Summary
Eelnõuga uuendatakse lasteaedade ja lastehoidude süsteemi ning luuakse senisest suurem sidusus alushariduse lõpptaseme ja põhihariduse lähtetaseme vahel. Senise koolieelse lasteasutuse seaduse asemel on plaanis kehtestada uus seadus, mis sätestab alushariduse korraldamise alused, selles osalevate isikute õigused ja kohustused, munitsipaal- ja eralasteaia ning munitsipaal- ja eralastehoiu tegevuse, rahastamise ja järelevalve. Eelnõu kohaselt tuleb lasteaedades õppe- ja kasvatustegevuse korraldamisel lähtuda kaasava hariduse põhimõtetest. Eelnõuga määratletakse näiteks tingimused tõhustatud või eritoe rakendamiseks. Eelnõuga muudetakse paindlikumaks rühmade moodustamine. Suurem roll antakse lasteaia hoolekogule, kes avaldab arvamust ning teeb ettepanekuid õppe- ja kasvatustegevuse kohta, samuti huvitegevuse korraldamiseks lasteaias. Eelnõu näeb ette, et lasteaia õppekeel alates kolmeaastastest lastest on üldjuhul eesti keel ja igas rühmas peab olema tagatud vähemalt üks eesti keelt valdav täistööajaga õpetaja. Lasteaia pidaja otsusel võib lasteaias või rühmas lisaks eesti keelele kasutada ka teist õppekeelt või teisi õppekeeli, kuid eestikeelne õpe peab olema tagatud vähemalt pooles ulatuses. Eelnõu kohaselt määratakse uudsena nõuded lasteaia abiõpetajale, kellel peab olema keskharidus ja kutseseaduse alusel antud lapsehoidja kutse või keskharidus ja pedagoogilised kompetentsid. Lasteaiad loetakse eelnõu järgi asutatuks õppeõiguse andmisega, lapsehoiuteenust saab osutada tegevusloa alusel. Senised lapsehoiuteenuse pakkujad peavad oma tegevuses edaspidi lähtuma tegevuskavast, mis on koostatud alushariduse riikliku õppekava alusel. Alushariduse riikliku õppekava kehtestab valitsus. Eelnõuga ei muudeta lasteaia rahastamise süsteemi, kuid eelnõu kohaselt tuuakse võrreldes senise seadusega selgelt välja, et KOV võib vanema osalustasu ja toidukulu kas osaliselt või täies ulatuses katta. Eelnõu seadusena rakendamisega kaasnevad aastatel 2022-2024 kulud seoses lasteaia pidajatele eesti keele õppeks summas 2,7 miljonit eurot aastas. Vastavalt riigieelarve seadusele jätkub KOVide toetamine antud valdkonnas sarnaselt senisele.
