Summary
Eelnõuga luuakse võimalus rakendada õpilaste suhtes täiendavaid mõjutusmeetmeid eesmärgiga tagada turvaline, õppimist soodustav koolikeskkond. Luuakse võimalus rakendada mõjutusmeetmeid õpilaste suhtes, kelle kasutuses koolis on keelatud ese. Koolil on põhikooli- ja gümnaasiumiseaduse §-st 44 tulenevalt kohustus tagada koolis viibivate laste turvalisus ja tervise kaitse. Turvalisuse tagamiseks, ohuolukordade ennetamiseks ning vajadusel sekkumiseks näevad muudatused ette võimaluse koolil rakendada täiendavalt kolme mõjutusmeedet: esiteks selliste esemete ja ainete kooli hoiule võtmine, mis on keelatud põhikooli- ja gümnaasiumiseadusega, muu asi, mis võib kujutada ohtu õpilase ning teiste isikute elule ja tervisele. Eelnõu kohaselt on lubatud õpilase ja tema esemete kontrollimine vaatlemise ja käega kompimise teel, samuti õpilase kasutuses oleva suletud kapi kontrollimine vaatlemise teel.
