Summary
Eelnõuga viiakse finantssektori karistuste ülemmäärad kooskõlla EL-i õigusega ning võimaldatakse kohaldada Eestis EL õigusaktides sätestatud ülemmääraga rahalisi sanktsioone. Eelnõuga muudetakse finantssektori kehtivate rahatrahvide ülemmäära ja nende arvutamise aluseid. Eelnõuga tõstetakse nii füüsilisele kui juriidilisele isikule väärteo eest kohaldatava rahatrahvi ülemmäära, mis on enamikel juhtudel kuni 5 miljonit eurot. Samuti saab määrata rahatrahviks kuni 10 protsenti juriidilise isiku või tema konsolideerimisgrupi käibest või rahatrahvi, mis vastab kuni kahe- või kolmekordsele rikkumise tagajärjel saadud kasule või ära hoitud kahjule. Näiteks suureneb panga poolt Finantsinspektsioonile teabe esitamata jätmise eest määratava rahatrahvi ülemmäär 32 000 eurolt 5 miljonile eurole. Lisaks muudetakse rahapesu ja terrorismi rahastamise tõkestamise seadust. Eelnõuga sätestatakse, et kui rahapesu kahtluse korral ei ole vara omanik või valdaja tõendanud vara legaalset päritolu, võib rahapesu andmebüroo taotleda halduskohtult loa vara käsutamiseks üheks aastaks. Sel ajal on vara omanikul või valdajal kohustus tõendada vara legaalset päritolu. Kui seda ei õnnestu kindlaks teha, võib rahapesu andmebüroo taotleda halduskohtult luba vara riigi omandisse kandmiseks. Kehtiva õiguse kohaselt võib käsutamispiirangu seada kuni üheks aastaks siis, kui vara omanikku või tegelikku kasusaajat ei ole õnnestunud kindlaks teha. Kehtiva õiguse kohaselt ei ole isikul kohustust tõendeid esitada. Samuti karmistatakse rahapesu andmebüroo poolt antava tegevusloa nõudeid. Eelnõu kohaselt tuleb edaspidi kontrollida ka juhatuse liikme mainet ja sobivust. Samuti peab edaspidi äriühingu registrijärgne asukoht, peakontor või filiaal asuma Eestis. Eelnõuga tõstetakse finantseerimisasutuse, virtuaalvääringu raha vastu vahetamise teenuse pakkuja ja virtuaalvääringu rahakotiteenuse pakkuja tegevusloa riigilõiv 345 eurolt 1300 eurole.
