Summary
Eelnõuga viiakse Eesti riiklik õigus vastavusse ELi vastava määrusega, mis käsitleb võitlemist terroristliku veebisisu levitamise vastu (TCO määrus). Terroristliku veebisisu eemaldamine on Euroopa Liidu ja liikmesriikide jaoks oluline ülesanne, mida toetavad ka veebimajutusteenuse pakkujad, nagu Google, Facebook, Twitter ja Youtube. Samas on ilmnenud, et taolise veebisisu eemaldamine oleks veelgi tõhusam, kui terroristlikku sisu oleks võimalik määratleda Euroopa Liidu tasandil ning ühtlustada selle käsitlemise ja eemaldamise reegleid nii veebimajutusteenuse pakkujate kui ka terrorismi vastu võitlevate ametkondade jaoks. Terroristliku sisu ühtsel määratlemisel ja eemaldamisel ning muude tugimeetmete rakendamisel on vaja kogu Euroopas tagada meetmete otstarbekus, proportsionaalsus ja põhiõiguste kaitse. TCO määruse põhieesmärk on parandada Euroopa Liidus koostööd veebimajutusteenuse pakkujatega, et tõhustada terroristliku veebisisu eemaldamist. Regulatsioon puudutab vaid avalikke veebilehti. Kohaldamisalasse kuuluvad sotsiaalmeedia, video, pildi ja audio jagamise teenused, mille puhul avaldab veebimajutusteenuse pakkuja kasutaja soovil veebisisu, mis on avalikult kättesaadav ja millele ei ole juurdepääsupiiranguid, näiteks parooli või krüpteeringut. Veebimajutusteenuse pakkujad on kohustatud võtma vajalikke meetmeid, et tõkestada terroristliku veebisisu levikut, ja sellise sisu esinemise korral eemaldama selle või blokeerima sellele juurdepääsu. Eelnõuga reguleeritakse infoühiskonna teenuse seaduses TCO määruses sätestatud avalikult kättesaadava terroristliku veebisisu levitamise vastaste meetmete üle järelevalve teostamise pädevust. Lisaks TCO määrusest tulenevale muudatusele muudetakse karistusseadustikku selliselt, et üleskutse panna toime terrorikuritegu ei pea alati olema avalik.
