Summary
Eelnõuga luuakse regulatsioon avalikust ruumist sinna mittesobivate rajatiste, eelkõige punamonumentide, eemaldamiseks. Seni on tulnud keelatud sümboolikat kandvate monumentide teisaldamisel tegutseda üldiste korrakaitse- ja karistusnormide alusel, vastavad normid sätestatakse nüüd ka ehitusvaldkonna reeglites. Eelnõuga täiendatakse ehitusseadustikku ja täpsustatakse, et hoone avalikult nähtav osa, samuti avalikult eksponeeritud monument, skulptuur, ausammas jms rajatis, ei tohi olla vaenu õhutav ega toetada või õigustada okupatsioonirežiimi, agressiooniakti, genotsiidi, inimsusevastase kuriteo või sõjakuriteo toimepanemist. Eelnõuga sätestatakse ühtlasi riigi volitused nõuetele mitte vastavate rajatiste eemaldamiseks. Rajatised peavad olema kooskõlla viidud uute nõuetega kolme kuu jooksul pärast seaduse jõustumist. Riiklikku järelevalvet ehitusseadustiku nõuete järgimise üle teostavad üldjuhul kohalikud omavalitsused. Seoses kehtestatava uue nõudega antakse Justiitsministeeriumile volitus teostada omavalitsuste üle haldusjärelevalvet. Vaidluste lahendamiseks moodustatakse valitsuskomisjon, kes saab anda hinnangu rajatise nõuetele vastavuse kohta. Eelnõus nähakse ette, et komisjoni peab kindlasti kuuluma Muinsuskaitseameti esindaja. Mälestiseks oleva või muinsuskaitsealal asuva ehitise puhul võetakse arvesse ka muinsuskaitseseadust ning järelevalve tegemisse tuleb kaasata ka Muinsuskaitseamet, kes annab arvamuse, kas tööde tegemiseks on vaja taotleda luba.
