Summary
Eelnõu eesmärk on võimaldada üleminekut digitaalsele asjaajamiskorrale (samuti kohtumenetlustele) ning laiendada vanglas kinni peetavate isikute võimalusi taasühiskonnastavateks tegevusteks (interneti kasutamise võimaluste laiendamine, mobiiltelefoni kasutamise võimaldamine avavangla kinnipeetavatele, samuti lühiajalise väljasõidu ajaks mobiiltelefoni kasutamise võimaldamine, lühiajaliste kokkusaamiste laiem võimaldamine, sh telesilla vahendusel). Selliseid õigusi ja kohustusi reguleerivad sätted on püsinud suuresti muutumatuna, kuid arvestades ühiskonna arengut, on otstarbekas liikuda vastavalt võimalustele üle digitaalsele asjaajamisele ka vanglas ning avardada kinnipeetavate võimalusi tehnoloogia kasutamiseks. Eelnõuga vähendatakse seaduses sätestatud maksimaalse kartserikaristuse pikkust, et viia VangS-i sätted kooskõlla rahvusvaheliste soovitustega, nähakse ette sissenõudmisele kuuluvate nõuete kinnipidamine vahistatu isikuarvele kantava raha arvelt ja muudetakse kriminaalhooldusaluse joobe tuvastamise dokument otsetäidetavaks, et vähendada tarbetut töökoormust. Vangistusseadust on aja jooksul muudetud peamiselt mõnda konkreetsesse valdkonda kuuluvate (nt arestimajade ülevõtmine) või üksikküsimuste lahendamiseks, kuid praeguse eelnõuga lahendatakse mitmeid praktikas tõusetunud probleeme, mis puudutavad läbivalt kogu seadust (sh ühtlustatakse läbivalt mõistekasutust ja tehakse seaduse tekstis muid tehnilisi täpsustusi). Krminaalhooldusseaduse muudatus hõlbustab ekspertiisikulude sissenõudmist kriminaalhooldusaluselt, kaotades vajaduse tarbetu tsiviilkohtumenetluse järele, milles üksnes kinnitatakse joobe tuvastamise dokumendi olemasolu ning kohustatakse isikut ekspertiisikulud hüvitama. KarS-i muudatusega muudetakse karistatavaks kinnipidamiskohas aine ja eseme ebaseadusliku üleandmise katse.
