku pädevust, tagades parema õiguskaitse diskrimineerimisjuhtumite korral abi saamiseks. Muudatused on kavandatud jõustuma üldises korras.
