Summary

The aim of the bill is to strengthen consumer awareness and guide them to make more sustainable consumption decisions. To this end, the requirements for providing pre-contractual information are supplemented so that consumers can have a better understanding of the characteristics of the products, including their durability and repairability, before making a purchase decision. The changes take over the requirements of the EU directive, which specifies the obligations of businesses and the rights of consumers to promote greener consumption. According to the draft, the obligation to provide the consumer with additional information before concluding the contract extends to the entrepreneur. In the future, the consumer must be informed about the availability of free software updates and the repairability of products. A product's repairability score is a score based on EU requirements that shows how easy it is to repair a product. Currently, the obligation to submit a repairability score applies to smartphones and tablets. In cases where the repairability score is not appropriate, the entrepreneur must provide information about the availability of spare parts and repair and maintenance manuals, as well as possible repair restrictions. The consumer must also be given information about environmentally friendly delivery methods. In addition, it is stipulated that businesses must introduce a harmonized notice and label reminding the consumer of his rights in case of non-conformity of the goods. If the manufacturer offers a sales guarantee related to the durability of the products, it must to present information about this to the consumer through harmonized labeling to ensure better comprehensibility and comparability of the information. Stores and e-shops display a unified notice of consumer rights.
