Summary
Eelnõu muudatused annavad riigile paremad võimalused tõrjuda massilist sisserännet hädaolukorras, kui välismaalased tungivad ebaseaduslikult üle Eesti riigipiiri ja esitavad põhjendamatult rahvusvahelise kaitse taotlusi. Muudatuse kohaselt võib Politsei- ja Piirivalveamet (PPA) jätta hädaolukorras ebaseaduslikult riiki saabunud välismaalase rahvusvahelise kaitse taotluse vastu võtmata ja ta ilma lahkumisettekirjutust või sisenemiskeelu otsust tegemata tagasi saata. Eestisse tohib välispiirilt siseneda üksnes avatud piiripunkti kaudu. Ühtlasi antakse seadusega PPA-le õigus määrata asukohad, kus välismaalane rahvusvahelise kaitse taotlusi esitada saab. Eelnõuga muudetakse paindlikumaks ka Kaitseväe ja Kaitseliidu kaasamine avaliku ja põhiseadusliku korra kaitsmisesse, juhul kui PPA ressurssidest ei piisa. Praegu saab Kaitseväge või Kaitseliitu kaasata kõige kauem 30 päevaks, kuid see ei vasta muutunud julgeolekuolukorrale, kus kaasamise vajadus võib olla pikem. Seletuskirjas märgitakse, et kunstlikult tekitatud rändesurve regioonis näitas, et Eesti õiguskord peab olema valmis taolise hübriidrünnaku haldamiseks ja massilise sisserände hädaolukorras julgeoleku tagamiseks.
